The City Council of the City of Lynwood met in an adjourned r®- gulnr session at the City Hall, 11351 Plaza Street, on above date at 7:30 P.1~I. Mayor Decker in the chair. Councilmen Williams, Davies, Grayson, Snyder and Decker answered the roll call. 'the minutes of the previous regular meetinsr of June 9th and of the two Special meetings on June 11th, one at 12«30 P. M. and one at 7:30 P. M., were read a.nd approved. RRIT'?'EN COMMUNICATIONS n nv tat on was rece ved from Los Angeles County Health.Depart- went of Inglewood, inviting the Council to attend the formal opening of In- lewood Township Civic Center Building on Thursday, June 25th - 3 to 8 P.M. here being no ob3ection, the Mayor ordered the communication and invitation filed and suggested if any one has the time to attend it would be in order to do so. An application was received from C. Kraintz to erect a stand on Lot 840, Tr~et 3172 for purpose of selling fireworks. It was moved by Counci.].aisn Davies and seconded by Councilman Snyder that Mr. Kraintz be granted a permit. Roll Call ,' 1~yas: Councilmen Williamd, Davies, Grayson, Snyder and Decker. Noes: None. An apx~lication- w'as received from Edwin E. Offede to erect. a stand on Lot 988, Tract 3172, corner of L. B. Blvd. and Orchard Avenue for purpose of selling fireworks. Thereupon it was moved by Councilman Davies and sec- onded bq Councilman Snyder thatMr. Offede be granted a permit. Hayne to the effect that'he would accept the sum of 500.00 in full compensation for his services to date in the case entitled Pacific Finance Corporation vs. City of Lynwood; also submitting an expense bill in the amo~]nt of 7.00 for steno- graphic services in writing brief and one for X2.25 for copy of opinion of the Court of Appeal. Thereupon it was moved by Councilman ~'lilliams and sec- onded by C~oazncilman Grayson that the bills be allowed. Councilman Grayson addressed 'the Council congratulating City Attorney Hess on the brief he has written petitioning for reheraring before-the Appelate Court, stating that while thpre`is very little to be expected, there is a lot of consolation to know that every effort will be made to get a rehearing or prevent the judg- ment going to payment. A ec3m:nunication was races ved from Attorney Stan~.ey Moffatt submitt- ing claim-in the sum of X50.00 for serving as City Judge in the City Court for one week dtiring the absence of Judge Charles E. Day. Councilmen Williams and Snyder addressed the Council to the effect that they are opposed to paying the demand inasmuch as 1t was agreed that Ns. Moffatt would nerve without any charge to the City. Thereupon it was moved by Councilman Vdilliams a1d secon- dad by Councilman Davies that the claim be disallowed.- Roll Call Ayes: Counc ilmen Williams, Davies, Grayson, Snyder and Decker. Noes: None. A co~aunication was received from C.H. Davis Hardware quoting price on traffic paint and making application to furnish same. There being no ob- jecti©n, the Mayor rederred the matter to Councilman Davies. Councilman Gray- son ac'Ec~ressed the Council favoring patronizing Lynwood Merchants, if prices are right. Councilman Davies addressed-the Council to the effect that they have plenty of paint on hand at the present time and therefore are not in the. market for same. A communication was received from Mr. A. B. Gray enclosing delin- quent tax notice on portion of his lot condemned for street purposes. City Treasurer Reed addressed the Council suggesting to Mr. Gray and to any other that have received such notices, to ignore the notice as same will be cleared up in the near future. Thereupon the Mayor ordered the communication filed. - A communication was received from Clara Raffensperger complaining because "she ~rasnot notified of lighting assessments due before same were de- lingv.ent lien penalties were added. The City Clerk and City Treasurer Reed addressed the Council to the effect that every effort was made. to notify her of the assessment, but County records 3ust disclosed her name without her address, and she did not notify the Treasurer's office of the address. until after the assessment was already delinquent. Thereupon it was moved by Councilman Davies and seconded by Councilman Williams that the Clerk be in- structed to communicate with Miss Raffensperger that the Council cannot do anything in the matter in the way of relief inasuuch as the City did not ~`~h have the proper address . A communication was received from Redfield, Van Evers &: Co., Ltd. requesting advance from General Fund to take care of delinquent Mattoon Dis- tricts No. 9 and 10, being sewer districts; also suggesting that an amount clear?