Mayor Snodgrass in the chair. Councilmen Williams, Tweedy, Anderson, gimble and Snodgrass answered the roll call. tai ty gttorney Hess and Engineer Bateras.n were present. The minutes of the previous adjourned regular meeting of November 25th were read and approved. A report of the activities of the Police Department for the month of November was received signed by Thoma$ J. Hogan, Chiei' of Police. A communication was received from Feli$ P. Eisenbeis, making application to audit the City Books. ®lsa the report of the County health Department was reoeived. There being no objections, the Mayor ordered said reports and application placed on file. The fallowing applications were received for City Mevhanic: George A. Thierer, Jack L. Farren, Harry li~ade, W. G. Rice, ~. H. Fisk and D; J, Holmes; also the Mulford Garage present d a bid to do the mechanical work on the present city equipment for 150.00 per month. Mr. J. g. Bishop addressed the Council making application for the fob stating that the Bisho 's p garage are willing to do the 4~ity mechanical work at their garage for X100.00 per month, the City to buy their own parts, or he will buy same and sell them to the City at wholesale prices. Thereupon it was moved by Councilman 9illiams and seconded by Councilman Anderson that Mr. J. A. B3.shop be employed on trial for one month to do the mechanical work at the Bishop Garage at a slary of 100.00 per month, not including parts. Councilman gimble having not been served of a notice of the special meeting of the Council on November 28th, 1930 due to her be- ing out of town, City Attorney Hess stated that it might be ad~risable to vote on the resignation of George Porter as City N[eehanie again. Thereupon it was moved by Councilman Anderson and seconded by Councilman gimble that the resignation of George Porter be filed and that it be accepted as of its date November 28th, 1930. The hour of 8:00 o'clock P~ ICI. having arrived, said time be- ing the hour set for receiving bids as per notice inviting sealed pro- posals for the paving of the first alley easterly of Long Beach Boule- vard, between the northerly line of Platt Avenue and a line 4:50 feet northerly of and parallel to the southerly line of Sanborn Avenu®. The Mayor inquired of the audience whether or not there was any on® __ present who had any bid they wished to present at this time. thereupon it was moved by Councilman Tweedy and seconded by ;~- Couneilman Williams that the bids be publicly opened and declared. It was moved by Councilman 4nderson and seconded by Councilman Williams that the bid and letter submitting formal bid to maintain orn- mental lighting standards be refferr®d to Engineer Bateiman and Water Superintendent Cummings for checking. Cdr. i'a~l Huebner addressed the Council stating that he was appointed by th® Lynwood Welfare Division of the Chamber of Commerce to ap ear before the Ccuncil to ask far an appropriation not to ex- osed180.00 to help out with the Christmas c®1®bration. City Trea- surer Reed asa addressed the Council regarding this utter siiating that X25,00 per month had previously been appropriated in the promo- tion a~ Welfare work and that there is now a small balanoe remaining. Mr. George Girasier also addressed the Council regarding $aid matter favoring of the appropriation. Thereupon it was moved by Councilman Williams and seconded by Ceux~cilman Anderson that the city appropriate the sum of 150.00 to ae~bst in the cand~ctix~g of a Christmas oelebratian by the Wel- fare Divzsian of the hamber of Commerce of the pity of Dynwood.and to be disbursed in the payment of bills fox '~hristmas tree and music. Roberts who is employ'®d as a voluat®er fixeman and is a minor, stating that he cannot .find ~ything in the law that payment of the demands would be illegal, stating ~'titrther that it was a matter of policy to b® decided:by the,Couneil. Fire Chief Roberts addressed the Council stating that the book of regulations by the Fire Underwriters, do ~~t say that it is unlawful to employ a minor. No action was taken. A communication was r®eeivad from Wailes Dave-Hermiston Cor- poration by ]~. F. Penton submitting bid for cleaning the interior sur€aee of a E5 000 gallon water storage