The City Council of the City of Lynwood met in a regular sess- ion at the Gity Hall, 11331 Plaza Street, on above date, at 7:30 P.M. Mayor Decker in the chair. Councilmen Williams, Grayson and Decker were present. Councilmen Davies and Snyder were absent. The minutes of the previous regular meeting of Deceq~ber 15th, 1931, were read and approved. TiP~€iTTEN COMMUNICATIONS: A communiea ion was received from Messrs. Lee Anderson and Harry D.Ott requesting that adequate police protection or traffic signs be constructed at Century Boulevard and Long ~eaeh Boulevard to prevent accidents, calling attention to a casualty that was caused by collisiion ~+, at said location on December 19th. No action was taken as the matter is ~Iready being investigated by Police Chief Bailey. - a A communication was received from B.Greenwood, 3236 Century Boulevard, making dem~.nd for X48.?5 alleged damages caused by not being ~_ permitted to establish the business of camp grounds on his lot located on Century Boulevard. Thereupon it was moved by Councilman ~lilliams, and seconded by Councilman Grayson that the communication be ordered filed. Roll Call: Ayes: Councilmen ~;Jilliams, Grayson and ~~eeker. Nones: None. Absent: Councilmen Davies and Snyder. A communication was received from D.r.Dunham, representing the Dunham Advertising Co., making application for a permit for the pur- pose of advertising on the streets of the-residence district for about three hours on Friday and Saturday, January 8th and 9th. No action was taken, but the consensus of opinion seemed to be that they be permitted to advertise provided they do not violate any city ordinance, and the communication was ordered filed. - g communication was received From Herbert H.Hallett, Secretary, representing the State Commission for ~'roteetion of children and animals, requesting the renewal of their contract to collect dog license fees, which expired on December 30th,1931, ~-~ith copy of contract attaeh~,d. Thereupon it was moved by Councilman Williams and seconded by Councilman Grayson that the contract be accepted, and the ~~ayor be authorized to sign dame, for and in behalf of the city of Lynwood. A communication w~~s received from H.M.Murray requesting that the Council reconsider the proposed `.pine Y'onic Ordinance and adopt one similar to the ~ iverside Ox~dinanee, which prohibits any per-son to sell wine tonics, except registered pharmacists duly conducting drug stores, wherein prescriptions are compounded. 't'here being no ob~eetion, the r.2ayor ordered the communication filed. Reports of activities for the month of December were received from the following Departments: Police llepartment, Street Department, `3u ilding Department, Fire Department, 'eater Department, City Court, and ,..~ ~iealth Department. There being no objection, the ~.Zayor ordered .said re- ports filed. ORAL COMMUNICATIONS: ~.~. 0 n n a reseed the Council in behalf of-four other t business men present, regarding the present hand bill ordinance, stating that the present ordinance for distributing advertising matter cY~eates a hardship on loco 1 ~~erchants because of the X10.00 fee, requesting that an Ordinance similar to the Compton or Long Beach Ordinance be adopted •~~~hich exempt: local merchants. At this tine Councilman Davies arrived and took his chair at the Council table. The Mayor stated to ~,'Cr. Johnston that such s,n ordinance hs,s been ruled unconstitutional by the City Attorney, and until such a time as the business men present a legal opinion fro- Long Beach or Compton Attorneys that the Ordinance is legal, the Council do not nsrant to Hass a.N Ordinance that has been ruled illegal. Councilman Grayson also addressed the Council to the effect that the Council are not desirous of putting the City into unnecessary litigation and therefore are not desirous to adopt an ordinance that is illegal; however, if the business men recommend something concrete for the Council to adopt that is legal, such as repealing the Ordinance en- tire ly, they ~.--i11 b e glad to coo prate. 3~3 Thereupon i t was moved by Councilman Williams that the Cound 1 pass the Compton Ordinance verbatim. There being no second, same lost for lack of a second. Councilman Davies addressed the Council requesting information from ?.Zimmerman of the Lyn?~~ood Theatre as to whether he pays a license for distributing advertising matter in C omp ton, whereupon T~Ir. zimr~erman stated that he does not. Thereupon it was moved by Councilman Davies and seconded by Councilman Grayson :that the present hand bill ordinance be repeale$. Where- upon ?JIr.Johnston again addressed the Council to the effect that they are not desirous of dictating to the Council, suggesting that they are no t wanting notion tonight partieularl.y, and therefore, further consider a- tion might be had. Whereupon Councilman Davies ~r,Jithdrew his motion at the consent of Councilman Grayson, who seconded same, and it was there- upon moved by Councilman Grayson and seconded by Councilman Davies th t the matter be referred to the City Attorney to investig~~te the Long Bach Ordinance as to it's legality. REPORTS OF SPECIAL CO?lC4~ITTEES: wri en repor was rece ve from Engineer Bateman on the matter of diverting water down the alley east of Long Beach Boulevard at Sanborn Avenue, to the effect that the expense