The City Council of the City of Lynwood met in a regular session at the City Hall, 11331 Plaza Street, on above date, at 7:30 P. Ni. Mayor ScY~outen in th.e chair. Councilmen '~'lilliams, Davies, Gillett, Snyder and Schouten vrere present, and anstivered tie roll call. The minutes of the previous regular meeting of December 20th, 1932 were read and approved. l~'URITTETd COP:~P~'NNICATI ONS : commun cation was received from Messrs. Walter E. bTellinger and A. T~f. Berglund, submitting report on progress on the matter of trans- portation for Lynwood, stating that the C3_ty of South Gate may give this City a permit for a local bus system to pass o~aer the route of the pre- sent Century Boulevard, tieing in with. the end of the Yellow Line at the present South. Gate bus depot; also reporting that the City of South Gate are negotiating with the Pacific Electric Railroad Company to lower their rate to 7¢ from Century Boulevard to Huntingtor. nark and the City of South Gate will abandon their buss service. Councilman Davies addressed the Council stating that inasmuch as we have no money to purchase bus- ses at this time, I move that the communication be or'ered filed., which was duly seconded by Councilman '-Tilliams, and upon roll call showed the following result: Ayes: Councilmen ':Nilliams, Davies, Gillett, Snyder and Schouten. Noes: None. A communication was received from the League of CaliforniaNiuni- cipalities reporting on a meeting held in San t+~rancisco where 50 repre- sentatives from various cities were present, favoring exempting states and State Agencies from paying the 3~ Federal Tax on utilities, present- ing resolution for Council to adopt if they see fit,to send to Senators and Representatives. Thereupon it was moved by Councilman Davies and seconded by Councilman Snyder that the Communication and resolution be turned, over to the City Engineer for investigation and report back to the Council his recommendations. Roll Call: Ayes: Councilmen T+Yilliams, Davies, Gillett, Snyder and Schouten. Noes: None. A cammunication was received from the Los Angeles County League of Municipalities inviting the Council to attend their January meeting to be held at Pasadana, Thursday, January 12th, 1933, dinner at 6:30 P. NT. It was moved by Councilman t~lilliams and seconded by Councilman Gillett that the invitation be accepted and that as many as desire to go do so. loll Call: eyes: Councilmen Willi:~ms, Davies, Gillett, Snyder and Schouten. Noes: None. A communication was received from the Fire Chief requesting per- mission to send Captain Daetweiler and Lewis to attend a class of train- ing for Firemen to be held in the Union High School at the City of Hunt- ington Park on Tuesday, Thursdays and Saturdays from 9 A. M. to 12 P. M.; also requesting Hermit for himself to attend when time will permit. There- upon it was moved by Councilman Williaams and seconded by Councilman Davies that the request be granted. Roll Call: Ayes: Councilmen ~lilliams, Davies, Gillett, Snyder and Schouten. Noes: None. A communication was received from Fire Cr.ief Dunlap to the effect that there are a few persons registered on the unemployment files that are not voters in the City of Lynwood, however, they have lived in the City for several years and are property owners of the city and respected citizens of the community, wishing the Council's decision on whether or not they should be entitled to work on relief work stating that several compalints have been entered because they are aliens; also whether we can legally employ aliens and pay them out of City funds. Thereupon it was moved by Councilman aYilliams and seconded by Councilman Gillett that the fire Chief use his own discretion in selecting those who live in the City and own property, and those who do not own property, and are not voters in the City, on the special relief work. A communication was received from Fire Chief Dunlap reporting that the cam shaft and idle gcaars in the Fire Engine motor has been develop- ing a noise that he cannot overcome, advising that the matter should be checked up and have same corrected as soon as possible. Thereupon it was moved by Councilman Gillett and seconded by Councilman Snyder that Fire Chief Dunlap be granted permission too have the matter checked up as requested. Roll Call: Ayes: Councilmen ~"lilliams, Davies, Gillett, Snyder and Schouten. Noes: None. """! ~i t! Reports ,tirere received for the month of 'December, 1932 from the Police Department, license and Building Department, City Court and Health reports for weeks ending '~eeember 17th and 24th and statistical report for month of November, 1932. There being no ob3ection, the Mayor ordered said reports filed. ORAL C ONiMUN I CATI ONS : Mr. M. erglund commented on-his letter relative to buss ser- vice for Lynwood, stating that the letter was in error where it stated that the City of South Gate would grant permission for busses through through Louth Gate, and that it should read that they looked favorably on the matter, stating that t;he City of South Gate wanted a decision on the matter immediately. Mr. Berglund advocated for the City to buy bus- ses to be used for Lynwood and also in South Gate. Councilman Davies stated that the City have no funds with which to purchase busses at this time; Councilman Gillett also corroborated the statement, and mayor Schouten stated that it would not be good busi- ness for Lynwood to purchase_a buss system that is now losing the City of South Gate money, and therefore the City does not look favorably on the proposition. Mr. Berglund thereupon requested permission to solicit funds for the purchase of two busses to be used in Lynwood, and he was informed that it would be necessary for him to apply to the State for permit, and no ac- tion was taken. REPORTS OF SPECIAL COMMITTEES ity Attorney .ergins reported relative to the matter of the re- solution regarding gasoline tax money distribution directly to Cities, sug- gesting that the Clerk read same to ascertain if the Council wish same a- dopted. Thereupon RE°>OLUTION N0. 