M. . ~- Mayor Davies in the chair. Councilmen Snyder, Wright, Daetweiler, Childs and Davies answered the roll call. In the absence of City Attorney Hubbard, his Assistant and Asso- ciate Mr. Clare Enyeart acted. It was moved by Councilman Childs and seconded by Councilman Sny- der that the minutes of the regular meeting of July 18th, 1933 be approved es written. WRITTEN COMMUNICATIONS: common ca on was received fromthe Los Angeles Chamber of Com- merce announcing that Mr. Justus S. Wardell of San Francisco has been ap- pointed by President Roosevelt es Federal Administrator of Public Works under the-terms of Title No. 2, NationalIndustrial Recovery Act; also re- garding the advisory group for California that have been appointed, request ing the Council to caaperate in urging upon Mr. Wardell that the offer of the Los Angeles Chamber of Commerce to assist him €n d his committees in coordin~ sting the Los Angeles County program be accepted. There being no objection the Mayor instructed the City Clerk to reply to said communication that the Council are pleased to give him their 100 cooperation in the matter. A communication was received from Chief of Police Mueller of South Gate, and President of the Southeast Coordinating Council, urging the Coun- cil to appoint a recreational playground commission for the purpose of for- mulating plans for vlaygrounds, nlungcs and wading pools for the smaller children. There being no oriection, the Mayor appointed Councilman Snyder a committee of one to look into the matter and see if the school is not conducting playgrounds activities at the various schools. A communication was received from the League of California Muni- cipalities stating that the National Industrial Recovery Act campaign is not intended to include either City or State employees. Mere being no ob- ~~ction the communication was ordered filed. A communication was received from Geo. E. Force, 2617 112th Stree~ Lynwood, stating that h® made a mistake last year in paying lighting assess went ~n Lot 27, Block 11, Tract 5418, whereas he owns Lot 26, Block 11, Tray 5418 and should have paid on Lot 26, therefore requesting that the 3~ghting assessment be transferred to and credited to said Lot 26. There being no objection, the Mayor referred the matter to City Treasurer Reed for consi- deration and if he finds that an error has been made that he make the proper ed3ustment and correction, and report to the Council his acti on in the mat- ter. A communication was received from Dr. Hugh R. McMeekin, Secretary of building Committee of St. Anne's Episcopal Church of Lynwood making ap- plication for permit to erect a stucco frame building for use as a Church on°tha corner of Lewis and Lynwood xoed on Lot 758, Tract 3078, in full ac- cordance with all requirements of a building of this nature. A petition signed by 16 property owners residing near to Lot 758, Tract 3078, protesting against the erection of a church on said Lot, was received. Mayor Davies requested a~ opinion from Attorney Enyeart relative to the matter. Attorney Ehyeart ruled that inasmuch as the City is not zoned for certain classes of buildings in that particular district, it is not a Gov- ernmental affiar for tre Co~~ncil to determine whether or not a building may be built and cannot refuse a permit unless there is a deed restriction against Church edfices, however, that they would have to comply with any building Ordinance in effect. Thereupon it was moved by Councilman Snyder and seconded by Coun- cilman Wright that the Building Inspector be instructed to issue a building permit for the erection of a church edfice on Lot 758, Tract 3078, when proper application has been executed and delivered to him. The hour of 5:00 o'clock P.Mr~iaving arrived, said time being the hour fixed for receiving bids for public printir~ for the fiscal year 1933- 1934. `I`he Clerk presented two bids which had been filed. It was moved by Councilman Wright and seconded by Councilman Sny- der that the bids be" publicly opened and declared. Roll Call: Ayes: Councilmen Snyder, Wright, Daetweiler, Childs and Davies. Noes: None. ~~ The following. firms submitted bids in the following amounts ; Lynwood ?Tess; 35~ per column inch for first insertion 25¢~ per column inch for each insertion thereafter, with standard 12 em column. Lynwood Tribune : 30r~ per inch for first insertion 20~ per inch for each subsequent insertion, to be set in 8-point type, nine lines to the inch. Considerable discussi on was had relative to the size of type used by each newspaper. It was moved by Councilman Childs and seconded by Councilman Wright that the bids be thrown out and the contract be awarded on the basis of the previous bid. Inasmuch as Acting City Attorney Enyeart ruled that the Council would either have to reject all bids, or award it to the lowest responsible bidder, Councilman Childs withdrew his motion at the consent of Councilman Wright, and it was thereupon moved by Councilmal Childs and seconded by "'"'^ Councilman Wright that the bids be rejected. Considerable discussion was then had about compiling a set of specifications by which the printers might be guided in submitting their bid, Mayor Davies suggesting that Councilman Childs prepare same inas- much as he is familjar with printing, however, Councilman Childs declined to act, whereupon Mayor Davies ordered the bids laid on the table until later and to proceed with. other business. The hour of 8 :00 0 ~ cl ock P. M. having arrived, said time being the hour fixed for receiving bids for the furnishing of electric current for illuminating the street lamps installed in the City of Lynwood for the district known as Lighting Maintenance District No. 6, for the period of one year . 