M. Mayor Decker inthe chair. Councilmen Williams, Davies, Grayson, Snyder and D®eker an- swered the roll call. The minutes of the previous regular meeting of May 26th, were read and approved. WRITTEN COMMUNICATIONS: aommun ca on was received from the Junior Chamber of Com- meTce signed by Herlon Cgsner, President offering their services to'the City in distributing a proposed ordinance regulating dogs to dog owners when adopted. The Mayor ins:;ructed the City Clem to write the Secretary of the Chamber of Commerce thanking them for their spirit of cooperation. A report showing the activities of Publicity Promoter Walter '~ E. Mellinger, for the month of May, was received. There being no objection, Mhe Mayor ordered same filed. Two firms made applications to submit bids for auditing City Books for next fiscal year, were received, one from W. W. Rarit~r & Company and one from George W. Wood' of Pasadena. There being no ob~eetion, the Mayor ordered same filed. ., A co~rununicati.on was received from City Treasurer Reed in- formingthe Council of the signing of Assembly ~3i~ls No. 438 and 218 relative to refinancing Mattoon Act obligations and limiting the ei~aunt of assessment against each property to 50~ of value, respectively. It was moved by Councilman'Williams and seconded by Councilman Davies that the Council extend City Treasurer Reed and Councilman Grayson a vote of thanks for their splendid cooper- a:tion''a.nd work in endorsing said bills and their trip to Sacramento, relQtive to same at their ownexpense. Roll Call: Ayes: Councilmen Williams, Davies, Grayson, Snyder and Decker. Noes: Non®. ` A communication was received signed by Rev. H. Robb French and Kasper Daetweiler asking permission to erect a gospel tent for three weeks revival ser vices under the auspicies of the Wesleyan Methodist Church. It was moved by Councilman Davies and ,seconded '`by Councilman Williams that permission be granted. Roll 017.1: Ayes: Councilmen Williams, Davies, Grayson, Snyder and Decker, _ - Noes: None. A communication was received om M.W. Karpe, requesting that Platt Avenue be repaired as same i`a very rough condition. Councilman Davies addressed the Council stating that the Street Department are going to have a 20 ton roller down in the near future tb repair-said street. There being no objection, the Mayor referred this natter to Councilman Davies for investigation. An application asking permission to erect a stand on South West corner of Long Beach Boulevard and Tweedy Boulevard was received •`~from Gus Kailas. It was. moved by Councilman Davies and seconded by Councilman Grayson that permission be granted. Roll Call: Ayes: Councilmen Williama,Davies;Grayson, Snyder and Decker. Noes: None. Councilman Grayson addressed the Council to the effect that when permission is granted by the Council to sell fire works, the Clerk should inf "the applicants that the City Council requests them to prevent' ccidents as much as possible and if there are more accidents than should be, a more drastic ordinance governing the sale of fare works will be adopted. Councilman Snyder addressed the Council stating that any matter affecting the fire department .would be Y~andled by the Chief of the Fire Department and he was certain that the utmost care will b® afforded., ' An application asking permission to erect a stand within the City limits of Lynwood on Long Beach Boulevard for the purpose of selling fire works, was received. It was moved by Councilman Davies and seconded by Councilman Williams that same be laid over for further consideration. _ _ Roll Call: Ayes: Councilmen Williams, Davies, Grayson, Snyder and Decker. Rayne, once Corporation vs. City of Lynwood reporting that thecCourtFof- Appeal of the State of California on June lst last affirmed the judgement of the Superior Court in said matter, the case being commonly known as the Schwa,bland 'case, stating that petition for a rehearing must be filed on or before June 20th next. Considerable discussion was had relative to the X8,000.00 that was withheld from Engineer Miller in the matter of the sewer installation in the City of Lynwood to apply on the money to be paid Schwabland, former eng- ineer, if any, which has never been set aside , but is carried in the Goner al Fund. It was moved by Councilman Davies and seconded by Councilman Snyder that the