819, entitled: "RE">OLUTION FAVORING THE T'ISTRIBUTION OP A PORTIO]`d CAF mHE GASOLINE TAX DIRECTLY TO CITIES't, was read. Thereupon it was moved by Councilman l?Uilliams and seconded by Coun- cilman Davies that said Resolution No. 819 be adopted, and that the Clerk be instructed to send certified copies of same as specified therein. Roll Call Ayes: Councilmen ~'illiams, Davies, Gillett, Snyder and Schouten. Noes: None. Mrs. Regina ~'eters addressed the Council rely tive to weed assess- ment rebate stating that she cleaned her Lot herself for year 1929, but was charged by the City through the tax bill. Discussion thereon ensued, and Mayor Schouten informed Mrs. Peters that he would confer with City Treasur- er Reed relative to the matter. An Ordinance of the City of Lynwood prohibiting the sale, gift, storage, manufacture, transportation, unlawful possession, importation or exportation of intoxicating liquors for beverage purposes; regulating all other traffic in such liquors; and providing penalties for violation here- of, was read for the first time. Councilman 'Davies wished further infor- mation on same. It was moved by Councilman Snyder and seconded by Council- man Williams that said ordinance be accepted as read the first time and pass to the second reading. Roll Call Ayes: Councilmen Williams, Gillett, Snyder and Schouten. Noes: Councilman Davies. An ordinance of the Gity of Lynwood licensing and regulating th@ business of advertising, and. distribution thereof, in said,City, was read for the first time. Considerable discussion ensued relative to fees for distributing handbills and regarding possible discriminatory features. Thereupon Mayor Schouten appointed Bouncilmen Snyder, Davies and Williams a committee to investigate the contents of the ordinance and report back to the Council their findings and recommendations. NE1Y BUS'7CNE55: Acommunicat on was received from the City Clerk stating that he,had re-checked the recall petitions against Councilmen Henry J. Schouten ''-" and font a~illiams for any possible errors and omissions, but that none _' were found and therefore that the certificate made December 6th, 1932 an d presented to the Council on December 13th, 1932, certifying that the peti- tions were signed by~ the requisite number of qualified .electors to call a Special Municipal Election, is_correct. Councilman ~'Villiams addressed the Council alleging that there are sever al irregularities about the petitions; that intimidations were used to procure signatures, etc., therefore making a mot~.on that the Coun- cil repeal all action heretofore taken relative to calling a special elec- tion, which was duly seconded by Councilman Gillett, but said motion was later withdrawn by Councilman t"dilliams at the consent of Councilman Gillett upon the ruling of City Attorney Jergins that he is of the opinion that it would be more advisable to postpone the calling of said election, therefore it_was duly moved by Councilman Williams and seconded by Councilman Gillett that the election be postponed until the matter has been investigated by th District Attorney's office. Consider able discussion ensued regarding the ~t matter and Councilman Davies stated that the calling of the election is a min- isterial act which must be done forthw' th ft- th i a ,er e certificate that the pe- titions have been signed by the requisite number of qualified electors is presented to the Council, and that the vote taken by 3 members of the Council, one not voting and 2 voting in favor -thereof, has been ruled as legal by the City Attorney for the eldetion to procedd. Councilman Snyder stated that he believed the Council cannot postpone the election. Roll Call on motion: Ayes ~ Councilmen Williams, Gillett and Schouten. M. having arrived, said time being the hour set for receiving bids for the doing of the public printing for the City for the fiscal year 1932-33. It was moved by Councilman ~'Villiams and seconded by Councilman Gillett that the opening of said bids be postponed. Roll Call: Ayes : Councilmen ~~dilliams, Gillett and Schouten. Noes: Councilmen Davies and Snyder. A communication was received from the City Treasurer recommend- ing advance from the General Fund to the Bond Redemption Fund of X1375.00 to assist in meeting the currect principal and interest maturities in the following 1915 series: I .. ~ 150.00 V ~ 300.00 o~ ... 125.00 Ac. Thereupon it was moved by `'ouncilman 'Davies and seconded by Councilman Williams that the transfers as recommended by City Treasurer Reed be authorized by the Council and that warrant~be drawn on the City Treasurer for said amount. Roll Call: Ayes: Councilmen Williams, Davies, Gillett, Snyder and Schouten. Noes: None. Councilman Snyder addressed the Council stating that some time ago afire was reported through the s witch. board and that because of the delay caused by the Desk Sergeant by not relayi ng the complete mess age to the Fire 'Department considerable damage occured which would have ot herwise been averted, which. was overlooked as a mistake, but the other day the County of Los Angeles incarcerated a desperate criminal in our City Jail and 'Desk Sergeant ~tiilliams left the f ail ~~oor unlocked and permitted the prisoner to escape for which neglect Mr. Williams should be discharged, therefore, making a motion that Mr. Hugh Williams be discharged as Police Officer of the City of Lynwood, which was duly seconded by Councilman Davies, and upon roll call showed the following result: Roll Call: "yes: Councilmen Davies end Snyder. Councilman Williams addressed the Council stating that it has been called to his attention that the City Mecnanic is buying his supplies for use on City equipment from out of town concerns where he could buy them locally at the same cost, therefore making-a motion that Mr. Bishop, City Mechanic be instructed to purchase all supplies for use in repair- ing City equipment locally, provided he can buy them at the same price as elsewhere and commodity being equal, which motion was duly seconded by_Councilman Snyder, and upon roll call showed the following result: Ayes: Councilmen Williams, Davies, Gillett, Snyder and Schouten Noes : None. It was moved by Councilman trlilliams and seconded by Councilman Gillett that the meeting adjourn to January 17tH, 1932, at 7:30 P. M.