2'he City Clerk presented the only bid from the Southern Cdifor- n is Edison Company. Thereupon it was moved by Councilman Wright and seconded by Coun- cilman Daetweiler that the bid be publicly opwned and declared. X54, entitled: "A RE:;OLUTTON OF THE CITY OF LYNWOOD AWARDING CONTRACT FOR FURNISHING ELECTRIC CURRECT FOR PUR:, POST OF ILLUMINATING CERTAIN STREET LAMPS IN SAID CITY TO THE SOUTHEf~N CALIFORNIA EDISON COMPANY", was read, authorizing the City Mayor and City Clerk to execute contract in and for the City of Lynwood. It was moved by Councilman Daetweiler and seconded by Councilman Wright that said Re- solution No. 854 be adopted. Roll Call Ayes: Councilmen Snyder, Wright, Daetweiler, Childs and Davies. Noes: None. A communication wAs received from Mr. Ben Fink requesting permis- sion to conduct a business for the dispensing of cigars, cigarettes, tobac- cos and featuring mvelty games in connection therew.L th, accompanied with """'~ 12.00 in cash to gay for yearly license fee. There being no objection, the Mayor ordered the matter turned over to deputy license collector Col- lips for issuacne of license. Reports were received from the Building and License Department, Court Department a3~d Health Department showing activities of their res- pective department for the month of July. There being no objection, the Mayor ordered same filed. UNFINISHED BUSINESS: dinance of the City of Lynwood providing for the licensing of and the operating of wholesale gasoline, ice and laundry trucks in said City, was read for the first time by caption. It was moved by Councilman Wright and seconded by Councilman Daetweiler that said ordinancb be accep- ted as read the first time and pass to the second reading. Roll Call: Ayes: Councilmen Snyder, Wright, Daetweiler, Childs and Davies. Noes: None. ~~ Councilman Snyder addressed the Council relative to license for distributors of auto accessories in the City of Lynwood, sta ing that he be- lieves that they should be compelled. to pay a license. There being. no ob- ~ection, the. Mayor appointed Councilman_.Snyder and Daetweiler a committee to investigate said matter. A communication was rcceived from Water Superintendent Bateman re- commending improvements to the pumping equipment, as follows: 1. To rebuild Kimball pump at Plant No. 5 into a 500 g.p.m. unit. 2. Replace 12" Kinball at Plant No. 1 with a 10" pump to care for sub-surface life only, which would bring back into service the old well now unused. 3. Replace and trade 20 H.P. .mat or and head for a 60 H. P. motor and head at Palomar Pumping Plant as present motor is somewhat overloaded, which alterations would cost approximately 850.00 and mature into a saving of approximately 1,000.00 on power consumption, besides greatly increasing the efficiency of the water system. .Thereupon it was moved by Councilman Wright and seconded by Coun- cilman Snyder that ?"Teter Superintendent Bateman be authorized to go ahead and make the necessary alterations and repairs e.s recommended in order to procure the reduced base rate Her u.`!C'.~'., and to increase the efficiency. A communication was received from City Engineer Bateman reporting that the cost of resurfacing Mulford Avenue from Long Beach Boulevard to easterly termination is 690.00. Thereupon RESOLUTION N0. 855, entitled: "A RESOLUTION OF THE CITY OF LYNWOOD, CALIFORNIA, REQUESTING AN APPROPRIATION FROM THE BOARD OF SUPER- VISORS OF LOSANGLES COUNTY, FOR THE PURPOSE OF PAVING MULFORD AVENUE EASTERLY OF LONG BEACH BOULEVARD", was read. Roll Call: Ayes: Councilmen Snyder, Wright, Daetweiler, Childs and Davies. Noes:None. City Treasurer Reed addressed tr~e Council stating that the case entitled: Herman Goldberg and W. Arthur Farrar, vs. County of Los Angeles which the City of Lynwood is sponsoring comes up for trial and hear- ing on ~+ugust 9th; also that he has contacted the City of Santa Monica rela- tive to them helping in the expense for Counsel, but that they have not re- ported; also that he has contacted Manhattan, Beach, but they have not re- ported as yet; that Culver City are not inclined to participate; and that Los Angeles will help in endeavoring to retard progress of the plaintiffs as much as possible. """ Mayor Davies reported on his trip to Sacramento, tra t they were unab~ to get a validating act through for the districts involved, as it was not within the activities and did not came under the head and classifie~- tion that the Legislature were thereto consider. The matter of the awarding of the contract for public printing was brought up off of the table. After some discussion, it was moved by Councilman Wright that the meeting adjourn to August 15th, 1933, at 7:30 P. M., however, there being no second, same lost for lack of a second. Councilman Snyder wisher. the City Attorney to submit an opinion on the validity of the slot machine ordinance. Mayor Davies stated that he believes that it would be in order, however,: it was decided to have City Attorney Hubbard write same when he returns from his vacation. It was moved by Councilman Childs and seconded by Councilman Wright that the Lynwood ~'ress be awarder the printing of legal notices for the next 30 days, and the Lynwood Tribune be awarded the printing of legal-notices for 30 days following the expiration of the Lynwood Press period, and to alternate until the contract be finally awarded, at the price of 50~ per inch per column for the first insertion and' 35¢~ per inch for each insertion thereafter.