City Treasurer be authorized to deposit X8,000.00, plus the interest that might be due, in a term account for 90 days, and in case the money is not needed at the end of $aid time to continue the account to such a time as the money will be needed Ro11 Ca11: Ayes: Councilman Williams, Davies, Grayson, SnBderand 'Decker. . ' Considerable discussion was had relative to a reheeri;ng in said matter, and it was moved by Councilman Davies and seconded by Councilman Williams that the Caw'icil meet with Attorney $ay~e on Thursday night at 7:30 P. M; in an endeavor to obtain more kn©wledge regarding said case.. - Roll Call: Ayes: Councilmen Williams, Davies, Grayson, Snyder and D~eker. Noes: None. The Clerk was instructed by the Mayor to make the appoint- ment with Mr. Rayne. It was moved by Councilman Snyder that the matter be turned over to Attorney Hess to advise the Council the proper move to make, which motion was with drawn by Councilman Snyder- after some discussion as City Attorney Hess addressed the Council stating that it might be advisable to retain Attorney Rayne inasmuch as the agreement with Attorney Rayne, as the minutes at a previous hearing with Attorney Rayne, read that he would"receive X1,500.00 for his services in the event he wins the case, therefore if it was taken out oP his hands now he may come back for the full amount of X1,500.00, but Attorney Hess stated that he would be willing to file a brief as *'riend of the Court, the City to pay the expense of print- ing said brief and no compensation in the event a rehearing is not granted and a reasonable compensation to be fixed by the Council in the event he is sucessful, separate from the petition filed by Attorney Hatiyn®. T#~.ereupon it was moved by Councilman Snyder and seconded by Councilman ~Jilliands that the City Attorney be authorized to file a brief as friend of the Court and that the City pay the expense of printing the brief, the City Attorney to receive no compensation therefor, exeez~t in the event a rehearing is granted, in which case a reasonable compensation is to be paid fixed by the Council, and for a hearing before the Supreme Court in the event that the petition for a rehearing before the Appelate Court is denied, and if possible, work out a compromise settlement with the Pacific Finance Corporation. City TreasuY+er Reed addressed the Co3~nci1 cautioning the Council to interview with Engineer Robert Miller before they enter into a compromise settlement. A communication was received from W. A. Hood proposing to drill a 16 inch or 20 inch water well to any depth that is desired for the price of X2.00 per foot. There being no objection, the hTayor ordered said communication filed for consideration at any time when the City is ready to drill a new well. A communication was received from Rose C. Kelly complain- ing regarding certain acts by the Water Department. There being no ob~estion, this matter was referred to Councilman Williams and Davies for investigation and report back to the Council. A Communication was received fpom Mr. F. B. Roberts. of- fering for sale a lot at the corner of Lewis Road and Pendleton Av- enue at550.00. Councilman Davies addressed the Council stating that he did not think it would be advisab~.e for the City to purchase the Lit as the well that exists is of no valu®, therefore a new well would have to be drilled and it wo~_ld cost approximately X2,000.00 to pipe the watE:r to the locality where the water is needed. 23d There being no objection, the Mayor ordered said communication filed. A communication was received from Lynwood Motor Sales proposing to sell an automobile for Police department. There being no objections the Mayor ordered said communication filed. Report of activities of Health Department of Los Angeles County was received, which was referred .to Councilman Grayson and he reported that the report for week ending May ~ rd showed 1 case of measles and 2 cases of chickenpox and the report for week endue ing May 30th showed 5 cases of chickenpox in Lynwood. Thereupon the Mayor ordered said reports filed. R®port of activities. of police department signed by Chief of Police"Bennett for the month of Ma3t~ was received. It was mdv®d by Councilman Williams and seconded by Councilman Grayson that Com- ._ missioner Snyder be requested to compile a report showing the number of arrests by each officer of the Department to determine what is taking place., After considerable discussion, the motion was with drawn by Councilman W111iams at the consent of Councilman Grayson and it was decided to look up on the records for said information. ORAL ~ OMP,2UNI CATI ON : - . edf~eld, epresenting Redfield.