~y sufficient be levied to pay all principal and interest i++dZich has be- come, or which will become payable before the proceeds of another tax levy can be made availabl®, in the future. It was moved by Councilman Williams and seconded by Councilman Davies that the matter be referred to a committee for consideration. The Mayor appointed the City Treasurer and himself to serv~a on said committeer; also suggesting that if the remainder of the Council wish to act they may do so. Report of condition of Water pumps of the City of Lya~wood, was received. There being no objection,the Mayor ordered same filed. A communication was received from the W. C. T. U. signed by Anna S. Humphrey, President and Ntrs. Lucy M.Getchell, Secretary thanking the Coun- ~ ci~.for the kind cooperation to the extent of voting to have two members of the W. C.T.U. to witness the destruction of liquors. Also a bouquet was presented to the Council and Mrs. Humphrey addressed the Council to the ef- fect that they fully appreciate the service of the Council and that she has been serving on the jury for the past few days a1d noticed that it was cus- tomary for the Judges to have bouquets given them and that they felt that the Council should be esteemed also, offering any further service they may render. Mayor Decker addres:~:ed the Council thanking the W. C.T., U. for the token o#' appreciation and assuring them that they Council have asked them to do only the thing they are capable of doing; also stated to the public present that the Council appreciates the cooperation of every citizen and that they are tryin7 to do what they think best and give every proposition presented full consideration at all times.. The following applications for employments were received: William J. Griffin,James M. Anderson, Louis Y. Sichler, all apply- ing for position on thePolice Department, and Frank F. Menzel applying for position as Building Inspector. 'Z'he report of the Health Department was received and Councilman. Grayson reported 1 case of Measels and 3 of Whooping Cough for. week ending June 6th and one of Measles snd one of Erysipelas for week ending June 13th, recorded. There being no objection, the Mayor ordered said applications an d report filed. A communication was received from Veterans' Welfare Board of the State of California with petition attached, petitioning the Council to can- cel all taxes as against Lot 5, Block !, Tract fi474. It was moved by Council- man Davies and seconded by CouncilmanWillians that the City Attorney be instructed to file a written opinion regarding said matter. There being no objection, the Mayor referred this mat~e~~ to Councilman Snyder for consideration. Councilman Grayson addressed the Council reporting for the comYnit- tee consisting of the Mayor a~ d himself to draft uniform rules regulating vacations, salaries, overtime, etc., to the effect that they. have received some helpful suggestions from Departments of the City and would be glad to receive more, stating that same will possibly be ready for consideration of the Council at their newt session. Councilman Davies addressed the Council reporting on the bond cpv- ering the Treasurer and Assistant, recommending that the desiand of H. E. Zeiler in the amount of X87.50 be paid and the bond continued, making a.mo- tion to that effect, w},ich was duly seconded by Councilman Grayson, and was withdrawn by the Councilman Davies at the consent of Councilman. Grayson, and 4 `i, it was thereupon moved by Councilman Davis and seconded by Councilman Grayson that the action taken by the Council at the meeting held on June 9th, 1.931 "that the claim .of H. E. Zeiser for renewing official bond of CityTreasurer and Assistant Sylvia Mitts in the principal a. ount of 87.50 be disa~.lowed", be rescinded. The Mayor instructed the Clerk to communicate with all agent and compani®s writing insurance and bonds that they submit the date of expira- tion of each policy and not renew same without authority from the Council. Councilman Snyder reported that Chief Dunlap is drafting an ordin- ance regulating incinerators which will possibly be ready for next meeting. City Attorney ness stated that he had written the Band ofAmeriea re- garding escrow instructions for the purchase of Lot in Century Square Tract, but up to date has not received a reply. UNFINISHED BUSINESS: N0. 