tank and applying one coat of Wailes Dave $itumsstic enamel, for the sum of X235.00 with a five t'sars' guarantee. ~_ It was moved by Councilman Wi~.liams and seconded by Couneil- ~ man. Andersen that the bid of Wailes Dove Hermiston Corporation for the interior surfacing of said tahk be accepted and awarded to said Coape~ration. Bigsby regarding petitions signed by 730 residents of Lyn- wood against the.adoptian of a proposed ordinance prohibiting the distribution of advertising matter, asking that na regu.lation be placed on such distribution in this Ci ty. Also the petition bearing the signatures was presented. Mr. F. Beating addressed the Council regarding said matter. ~' It. ~.s moved by Councilman T~illiams and seconded by Coun- cilman Tweedy that the matter be laid on the tabl®. After some die- anssion, Councilman Villiams withdrew his motion. Whereupon it was moved by Councilman Kimble and seconded b9 Councilman ~filliams that we grant the prayer of the petitions and re- peal all ordinances on distr#bnting of advertising matter in the City of Dyn~ro o d. I~,y submitted bills for appraisal services in the matter of Acquisition and Improvement Distriot No. 25. pity Treasurer Reed addressed the Council stating that there was a surplus in the adva~.ae from the General F and to A. 8c I. Diet. No. 25 fund, but that he was of the opinion, and was so in- _ oformed by Special Attorney Bayne in said matter, that all incidentals ', i had been paid in said matter and therefore has transferred the surplus to the Bond Redemption b'und, stating that he did not know whether or not the bills could be paid by a transfer from the Bond Redemptiion b'und to the C'eneral Fund or not. City Attorney Hess addressed the Council $tati that a transfer had been made from the Gaseral ~'uad to the Bond In~erest and Redemption Fund, and that a transfer beak to the General `and is legal, but that he does not pass on the vali- dity of the bills. Whereupon it was moved bT,~ Councilman Tweedy and seconded by Douncilman Williams that the demand$ be allowed and warrant$ be drawn on the City Treasurer for the amount of 25.00 each, and that a transfer be made from the Bond Interest and Redemption Fund to the b~eneral end to Dover same, Roll Call: Ayes: Councilmen Williams,Wweedy,.AndEerson,~imble & Snodgrass Noes : Drone, 4ity Treasurer Reed presented a bill from Selen Rapper for stenographic services in the matter of Acquisition & Improvement Dietriats I3o. 4 and.6 in the amount of 53.15, stating that h® did not think the bill was dust as he was of the opinion that the speci- al ©ity Attorney in said matter should pay for stenographic services out of his fee. City Attorney Hess ruled on the bill, ®tating that it was a legal demand and could be paid out of the ineidente-ls, however, that it was a matter of policy for the Council to determine, Whereupon it was moved by Councilman Anderson and seconded by Councilman Williams that the demand be referred to the City gtton~ey for checking to present a written opinion. At the consent of Councilman Williams who Seconded the motion, Councilman #ndereon withdrew his motion and after consid®rable discussion it was moved by Councilman Williams and ascended by Councilman Anderson that the bill be disallowed. City Treasurer Reed reported regarding Aoquisition and Im- provement Histriot No. 6 which was referred to him some tim® ago, teasn~ing a statement which ehOSled sash on hand with County Treasurer 968.16. Required to pay all defendants claims with interest X1109.71, Attorney fees, 400.00, leaving a total to clear of X541,58, stating ~_. further that the special City Attom ey is not eneitled to his fees until final • ~ndgment has been entered in said matter. Noes: Councilmen Kimble and Snodgrass, 14J ~- ot~munioation was. received from Thomas J, Hogan requesting the CQUncil to accept his resignation as Chief of Polioe of the City of Lynwood, ~h~ie~' of Polioe Hogan also addressed the Council regarding his r®_signation requesting that his resigns tion be accep- ted as he could not carry on as Chief of Polioe without the co- opestion of the Council. Mr. Zeiler addressed the Council regarding Chief of Polioe Hagan, endorsing Hogan as Chi®f of