-Van Ever Bonding Com- .pany addressed the Council relative to some delinquent coupon and interest payments in certain Matoon Act districts. Mss or Decker requested Mr. Redfield to submit his proposition in writ- ing. Mr. A.B. Gray addressed the Council stating that he-has received notice of delinquent taxes on the portion of his Lit condemned for Street purposed. The Mayor requested Mr. Gray to submit the, information in writing. REPORT OF SPECIAL COMIvTITTEES: ounc man av es reporte or the committee composed of Mayor Deckers Councilman Grayson and himself, to confer with City assurer Reed, relative to payment of judgement in the amount of X653.14 requested by the City Treasurer at the last meeting, mak- ing a motion that the City Treasurer be authorized to pay the. X653.14 to L. E. Campton, County Clerk of Lis Angeles, County, in the matter of Acquisition and Improvement District No. 4, being for the opening and paving of -Peach Street, to clear the judgement, and that a warrant ire drawn to cover sam®, which was ss~conded' by Coun- cilman G~syson. Councilman Williams, reported for_the committee composed of Councilman Davies and himself, on the lowest responsible bid- _der for insurance covering metal lighting standards on Long Beech Boulevard between Century Boulevard and Tweedy Road, staffing that ,W. W~ Wilson, agent representing.. the Imdemnity Insurance Company of ~Jorth Ame rice, is the lowest responsible bidder, making a mo- tion~that the insurance be written by Mr. Wilson at X75.00 for a 3 year period as per bid, which was duly seconded by Councilman Davies. _ Roll Call: - Ayes Councilmen Williams, Davies, Grayson, Snyder and Decker. Councilman Grayson reported on the effectiveness of innoeu- lation of dogs against rabies, stating that from information re- ceived, serum for innoculation is very effective, stating that City Attorney Hess has drafted an ordinance regulating same. Thereupon City Attorney Hess read an Ordinance entitled: " AN ORDINANCE OF THE CITY OF LYN'~VOOD REGULATING THE KEEPING OF DOGS. AND DECLARING AN EMERGENCY". It wss moved by Councilman Davies and seconded by Councilman C~i^ayson thst same be~acce~~edas read the first time and passed to the second reading and that a clause he inserted. to provide that dogs may be securely tied up also. UNFINISHED BUSINESS: propose or nance prohibiting nuisances in the City of Lynwood, was presented. It was moved by Councilman Dairies and seconded by Councilman Snyder that the proposed nuisance ordinance e~ read tlae first time some time ago be abandoned and that a new nuisance ordinance be drafted. An ordinance of the City of L~,nwood Licensing and Reg- ulating the distribution of advertisements in said City, was rdad far the first time. Consider•~able discussion was had relative to a paragraph requiring all distribution to be affixed or attached~to some portion of the building. Therupon it was moved~by Councilman Davies and seconded by Councilman Grayson that said paragraph be eliminated and the ordinance with the exception of same be accepted as read the first time and passed to the second reading. Dobson and 10 other property owners representing 1028 feet of frontage petitioning the Council to institute .condemnation proceedings or take such QQthen steps as may be necessary to open Minnesota Avenue through to L1~ng Beach Boulev~ d. Considerable discussion was had resat ding said matter, and it was moved by Councilman Snyder and seconded by Councilman Williams that the matter be referred to Councilman Davies for investigation and consideration. An application was received from Mr. E. J. Conner making application to erect a steel structure 30x80-to be used for light boiler repair shop, supported by a petition attached signed by J. A. Squins and 13 other property owners consenting to the erection of said building on Lots 14 and 16, Block 14 Belle Vernon Ages, It was moved by Councilman Grayson and seconded by Councilman Snyder that p®rmission be granted, and at the time of issuing the