6 , entitled: "AN ORDINANCE OF THE CITY OF LYIVWOOD RE- GULATING THE KEEPING OF DOGS AND DECLARING AN EMERGENCY", was read for the second time. It wa.s moved by Councilman Davies and seconded by Councilman Gragson that same be adopted as read the second time, finally passed and published as required by law. It was moved by Councilman Davies and seconded by Councilman Grayson that the City Clerk be instructed to order 1000 copies of said Ordinance printed for distribution. ORDINANCE N0. 167, entitled:nAN ORDINANCE OF THE CITY OF LYNV~(OOD, LICENSING AND REGULTING THE DISTRIBUTION OF ADVERTISING TN SAID CITY", was read for the second time. It was. moved by Councilman Grayson and seconded by Councilman Davies that same be adopted as read the second time, finally passed and published as required by lave. ORDINANCE N0. 1fi8, entitled: "AN ORDINANCE OF THE GITY OF LYNV~l00D AMENDING ORDINANCE N0. 137, FIXING SALARIES OF OFFICERS AND EMPLOYEES", by fixing salaries of City Judge, Clerk of 'Court and firemen, was read for the second time. It was moved by Councilman Davies and seconded by Councilman Grayson that same be adopted as read the second time, finally passed and published a s required bylaw. An Ordinance of the City of Lynwood regulating the use of Devices and Apparatus which intereferes with Radio Broadcasting Reception, in the City of Lynv~oc~d, repealing all ordinances and parts of ordinances in con- flict herewith and providing penalties for the violation hereof, was read for the first time. It was moved by Councilman Davies and seconded by C oilman Williams that same be accepted as r®rad the. first time and pas- sed to the second reading. Report of Building activities of the City of Lynwood was received -from Building Inspector Collins from June 1st to June 23f~d,inclusive. RESOLUTION N0. 781, entitled: "A RESOLUTION OF THE CITY COUI~ICIL OP THE CITY OF LYN1"FOOD REPEALING RESOLUTION N0. 752 FIXING DOMPENSATION FOR EMPLOYEES BY PROVIDING FOR 622 per HOUR FOR SERVICES RENDERED IN EXCESS OF EIGHT HOURS PER DAY FOR PIPE LAVE FOREMAN AND SERVICEP~IAN IN WATER DE- PAR`1'PTENT, was read. It was moved by Councilman Davies and seconded by Coun- cilman Williams that said Resolution No. 781 be adopted. Roll Call Ayes: Councilmen Williams, Davies, Grayson, Snyder and D®~eker. Noes: None. - Grant of Easement signed by Henry Doebler for strip of land, be- ng the b'Vesterly three feet of Lot A of Doebler Tract, to be used for con- struction of ditch for flow of storm and flood waters, was received. It was moved by Councilman Crrayson and seconded by Councilman Williams that same be accepted and that the Clerk be instructed to w~'ite Mr. Doebler a letter thanking him ,for his cooperation in this matter. Noes: None. ~ , The Gity Clerk was instructed to advertise for bids for pump of 1500 gallon capacity per minute with motor of 125 hoarse power, capable of operating said pump against a total head of 2~5 feet, by a motion of Councilman Davies which was duly seconded by Councilman Williams, fixing July 14th as the day for receiving bids. It was moved 'by Councilman Davies and seconded by Councilman Gray- son that the City purchase Sparli.ng Meters for measuring the sufficiency of the different water plants in the City as requested by Councilman Williams. Noes: None. - It was moved by Councilman Davies azd seconded by Councilman Snyder that the Engineer be directed to prepare a report and amended assessment for each parcel included in the list on file in the office of the City Treasurer as provided in Section 14-B of the Improvement Bond Act of 1915, and file same in the office of the City Clerk. Sullivan has been appointed to work in the Fire Department, Mr. Evan Lewis having been promoted to captain to fill vacancy of C. `JV. Robert,s, Mr.Sullivan to receive X125.00, requesting the Council to confirm the appointment. There- upon it was moved by Councilman Grayson and seconded by Councilman Davies that the appointment of C.J. Sullivan be ratified. An Ordinance of the City of Lynwood prescribing certain duties of the Building Inspector of said City, to see that all contractors are licensed by the State of California, was