The City Council of the City of Lynwood met in a regular ses- aion at the City Hall, 11331 Plasa Street on above date at 7:30 P. M. Mayor decker in the chair. Councilmen Williams, Davies, Grayson, Snyder and Decker answered the roll call. Councilman Grayson addressed the Council stating that Judge C. E. Day is leaving town and wishes that Judge StanSey Moffatt be given judicial power in his absence and that the Clerk swear him in at this time. Thereupon it was moved byCouneilman Snyder Rnd seconded by Councilman Davies that Judge Day be granted the leave of absence requested and that Judge Moffatt be sworn in by the Clerk as Judge in his absence, without compensation. Roll Call: Ayes: Councilmen Williams,DAvies, Grayson, Snyder and Decker. Noes: None. Thereupon the City Clerk imposed the constitutional oath oP office. Judge C. E. Day addressed the Council stating that he expects to return next Monday. The minutes of the previous regular meeting, of May 12th were read and approved. WRITTEN COMMUNICATIONS: common ca on was received Prom Harry E. Bunnell and Associ- ',. etas, Accountants making application to audit the City books. There be- ing no objection, the Mayor ordered same filed. Communication were received from Safeway Stores, Harbaugh & Peters at Imperial Market, Corner Grocery, by H. S. Fletcher and Lynwood Press, protesting the adoption of the proposed ordinance prohibiting di~- tribution of advertising matter in the City of Lynwood. The Mayor .ordered this matter laid aside until the nuisance ordinance is taken into consi-. deration. A communication was received from Wm. E. Homme to the effect that C.W. Rice who platted some acreage in the City of Lynwood is not living up to his promises as to the improvement of streets, etc., request- ing that the City make an effort to have hire construct the improvements which he agreed to and as per contract. City Attorney Hess addressed the Council to the effect that the City have no power to accomplish any relief as it is an individual matter and will have to be handled by civil action against the subdividor by the purchasers. Thereupon the Mayor in- structed the City Clerk to replg to Mr. Homme's communication informing him of the status of the matter. An application was received from Mr. J. C. Helderle,Sr., to erect a stand on Lot 308, Tract 2551, City of Lynwood, for purpose of selling fire works. Thereupon it was moved by Councilman Davies and sec- onded by Councilman Snyder that permission be granted to erect said stand for sale of fireworks, subject to license. Roll Call: Ayes: Councilmen Williams,Davies, Grayson, Snyder and Decker. Noes: None. A communication was received from Dr. G. Edw. Cassady, request- ing to be appointed City Physican whose chief duty would be that of per- forming sobreity tests and examination of those ~*rested on charges of intoxication, either on a monthly rate basis or per individual. There being no objection, the Mayor referred .this matter to Police Commissioner Snyder for investigation and to report back to the Council. A communication wad received Prom the County Health Department submitting quotation of 1930-31 budget. allowance and request for next fiscral year as requested by the Council at a previous meeting to deter- mine whether the Council should adopt a resolution as requested by the Health Department, asking the Board of Supervisors not to .cut the budget for County Health services for next fiscal year. There being no objec- tion, the Mayor referred this matter to Commissioner of Public Health and Safetg Grayson for investigation. A communication was received from St,. Emydous C tholic Church Lynwood, requesting permission to erect a sign on both sues of street at the corner of Mulford Street and Long Beach Boulevard designating lo- cation of church. It was moved by Councilman Davies and seconded by Councilman 'Williams that permission be granted. R oil Call Ayess: Councilmen Williams, Davies, Grayson, Snyder and Decker. Noes: None. A communication was received from Mr. A. B. Gray giving data regarding the wester system of the City of Lynwood Pram its formation to the present time and offering advise on future developments. D[r. Grey also addressed the Council regarding said matter by the Consent of the Mayor at the request of Councilman Williams. There being no objection, the Mayor ordered said communication filed. 