permit he be informed that in case a zoning ordinance goes through that it may compel him to move the shop. Noes: None; An ordinance regulating the use of devices and apparatus which interferes with Radio broadcasting receipts, was presented. A communication was received from City Attorney Hess with a certified copy of order of Railroad Commission of the State of 23~~ California authorizing the relocation of crossing at Bullis Road over the right of way of-the Pacific Electric Railway Company. There being no objections, the M~.yor ordered acid cozmnunication filed. Resignation of Judge C, E. Day as Jude of the Police Court of the City of L~wood, was received. Nges: None. Councilman Snyder addressed the Council to the effect ;ghat the Fire Department is in need of certain fire apparatus for use in the fighting of fires, amount to not more than X200.00. There upon it was moved by Councilman Grayson and seconded by Councilman ~~Williama that Councilman Snyder be authorized to purchase said equiptment. An ordinance of the City of Lynwood, amending ordinance No..137 fixingg salaries of Officers and emplo ees, fixing the sal- ary ~o~ -City J4idge at X150.00, Clerk of Court 70.00, Firemen for fi.7~st yew ~I25.00, second year X135.00, and after second year X150,00 per month, was read for the first time. It was moved by Couneilm~a Grayson and seconded by Councilman Davies that same be accepted ms read the first time and passed to the second reading. Roll. Thereupon it was moved by Councilman Grayson and seconded by Councilman Davies that the appointment of Robert Dunlap as requested by Councilman Snyder be ratified by the Council as Fire Chief of the City of Lynwood. Mr. Dunlap addressed the Council stating that. he will have a report to present to the Council regarding the Fire Department in the near future, stating further that he is going to endeavor to build the Fire Department up to such a standard that the Insurance rate for the City of Linwood will be reduced 20 or 25~. _ „' Councilman Snyder addressed the,Couneil recom~}ending Mr. Hghard Hemenway practising attorney in the City of Los Angeles for t~ib"past five years to fill the vacancy of Police Judge created by`the resignation of Judge Day. Thereupon it was moved by Council- man Williams and 'seconded by Councilman Dav ies -that the reco~cmiend- ations of Councilman Snyder be accepted and Mr. Hemenway be appoint- ed` City Judge of the City of Lynwood. ~ _ . The Mayor appointed Police Commissioner and the Clerk to com- municate with the new City Judge Hemenway and request him to meet with the City Council for the purpose of discussing the Courtin keeping with the desires. of the Council. Councilman Snyder addressed the Council requesting them to approve the appointment of former Fire Chief Roberts as once of the Captains of the Fire Department.. Thereupon it~was moved by Councilman Grayson and seconded by Co~- cilman Williams that Mr. C.W. Roberts be demoted from that of Fire Chief to Captain of the Fire Department. . City Attorney Hera presented and read an amendment for the SaYary ordinance to provide that the emp],oyeea whose compenaaation is fixed otherwise than by the month or to those whose compensation isrfixed by the month plus overtime shall riot be entitled to vaca- tion with .pay. Thereupon' it was moved _by Councilman _Gray_son and ~~Q seconded by Councilman Davies that said amendment be inserted into the amendment to salary Ordinance read for the first time. Roll Call: - Ayes: Councilmen Williams, Davies, Grayson, Snyder and Decker. "Noes: None. It was moved by Councilman Davies and seconded by Council- man Snyder that Messrs. Robt. Rodwell and H. S. Rutter be granted one week vacation with pay, and if they be given any further overtime they be eliminated from vacation with pay in the future. Councilman Davies requested there,~eal of the Resolution permitting pay for overtime, but inasmuch as the Resolution No• was not available, it was deetded to lsy same over-to nett meet- ing. Councilman Grayson addressed the Council recommending that a committe be appointed to have the power to go into every Depart- ment of the City in an endeavor to have uniform rules governing vacations, salarires, overtime, etc., drafted, making a motion that such a committee be appointed, which was duly seconded by Coun- cilman Williams.
