RESOLUTION NO. 14 -2015
A RESOLUTION APPROVING A PAYMENT IN LIEU OF TAXES (PILOT) TO
THE CITY OF RICHMOND AND RECOMMENDING COMMON COUNCIL OF
THE CITY OF RICHMOND, INDIANA, PASS-AN ORDINANCE FOR AN
ADDITIONAL APPROPRIATION TO THE RICHMOND SANITARY
DISTRICT'S 308 LANDFILL ACCOUNT
WHEREAS, The Board of Sanitary Commissioners (hereinafter "Board ") for
the Richmond Sanitary District (hereinafter "RSD ") owns, operates
and collects revenue for the City of Richmond, Indiana's
(hereinafter "City ") landfill (hereinafter "Landfill "); and
WHEREAS, The revenues collected from the Landfill are placed into and
disbursed out of the RSD's 308 Landfill account, which account is
funded by user fees; and
WHEREAS, Employees of the City, including employees of the Richmond
Sanitary District, have gone without any pay raises for at least
seven (7) years and over that same period of time have only been
granted two (2) stipends of Five Hundred Dollars ($500.00) each
in 2013 and in 2014; and
WHEREAS, It has come to the attention of the RSD that the City does not
currently have, nor does it anticipate having, an operating cash
surplus in its 2015 budget in which to grant City employees any
stipends for 2015; and
WHEREAS, The Board of RSD believes it is in the best interests of the Board
of RSD and the Common Council (hereinafter "Council ") of the
City for the Board of RSD to enter into with Council of City a
Payment in Lieu of Taxes (hereinafter "PILOT "), wherein the
monies for a PILOT could be based on RSD assets but
payment would only be from the 308 Landfill account; and
WHEREAS, There are not sufficient funds at the present time in RSD's budget
in its 308 Landfill account to make a payment to the City's General
Fund for stipends for City employees for 2015 through a PILOT;
and
WHEREAS, RSD believes that there are sufficient cash assets available in its
308 Landfill account, which is funded by user fees, that could help
assist and augment the General Fund of City for the purpose of
granting all City employees, including RSD employees, stipends
for the year 2015, all of which would not impair RSD's ability to
operate the Landfill or to meets its obligations thereto; and
WHEREAS, The Board of RSD recommends that its PILOT payment to City be
in the amount of $254,000; and
WHEREAS, RSD approves, recommends and encourages Council to make an
additional appropriation of $254,000 to the 2015 budget of RSD's
308 Landfill account in order for the City to subsequently make a
payment of those funds to the City's General Fund.
NOW THEREFORE, BE IT RESOLVED by the Board of Sanitary Commissioners of the
Sanitary District of Richmond, Indiana, which said Board, having reviewed and discussed
the PILOT concept and the Whereas set forth above, now approves entering into a PILOT
with the City of Richmond, Indiana, as set forth in the Whereas above, only for calendar
year 2015.
BE IT FURTHER RESOLVED by the Board of Sanitary Commissioners of the Sanitary
District of Richmond, Indiana, that said Board, expressly subject to formal approval by
the Common Council of the City of Richmond, Indiana, approves the additional
appropriation by the Common Council of $254,000 to the 2015 budget of the Richmond
Sanitary District's 308 Landfill account.
Passed and Adopted this day of November, 2015, by the Board of Sanitary
Commissioners of the Richmond Sanitary District of the City of Richmond, Indiana.