23~ Communications were received from Burns-aicDonnel-Smith, En- gineers, City Controller, Los Angeles, City of Glendora, City Service Com- mission of Los Angeles, all making announcement of the short Course on public administraction at the University of Southern Cal ifornia to be held June 8th to 13th, inclusive, 1931. The Mayor r®quested the members of the Council to bear the dates in mind and if any one wishes to attend they can avail themselves of the opportunity. ORAL CO&IMUNICATIONS en eve an , representing the southern Fuel Company, ad- dressed the Council to the effect. that inadvertently the Notice of Proposed Sale and Grant of Franchise recently published fining May 26th, 1931 as the time for receiving bids in said matter for Atlantic Boulevard pipe line,. was 1n error, requesting the Council to re-publish the notice, stet- ~I ing that the Southern Fuel Company are willing to pay for same.. Thereupon 1t was moved by Councilman Davies and seconded by Councilman Williams that RESOLUTION N0. ?79, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD, COUNTY OF LOS ANGELES, STATE OF CALIFORNIA, IN THE M~.TTER OF THE APPLICATION OF SOUTHERN FUEL COMPANY FOR A FRANCHISE AND PRIVILEGE, fix- ing 8 P. REPORT OF SPECIAL COMMITTEES: ' ounc loran rayson repor a on the matter of application of Mrs. Farr & Mr. Horsley for establishment of dairy on Fracar Street stating that under the present ordinane it w111 be impossible to grant the request, but that when the new nuisance ordinance goes into effect, permission may be granted. Councilman Davies reported on the purchase of well site and equip- ment in the Century Square Tract district from Southern Development Co. to the effect that he had an agreeable confernenee with Mr. Mcl~ture and that the Lot an$~ equipment could be purchased for X850+00, recommending that City Attorney be instructed to go into escrow in the matter. .Thereupon it was moved by Councilman Grayson and seconded by CouncilmanWilliams that Councilman Davies be empowered to close the deal and cooperate with the City Attorney in any wag desirable and that the City ps~r one -half of the escrow fee . Noes: None. .;.Councilman Grayson addressed the Council to the effect th#t at the last meeting of the Council a letter was received from certain doctors in the City suggesting the adoption of an ordinance regulating dogs running at large, thereby endangering the spread of rabies as many of the d©gs have not been.,innoculated, stating that the Council have been waiting for a ssn - ple ordinance for Cities to be compiled by~the County, but up to date have not received same and therefore recommended the adoption of a temporary or- dinar}ce to take care of the situation for the Bummer months. Thereupon it was moved by Councilman Snyder and seconded by Councilman Davies that the City Attorney be instructed to draft a suitable ordinance regulating the dog situation for the summer months. ORDINANCE N0. 164, entitled: "AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF LYNWOOD AMENDING ORDINANCE N0. 137 FIXIN4 SALARIES OF OFFICERS AND EMPLOYEES, was read for the second time. It was moved by CounciTan Gray- son and seconded by Councilman Davies that same be adopted as read the sec- ond time finally passed and published as required by law. ORDINANCE NO. b65, entitled: "AN ORDINANCE OF THE CITY OF LYNWOOD AMENDING ORDINANCE NO. 154 OF SAID CITY, FIXING THE TIME OF MEETINGS OF THE CITY COUNCIL OF SAID CITY", was read for the second time: It was moved by Councilman Snyder and seconded by Councilman Davies that same be adopted a~i read the second time, finally passed and published as required by law. The following bids for insurance on metal lighting standards between C~nt~r~r Boulevard and Tweedy Road on Long Basch Boulevard, were received: G. R. Wood, A. L. Young, A. E. Zeiser, W. W. Wilson, Lynwood Real ty Co., Floyd B. Rowlee, Claude L. Reber and F.B. Roberts. The Mayor appointed Councilman Williams and Councilman Davies to act on a committee to investigate said bids and report back to the Council their findimgs. Councilman Davies addressed the Council to the effect that through certain manipulations he has increased the amount of money in the Tramsury, and requested that h® be given permission to use a portion of the money to construct comfort stations at the south and north circles on State Street. Councilman Grayson addressed the Council further on the matter stating that the money was accumulated from the repairing of excavations by the Street Department after the construction of the pipe line along Atlantic Boulevard by Southern Fuel Company, which repair would have otherwise been done by said Company, and the City thereby deriving no profit therefrom. Thereupon it was moved by Councilman Snider and seconded by Councils Grayson that Councilman Davies be authorized to go ahead and procure bids for the constru- ction of said comfort stations at the south and north circle on State Street, but contract not to exceed 300.00 and be by day labor. An easements was presented between Pacific Electric RailrFay Company and the City of Lynwood conveying to the City oP Lynwood too certain strips of land for storm drain purposes across. the right of way of said Company; also RESOLUTION N0. 