Polioe, stating that h® believed that Mr. Hogan was the best Chief of Police Lyn- wood ever~:~ had; also ~[r. .4, B. Gray endorsed Air. Hogan as Chief of police requesting that unity be maintained in the Council regarding th® Polioe Department, and Mac. W, H. Sullivan also addressed the Council, endorsing 3[r. Hogan as Chief of Police. .At this time Captain of Folice Gardner addressed the Cournci 1 ~requesting~information from Councilman Williams what charges he had had to make against him, and if he had any, to let him know at this time. C©uncilman Williams did not prefer any charges. Thereupon it was moved by Councilman Anderson and seconded by Souncilman T~relldy that the matter of the resignation of Chief Hogan be laid over to next meeting. Bullis regarding the proposed extension of Santa ~e 4venue through Lynwood suggesting that ~a resolution be adopted and ; a copy be sent to, the County of Los A ®les disapproving the pra~posed County plan for the extension of Santa yo Avenue, only if it meets with the approval of the Coup-- oil. Naesr None. ~[r, L, Budeway representing the Lynwood Compton Shopping ~Tewe addressed the Counci~ requesting information as to who was going to roeecute the case 0ity of Lynwood ps. C. ~, Bigsby of the Lynwood ~offipton Shopping News, for the City of L ynwood, stating that the ,~tt8ge 4tated to him that he thought .,the pity attorney was going to prosecute same. City Attorney Hess stated that it ,was not part of is duti es. Judge Q. E. Day addressed the Council stating to Mr. day ;...that the case would come up for trial on Thursday at 1 P. M. Thereupon it was moved by Councilman &imble and aeaonded by ~onnailman Williemns,that the Mayor be authorized to .employ a spec- ial attorney to prosecute said case at 100 o'clock on next Thurs- day. After considerable discussion, Councilman Wil,lia~i withdrew his second. Mr. Budway requested that the men employed by the Lynwood-Comptcan shopping Nets be allowed to distribute. their paper pend3n the outcome cf the trial, which request was not granted. ~t this time the Paliae Officers appeared before the Council and Offteer Sharp addressed the Council in behalf of the Officers, askirir~ dust what Qouncilman '~illiams had against arty one of the Polies offi ere, if arm, and if he had to present them at this time. Councilman ~f,llisaas did not prefer any charges. Officer Sharp ' stated further that the Police Officers were behind Chief of Police 100 and that above everything else, they have found him square in his dealings, and as for Captain Gardner, Mr. Sharp stated that the officers arebehind ham 100 also. Mr. Sharp stated further that the Police officers duty is to enforce the laws and asked the co- operation of each citizen. Officer Claire 3ledsriak addressed the ~ouneil asking ~louncilman Willimnd to point out the three officers that he saw Derry packages out of Dr. Copeland's hones. Councilman ~illie~rd stated that that was a thing of the past, and officer sharp asked Williams if the matter of $cker's dealings in Lyrm-ood was not also a thing of the past. ~cuneilman Williams stated the matter was in the hands of the District Jttorney. A communication was received from Otis Mitchell, asking per- raission to sell physicians prescriptions for medicine r~rcotics, wines and liquors so long as such prescriptions meet all the re- gairements of the State and Pedestal requirements at his drag store located at 11174 Long Beach Boulevard. city AttorM:ey Hess stated that the City have no ordinance requiring a special permit, but ~-`~l~t he must have a basin®ss license. There being no ob~eotion, the Ma9or ordiered laid communication filed. ~'he City clerk presented and read a petition asking the Council to call aa~=election for the purpose of r®calling .+~ddie ~.i.mble as a member of the Council signed by 14 persons, with a certifiBate attached stating that the number of names who sii gr:.ed said petition are not sufficient to call an election for the recall of said Addie Kimble. The Clerk also stated that he now had on file supplement petitions asking for an eleetian for the purpose of recalling Eddie gamble and requested that the council authorize the employment of additional help to cheek same.