that would be involved would be approximately X15.00. Thereupon it was moved by Councilman Gray son that the City Engineer be ins trueted to make the improvements to the extent stated, which motion was withdrawn after some discussion, and the matter was referred to Councilman Davies and City Engineer Bateman for further investigation. Councilman Williams reported that Co uncilman Davies, and him- self was successful in their attempt to obtain a release of any claims that Ex-Engineer Miller may have against the City. Thereupon the City Clerk read the Release of Claim executed~y said Robert B.Miller, whereupon it was moved by Councilman Grayson and seconded by Councilman Williams,- that same be accepted and ordered filed. Roll Call: _ Ayes: Councilmen Williams, Davies, Grayson and Decker. Noes: None. Absent: Councilman Snyder. Thereupon, RESOLUTION N0. 794, entitled: " A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYN'JVOOD DIRECTING EXECUTION OF RELEASE OF CLAIMS AGAINST ROBERT B.MILLER", was read. It was moved by Councilman Da.viss, and seconded by Councilman Williams that-said RESOLUTION No. 794 be adopted. Roll Call: Ayes: Councilmen Williams, Davies, Grayson and Decker. Noes: None. Absent: Councilman Snyder. UNFINISHED BUSINESS: A , entitled: "AN ORDINANCE PRt?HIBITING THE SALE OF WINE TONICS TN THE CITY OF LYN'"d00D, REPEALING ALL (1RDINANCFS AND PARTS OF ORDINANCES IN CONFLICT HEREWITH AND PROVIDING PENALTIES FOR THE VIOLA- TION THEREOFff, was read for the second time, Thereupon it was moved by Councilman tilliams and seconded by Councilman Davies that same be adopted 'as read the second time, and finally passed and published as required by ~ ,law. Roll Call: Ayes: Councilmen Williams, Davies, Grayson and Decker. Noes: None. Absent: Councilman Snyder. It was moved by Councilman Williams and seconded by Councilman Davies that R.D.Crenshaw & Co., be employed to continue their audit of the Gity books to the close of the fiscal year 1931-32, at the same rate as heretofore quoted. ~ e Roll Call: Ayes: Councilmen Williams, Davies, Grayson and Decker. Absent: Councilman Snyder. r City Treasurer Reed addressed the Council to the effect that he can return X1,250.00 of the money advanced to the Bond Redemption ~~und from. the General Fund and that he desires that same be re-allocated to Bond, Funds R?. I.D. No.l and Series "DD". Thereupon it was moved by Council- man Grayson that we authorize the City Treasurer to transfer the funds as outlined. After some discussion, Councilman Grayson withdrew his motion. r~ ~_ At this time, 8:45 P.~, Councilman Snyder arriged and took his chair at the Council table. 2'here being no ob~eetion the ~.~ayor referred the matter of transfers back to the City Treasurer and City Attorney to report in writ- ing and make recommendations. RESOLUTION N0. 795, entitled: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNt'YOOD REPEALING RESOLUTIONS No. 765 AND 774 of SAID CITY", naming Councilmen as aommissionere was read. Thereupon it was movr~d by Councilman Grayson and seconded by Councilman Snyder that said RESOLUTION N0. 795 be adopted. Roll Call: Ayes: Councilmen Williams, Davies, Grayson, Snyder and Decker. Noes: None. Absent: None. Thereupon, RESOLUTION No. 796, requiring that all requisi~iorB bear the approval of the City Clerk, that the item purchased is within the budget allowance, was read. Thereupon it was -moved by Councilman Grayson and seeondeu by Councilman Snyder that said RESOLUTION No.796 be adopted. Roll Call: Ayes: Councilmen Williams, Davies, Grayson, Snyder and beaker. Noes: None. Absent.: None. An Ordinance of the City of Lynwood, amending Ordinance No. 16 1 of the City of Lynwood relating to presentation of claims, was read for the first time. Thereup,~n it was moved by Councilman Grayson and see - onded by Councilman Snyder that same be accepted as read the first time, and passed to the second reading. A communication was received from Chief of Police Bailey, re- questing confirmation of his action in employing Mr.J.C.Cooper temporarily as Police Officer, between December 16th and December 31st,1931, at X125.00 per month. Thereupon it was moved by Co uncilman Davies, and seconded by Councilman Snyder that said act be ratified. Roll Call: Ayes: Councilmen xlilliams, Davies, Grayson, Snyder and Decker. N©es: None. Absent: None. It was moved by Councilman Grayson and seconded by Councilman . Davies that the Street Superintendent be instructed to grade and roll the lots at Long ~eaeh Boulevard and Mulford Avenue to b® used as a free park- ing :station, as requested by Ry~r. Reber. Roll Call: Ayes: Councilmen ~~illiams, Davies, Grayson, anyder and Decker. Noes: None. Absent: None. Councilman Snyder addressed the Council to the effect that the fire engine is torn down and the Seagrave Corporation find that it will cost approximately ~15U.00 to repair all defects, requesting the Cou~- cil's wishes in i;he matter. Thereupon it was moved by Councilman Grayson and seconded by Councilman ~~illiams that the sire Engine Truck be repaired to the extent of not to exceed X150.00, and that the Eire (.Thief be inform- ed that his budget allowance is way overdrawn for t'rie first six months, and insist that the strictest economy be maintained for the remainder o~ fhe fiscal year to make up the deficiency that exisits.
