Councilmen 4'Villiams, Anderson ^'imble and Snodgrass answered the roll call. Councilman Tweedy was absent. Cite Attorney Hess and -=ngineer Bateman were present, The minutes of the previous regular nn eeing of ~`etober 7th were read and approved. ;WRITTEN CO~i1IUNICATIONS communication was received from Lynwood-Compton Shopping News making application for license to do busirxtse in the City _of Lyn- wood at 11408 L. B. Blvd. where they will conduct a general advertis- ing agency, Mr. C. ;~. Bigsby representing the Lynwood-Compton Shop- ping hews addressed the Council on said application. 1'he Mayor stated to Mr. C. PI. Bigsby that he should make application to the Chief of Police . A communication was received from Alfaretta VV. LePage stating that a leak in the gas main in front of the place at 3243 Luelid Ave. killed about fourteen feet of hedge, two shade trees in parking and some of the grass asking that steps be taken to investigate this mat- ter. The Mayor instructed the City C'_erk to write a letter to the Southern California Gas Co. requesting them to investi~;ate ~aaid matter. The following application for employment were received; also the re port of L. A. CounttT Health Department of services rendered; James Y. '~ilson, applying for position as motor cop or other work; R. Nelson dValker, appl.~7ing .for position as speed cop and Pearl E. Haack applying for position on election board. There being no .objection, the hayor ordered same placed on file. ORAL COrJl~UNiCATIO~iS idney mit addressed the Council asking that the Coun- cil take some action on the petition for the paving of the alley east of L. B. Blvd. between Platt Avenue and Sanborn Avenue which had been filed some time ago, stating teat the petition contained 71,4jo of the property owners fronting on said alley and that relief is urgently de- sired before the rainy season. City Attorney Hess stated that at the convention of the Lea- gue of T:~unicipalities held at Long Beach, discussion was had regard- ing the improvement Bond dot of 1915, and it appears tom: t there are two test cases in Court regarding the constitutionality of the Aet and in view of the litigation a better price might be secured from contractors if bids were called for under the 1911 Act for the improve- ment of said alley. Thereupon it was moved by Councilman Anderson and seconded by Councilman Williams that the matter be referred to Engineer Bateman and he be instructed to prepare plans and specifications and resolu- tions necessary to cormnence the proceedings for said work. moll Call: Ayes: Councilmen y~Jilliams, Anderson, nimble and Snodgrass. Steltzer addressed the Counc ~.l re ardi g ng wires having been instal led by the Telephone Co. at the corner of ~'ernwood Avenue and Peach Street (south roadway of FernwoodAve.) stating that they ran the wires across her Lot, whereas then should have run them alor~ the parking . The Mayor instructed the City Clerk to write the Southern Cal- ifornia Telephone company asking them to remove the wire. It was moved by Councilman And- erson and seconded by Councilman F:imble that said Ordinance No. 150 be adopted as read the second time, finally passed and published as re- quired by law. ORDINANCE N0. 151, entitled: "AN ORDINANCE OF THE CITY OF LYN- YVOOD AMENDING ORDINANCi: N0. 137, FIXING SALARIES, by providing for the salary of pity Judge at X225.00 per month, was xead. Absents Councilman Tweedy. the Cite Clerk presented s Grant of Easement desired by the Southern California Edison Co. from the City of Lynwood, stating that a clause had been inserted that the Grant of Easement shall be used to convey electricity at a voltage not to eases d 16000 volts. Consider- able disnussion was then had regarding said matter and the Mayor in- structed the City Clerk to write the Right of 6YSy office at Los 6ngeles and ask that a representative be present at the next meeting of the council to explain more in detail the proposition. A communication was received from the Pacific Rlectric Rail- road Co. addressed to the Mayor regards the drainage condition along the P. E.~right Eof way: stating that theity of Zynwooci were to comer with the ounty 'ngineers regarding said matter and when you have reached an understanding as to improving :these conditions the City should advise the Pacific Electric. The ~~a.yor instructed the City Clerk to write to the Board of Supervisors asking them to $end a Dopy of the franchise on which the pacific Electric is operating from Zos Angeles t.d Santa Ana through Lynwood. Discussion was had regarding the cX.aim of Dr. Copeland far services r ndered in examin~.a~~certain into aioated persons in the amount of 9.00. thief of ?'olice Hogan Aresented a letter from H. G. McOarthy, Deputy District .A.ttorney stating that a Chiropractor caam testify in Court on persons charged with being under the influence of intoxicated liquor, which was read. Whereupon it was moved by Councilman Williams and seconded by Councilman Anderson that the claim of Dr. Copeland in the amount of X9.00 be allowed and warrants drawn on the City Treasurer for said arsount and the Chief of Police be instructed that in the future only Medical Doottrs be called to examine intoxicants; also that the demand of Ramley & Bert be allowed in the amount of 14.25 ~ba---~-1~4w~-d and a we,rrant be drawn on the City Treasurer for said amount. Councilman Anderson reported regarding the bill board next to 10341 Long Beach Boulevard, stating that aYilliame and himself had viewed same, but as same is located on private property, nothing can be dole to relieve the situation. Engineer Bateman presented a map showing where i~isconsin is cl©s®a on account of a Lot running into the Street at Long Beach Boule- vard and stated that he had been unable to get in touch with the owner of the Zot as yet. A communication was received from George W. Crouch, by Roscoe R. Hess, Special Attorney inthe Matter of Oentury Boulevard with 8 cer- tified copy o-~ Final Judgment in case of City of Lynwood vs. L. C. ,~- ley,- et al for the widening of said Boule yard. It was moved by Coun- cilman Anderson and seconded by Councilman gimble that the Final Judg- ment be accepted and the City Clerk be instructed to have said instru- ment recorded in Los t'ngeles County Recorder's office . City Attorney Hess read his written opinion regarding the claim of one Thomas Mason for one day`s services as a wit$ess for the City in the Case of City of I,ynwoo d vs . Cahill, et al, stating that~any extra compensation for his appearance in Court was a matter that should be properly cared for by the Judge hearing the exceptions and°inasmuch as the Special City Attorney in said matter is of the opinion that the bill should be disalltdwed I do not fee 1 inclined to rec a~mmend the approval of the bill . There being no objection, the Mayor ordered same placed on file. City Attorney Hess read his report regarding the claim of Hare ~: Walden, Attorneys for professional services in the sum of X150.00 for drawing an Answer and appearing at the trial on behalf of three de - fendants in the case of City of Lynwood vs. Reber, stating that he finds no aat'horit~ in the Acquisition and Imprrnrement Act of 1925 for payn¢ent of a bill of this sort, stating further that costs of defendants can ~~~~ be all~r~sd. ~.~ the ~~~.gt~er~t, but the~A ~g ~o pr~visien for evnsidering the Attorna~'s ~~~~ cif defendants as an incidental expense. ~teport- ing further that it was with regret that he must disapprove the bill as being unwarranted at law. Thereupon it was moved bZs Councilman Thimble and seconded by Councilman Anderson that the bill of `Tom Mason in the amount of 50.00 and the bill of Hare and d~lalden in the amount of x'150.00 be disallowed in view of the City Attorney's opinion. Chief of Police Hogan addressed the Council and stated that he wished Ben Christensen reclassified from that of a Patrolman to that of a motor cycle officer. Thereupon it was mOV@d by CounCi].man Kimble and $eooAded by Councilman Anderson that Ben Christensen, ;reclassified from that of a Pa- trolman to that of or oycle o~fieer to take effect immediately.
