W H E RE A S, 3 Peruchos, LLC ("Applicant") is the owner of 630 Sunset Circle, Key
Biscayne, Florida, as more fully described in the legal description attached hereto as Exhibit "A"
("Property"); and
,v H E RE A S, pursuant to Section 30-63 of the Village Code of Ordinances ("Village
Code"), the Applicant has submitted a Planning and Zoning Application, seeking a regulatory
variance from the maximum building and wall height envelope requirements of Section 30-
100( c )(2)( c) of the Village Code ("Variance") in order to allow for construction of a third story
on the property; and
W H E RE A S, after proper public notice, the Village Council conducted a public hearing
and considered all testimony and other evidence presented and otherwise made part of the record
concerning the Variance.

S ection 1. R ecita ls. Each of the above-stated recitals are hereby adopted, confirmed,
and incorporated herein.
S ection 2. F indings. The Village Council finds that the Applicant has met all of the
requirements in Section 30-63 of the Village Code. Specifically, the Village Council finds that

the V ariance w ill : ( a) resu lt in con ditions that m aintain and are consistent in all m aterial respects
w ith the intent and purpose of the V ill age C ode, and that the genera l w elfa re, stability and
appeara nce of the com m unity w ill be pro tected and m aintained; and (b) be com patible w ith the
surroun ding land uses, and otherw ise consistent w ith the V illage C ode and the C om prehensive
Plan, and w ill not be detrim ental to the com m unity .
Section 3. Approval of Variance. The V ill age C ouncil hereby appro ves the
A pplicant's request to vary the pro visions of Section 30-10 0( c )(2)( c) of the V illage C ode, subject
to the conditions set fo rth in Section 4 below , to allow the m axim um w all height of a third story
to encro ach into the required m inim um setback lines along the nort h and south sides of the
Pro pert y as show n on the plan attached hereto as Exhibit "B ".
Section 4. Conditions. The appro val gra nted by this R esolution 1s subject to
com pliance w ith the fo ll ow in g conditions:
a. The porch , carport, and covered terr ace on the Pro perty m ust rem ain as such
and m ust not be convert ed into living or habitable spaces unless the applicant
applies fo r and receives a variance to replat the Pro perty fo r deletion or
rem ov al of the currently platted setback lines.
Section 5. Recording. T his R esolution shall be recorded, prior to the issuance of a
buildin g perm it, by the A pplicant at its expense in the public records of M iam i-D ade County,
Fl orida. A copy of the pro of of recordation shall be subm itted to the V illage Clerk prior to the
issuance of any building perm its.
Section 6. Effective Date. T his R esolution shall be effective im m ediately upon
adoption .