780, entitled: "'RESOLUTION OF THE CITY OF LYNWOOD AC- CEPTING AN E,AtiSEbIENT", was read. It wss moved by Councilman Davies and sec- onded by CouncilmanWilliams that sad.d Resolution No. 780 be adopted. Roll Call: Ayes: Councilmen Williams, Davies,Snyder, Grayson and Decker. Noes: None. It was moved by Councilman Snyder and seconded by Councilman Davies that the Mayor of the City of Lynwood be authorized to execute said ~~ase- went for and in behalf of said City and to submit a copy of same to the the Pacific Electric Railway Company upon execution. Bateman in the amount of X1,200.00 for preparing plans and specifications for the improvement of Bullis Road, plans and specification$ for the improvement of State Street and Santa Fe. Avenue and one sheet map of the City of Lynwood. It was moved by Councilman Williams and seconded by Councilman Davies that payment of the demand be deferred for investigation and that a committee be appoin- ted to go into the matter; also that an itemized statement be requested from Engineer Bateman. Roll Call' Ayes: Councilmen Williams, Davies, Grayson, Snyder and Decker. Noes: None. The Mayor appointed Councilmen Davies and Williams to act on said @ommittee. The Clerk presented reports of condition of budget up to May 1st, 2 eJ 1931 which was accepted and letter attached ordered filed. City Treasurer Reed addressed the Council to the effect that Acqui- sition and Improvement District No. 4, being the opening and paving of Peach Street, has never finally been cleaned up, stating that it would r®quire $fi53.14 advance from the General Fund to clear up the ~ud~ment, urging that the Covncil take $~vorable action to clear. the matter,authorizing the City Treasurer to pay said alnovnt to the County Clerk of Los Angeles County. Councilman Grayson addressed the Council suggesting the appointment of a com- i rattee consisting of Mayor Decker as one member to investigate this matter. Thereupon the Mayor appointed Councilman Grayson and Councilman Davies to act with Yim on said co~aaittee. _ A report of audit of City .Books from July 1st, T930 to March 31st, 1932 by R. D. City Treasurer Read. addressed the Council requesting the Council to authorize him to cancel a cheek payable ,to the Pacific Electric Railrway Co. in the amount of 900.00 put up in the matter of constructing storm drains under the Pacific Rleetric Railroad tracks, as the final bill was for X581.44 and a new warr~rnt can then be drawn for_the correct amount. Thereupon it was moved by Gouncilman Davies and seconded_by Councilman Grayson that the City t#rwa.surer b® authorized to cancel the 900,00 check. Noes: None. _ A ao~muxiication was received from Citp Attorney Hess to the affect that he has received a letter from the Southern California Edison Co. assur- ing him that dot later than January 15th, 8932, it will apply to the Com- mission for a reduction in rates, stating that this is perhaps as soon as he chould secure a reduction by a hearing before-the commission, recommending that®f~r.e~, that he be authorized to dismiss the ~p~leation on behalf of the City C ty before the Railroad Co~nnission of the Late of California seeking a reduction in rates, inasmuch as he has practically accomplished the ,purpose sougY}t. Thereupon it was moved by Councilman Davies and seconded by ~'ouncil- man Snyder that the City Attorney be authorized to dismiss the application on behalf of the City in said matter. Noes: None. ,. ~-yor Decker stated that the two witnesses to witness the destruction of intoxicating beverages to be appointed by the Council, have never been appointed. Thereupon it was moved by Councilman Davies and seconded by ~ounciltsan °~iilliams that we request two members of the W. C.T. The Mayor instructed the Clerk to notify the organ ization of the Councils desire. It was moved by Councilman Davies and seconded by Councilman Snyder that the City Attorney be instructed to amend the vacation ordinance to have same cover monthly employees only and not men hired by day or hour with re- spect to vacations. The Mayor instructed the CityClerk to communicate with the PaciB.d Electric Railroad Company thanking them fvr their prompt attention in rede- corating their station at Fernwood Avenue and State Street; also Linn Lumber Company and Hudson Lumber extending our anpreici$tion to them for donating lumber to construct tables for parks. At this time Councilman Grayson requested permission to leave the Council session, which was granted by the Mayor. Whereupon Councilman Grag- son vacated his seat at the table.