read for the firs time. AN ORDINANCE OF THE CITY OF LYN~NOOD AMENDING ORDINANCE No. 121 regulating thesal a of Fireworks by repealing certain sections thereof, was read for the first time. It was moved by Councilman Snyder and secon- ded by Councilman Davies that same be accepted as read the first time and passed to the second reading. An Ordinance of the City of Lynwood amending Ordinance No. 117 relating to 'J~`ater Rates, ny requiring the charge g~sr water served to any new consumer and certain business. establishments, to be upon the metered basis. It was thereupon moved by Councilman Snyder and seconded by Councilman Grayson that same be accepted a s read the first time and passed to the second read- ing. Considerable discussion was had as to whether or not old water consum- ers would be charged on the metered basis too, but it was determined that old consumers would be charged in the same way as heretofore, except if they move into a new house where new service is necessary in wlich case they would be subject to meter charge. ~~~ ,y e Roll Call on Motion: Ayes: Councilmen ti'Villiams, Davies, Grayson, Snyder and Decker.. Noes:None A proposed new section for the nuisance ordinance which would provide that it would be unlawful for any person to sell any fruit, vegetables, or any foodstuff not in sealed containers, unless the same be in a building of Type 1, II, III, IV or V,orunless in vehicles that is not allowed to remain stationary upon any private property, was brought up for discussion. It was moved by Councilman Grayson and seconded by GouncilmanDavies that the ~~ proposed paragraph for ordinance go into a committee for consideration. Thereupon an Ordinance of the City of Lynwood defining nuisan ces and prohibiting their maintenance, and fixing a penalty therefor, was read for the first time. It was moved by Councilman Davies and seconded by Councilman Williams that bonds be takenput to cover Clerk of the City Court and Building In- spector Collins in the amount of X1,000.00 each, and be presented to the City Attorney for inspection when written. It was moved by Councilman Snyder and seconded by Councilman Grayson that the City Attorney be instructed to prepare an Ordinance prescribing the form of bond for all officials and amend the existing ordinance fixing the amount of bondsfor the various officials bonded to conform to amount carried. M., whichcall read as follows:- "You are hereby notified that a special meeting of the Council will be held in the Council Chamber of the City Hall on June 11th, 1931, at ?:30 P. M., for the purpose of discussing the case of Pacific Finance Gorporation vs. City of Lynwood, commonly known as the Schwabland Case, Yours truly, Louis H. Decker, Mayor of the City of Lyn~rrood", a copy of which call had been served on each member of the Council at least three hours before said meeting as ret~a.ired by law. Councilmen `~'lill'iams, Davies, Grayson, Snyder grid Decker answered the roll call. It was moved by Councilman Davies grid seconded by Councilman Snyder that the reading of the minutes of the regular meeting of June 9th and of the special meeting held at 12:30 P. It was moved by Councilman Davies and seconded by Councilman Grayson that the action taken by the Council at the special meeting this afternoon directing Attorney Hayne and Attorney Hess to petiton for a.re- hearing in the Appelate Court, and in the event same is denied to peti- tion for a hearing before the Supreme Court, be rescinded. City Attorney in plane of Brewton A. Hayne as Counsel in the ease Pacific Finance Corporation vs. City of Lynwood, and that the City Attorney be directed to file a petition for rehearing of said eretion before the DistrictCourt of Appeals on such compensation a$ may be hereafter fixed if its Gity Attorney wins, but without. any compenffiation if the City loses, and that the City Clerk be directed to communicate with Mr. hayne that the C ty Council wishes to substitute its City Attorney as re- cord Counsel in ~he said case Pacific Finance Corporation vs. City of Lyn- wood and that the City accepts the offer made by Mr. Hayne at a legally called special meeting held at 12:30 P. b1. on June 11th, 1931, "that he would accept the sum of 500.00 in full payment for services rendered here- tofore in said action", and that warrant for same will: be adopted at the next regular meeting of the City Council.
