The minutes of the previous adjourned regular meeting of Sep- tember 8th, 1930, were read and approved. V~RITTEN COICATIONS: A communicat on was received from ~'~alter E. Mellinger, Sec- regary of the Chamber of commerce inviting the Ccuncil to attend a meeting of the Exchange Club September 23rd. It was moved by Council- man gimble and seconded by Councilman Anderson that the invitation be accepted and as many as Dan attend. ~~otion was carried and so ordered. A communisation was received from L. g. Chamber of Commerce inviting the t%puncil to attend the opening of Sepnleveda Highv-ay .:~_~. ,~ ~: on September 27th, also an invitation from Pacific Coast Building Officials Conference urging the Council to authorize the Building In- spector to attend the 9th anneal meeting at Long B®ach, California, September 28th to October 4th. tt was moved by Eouncilmsn Williams and seconded by Councilman Tweedy that same be ordered placed on file. emotion was carried and so ordered. An application was reQeived from Dr. ~~thur E. Joseph making application to conduct a Veterinarians office at 1©523 L. B. Blvd. Mayor Snodgrass appointed Chief of Police Hogan a committ®e of one to investigate this matter. The following applications for employment w®re received: J. B. Demarest applying for position as ~8t~hman on school zones and Vern H. Fisk applying for position as police officer. It was move8.by Councilman Tweedy and seconded by Councilman Anderson that same be placed on file. motion was carried and so ordered. A written opinion was received from City Attorney ges$ re- lative to non-employment of all persons who are not citizens of U. S . in all pub ~.ic work, ~ iaclnding work performed by Contractors for the ~%ity, to the effect that any ordinance requiring the employment of reaid~ents of the City of Contractors for public work where comps - titive bidding is required by law is unconstitutional. There being no objection, the t"ayor ordered same placed on file . A written opinion was received from City Attorney Hess re- lative to the renting of houses within the City of Lynwood to others than those of the Caucasian race, stating that the City has no power bra ordinance or otherwise to adopt any penal ordinance making it a prime to rent property- other than tho ~e of the Caucasian race . There being no objection, the Mayor ordered same placed on file. A written opinion was received from City Attorney Hess rela- tive to the proposition of employing ~~r. Erkfitz as Policeman and the effect of the vote of the Council upon same at the meeting of the Coun- cil previous to August 25th, 1930, giving the opinion that under the circumstances where two members of the Council voted to employ fir. Erkfitz, two did not vote, and one voted against his employment he was of the opinion that the paym®nt of salary to him is improper. The Mayor ordered same placed on file. Upon investigation it was found that ter. Erkfitz was employed as Eztra Patrolman by Resolution No. 737 on the 8th of September, 1930 by a majority vote of the Qouncil. Mr. A. B. Gray addressed the Council and called attention to the excessive rate of epee d by automobile drivers by some motorists between Californig Street and. Long Beach Boulevard on Imperial Highway suggesting that a EO mile zone be established there. Mr. Francis Mar-~ shall also addressed the Council regarding traffic regulation. Thereupon it was moved by Councilman ~Iilliams and seconded by Councilman Kimble that Chief of Folios Hogan be instructed to enforce the 15 and 20 mile speed limit more st~gently. It was moved by coun- cilman Tweedy and seconded by councilman Anderson that permission be granted for this purchase and same to be paid out of the Con- tingent reserve Fund. Roll Call: Ayes : Councilmen Tweedy, Anderson, Ki~ble and Snodgrass . Noes: Councilman ~'~illiams. The City Clerk called attention to tl~ie Council, that the State Compensation Insurance policy would expire September 23rd. Thereupon,it was moved by councilman Anderson and seconded by councilman Tweedy that the Mayor be authorized to execute the demand for the continuance of the Compensation Insurance policy to the City from the State Compensation Insurance Fund, in behalf of the City of Lynwood. Roll Call: r Ayps: Councilman V~illiams, Tweedy, Anderson, Kimble and Snodgrass, .'; ~~ Noes : None . City Attorney Hess reported relative to the Buick car owned by Chal'res ~~. Ecker, formerly police Officer, who signed up his contract in the name of the Police. Department, City of Lynwood, and also obtained exempt license plates, stating that Chief of Pollee Hogan now had in his possession the license plates and white slip, being the certificates of registeration. Attorney Hess stated that it is the custom to permit the issuance of police exemption plates ,which is done by signing the registration card of legal own- er by the party who awns the car 8nd registered owner, the City, and that the statement requires the setting forth, that the oar 3s• to be used exclusively for the City business. If the legal owner is one party and the registered owner is a City, the City is not the owner of the car, and in case of accident the City is not liable. In .any event, permission should be granted by'the Council of the City. Attorney Hess suggested that the Chief of Police get rid of the plates and white slip by turning them over to the California &kgtor Vehicle Department. Attorney Hess further stated that the City has no authority to take possession of the car. Chief of Police Hogan addressed the Council at this time regarding same. At this time Councilman ~Jilliams stated that he would be wilting to give ~100.0C~ reward out of his own pocket for the arrest .and conviction of Charles R. L'ckert as he is a crook and professed bootlegger. Councilman ~'dilliams farther stated that Chief of Police Hogan and members of the Police Department refused to put Ir. Ecker under arrest. Chief of Police Hogan addressed the Council and resented the statement dust made by Councilman V~illiams, stating that he brought ~~r. Ecker into Judge C. E. Day's Offic®,. bat, that we had no legal grounds to hold him at this time. City Attorney Hass stated that he was of the opinion that the City had no charge to,prefer against Nr. L'eker as he had not Violated any City Ordinance but, if there was a charge on account of signing the City of Lynwoo d to the ocntract,'it would have to be handled through the District A~ttorneya~s office . City Attorney Hess stated that he had no report to make regarding the claim of ~p141.00 due the t~~later Department as yet. Oi~AL CO1~~UNICATI©NS f Au itor Francis rshall addressed the Council and stated ~,;. that the Southern Pacific Railroad Company are getting ready to improve the crossing at their right-of-way at Century Boulevard anc9 Alameda: qtr. Marshall, also stated that he had interviewed ilr. Pon- flue, President of the Pacific Electric Railway, relative to a point meeting with the Council at Lynwood; but, he would be unable to come to Lynwood, however, if a meeting could be arranged at Los Angeles, he might ~e able to attend. L~r.~t~arshall then .invited the Council fora luncheon on Thursday, when 2~`r. Pontius will be request ed to attend, and if he is unable to attend, he may be interviewed at his office. Mr. Marshall also reported regarding the dam at the Los Angeles Flood Control stating that the matter has been referred to Masers. gnickerboeker and Adamson for consideration and they will communication with the '~ounail. dir. Marshall also stated that he has r®ceived a eommunieation from Supervisor Quinn and he has had a letter from Union Pacific railroad Company and they are willing to have a meeting next Thursday regarding said matter. .~." Councilman Williams l a so asked about an ..alley intersecting with Platt Avenue, stating that the water stands there durin the se o g r sy ason on account of a depression there. City Treasurer Reed again addressed the Council and reported relative to the claim far Attorney's fees of C raueh 8c Crouch which was referred to him for checking at the previous meeting stating that B. A. Ha ne was ~ y appointed Attorney at the beginning of the proceedings in the matter of A. & I. fist. No. l8 (Centur B l ' y ou evard) and he could not find in the records where he had been relieved as such attorney but Crouch & Crouch h d , a also been appointed therefore Mr Reed re- eammended ~I-syment of the bill after a waiver is ~ ~ ~ procured fror~a B. A. Hayne .
