HomeMy Public PortalAboutM 1931-06-11 - CCSPECIAL MEETING JUNE 11TH, 1931. ~ ~~~ .~ The City Couneil of the City of Lynwood met in a special meeting at the City Ha11, 11331 Plaza Street, pursuant to call by Mayor Decker on above dates at 12':30 P. M., which call read as follows: "'You are hereby notified that a special meeting of the Council will be held in the Council Chamber of the City Hall on June 11th, 1931, at 12:30 P. M., for the purpose of discussing the case of Pacific Finance Corporation vs City of Lynwood, commonly knovm as the Schwabland Case with special attor-~ ney in said matter, Brewton A. Iiayne. Yours truly, Louis H._Decker, Mayor of the City of Lynwood', a copy of which call had been served on each member of the Council at least 3 hours before said meeting as required by law. Councilmen Williams, Davies, Grayson, Snyder and Decker.answered the roll call. Discussion of said case Pacific Finance Corporation vs. City of Lyn- wood, ensued. Attorney Rayne proceeded to produce errors in his opinion handed down b9 the Judge presiding temporarily on the bench of the ,Appelate Court in its decision against the City of Lynwood, affirming the judgment of the Superior Court in said matter. Attorney Rayne stated to the Council that there would be no additional cost to the C.~ty for Attorney fees if a re- hearing is had before the Appelate Court. Mrs. Robt. Miller, representing Engineer Miller, addressed the Council regarding said matter. Councilman Grad son addressed the Council stating that he had conferred with Engineer Miller regarding the matter, and that he would confer further with Mm, if so de- sired, to find out his wishes in the matter, which he was instructed to do by Maxtor Decker . It eras moved by Counci]anan Davies and seconded by Councilman William that the City pay Attorney B.A.Ha~Tne, X1,500.00 in case he wins said case, ~1~000.00 in the event a compromise is entered into, and 500.00 in the event he loses through to the Court of Final Judgment. Councilman Davies addressed the Council questioning Attorney Rayne what his Qompensation would be in the event his services in said matter were severed tt this time. Attorney Rayne addressed the Council stating that he would accept the sum of 500.00 in full payment for services rendered here- tofore to said matter , Pacific Finance Corporation vs. City of Lynwood., in the event his services terminated at this time. St eras moved by CouncilmanDavies and seconded by Councilman Snyder that`Attorney Rayne and A~torney Hess be instructed to file a petition for rehearing in the AppelateLCourt and in the event that same is denied peti- tion f'or a htraring before the Supreme Court.
