WRITTEN COt~,'IUidICATIONS: A written communication was received from I!fir. David Bell pro- testing the payment of his light maintenance bill, stating that later a petition will be presented to the Edison Company seeking relief, when he will ask for return of X7.60 lighting assessment paid. There being no objection, the communication was ordered filed. A communication was received from I~r . John Strain requesting permission on behalf of the Utopian Society to hold a picnic at the park circle located at Los Flores Boulevard and State Street on Sunday, August 12th, 1934, when Judge Ben Lindsay is to be the principal speaker. It was moved by Councilman Snyder and seconded by Councilman Daetweiler that permission be granted with the request that the grounds be left in as clean a manner as they found them, and to create no nuisance of any kind. All members of the "ouncil voting aye, the N`ayor declared the motion duly carried and it wa.s so ordered. A communication wa_s received from Mr. R. Y. A communication was received from the Stockton Convent ion Bureau requesting the Council to keep in mind that they are putting in a bid,to hold the League of California h~iunicipalities Convention for year 1935 at Stockton, at the Pasadena Convention in September, requesting the City of Lynwood to support them. There being no objection, the Mayor ordered the comnunicat ion filed, requesting that the Council keep the matter in mind. A communicat ion was re cei ved from Nr . H . D. Alfonso, County Tax Collector, submitting schedule of pro je cts in the City under the Improve- ment Bond Act of .1915 and quoting the amount of delinquent assessments in each for the fiscal year 1933-1934 as of June 30th, 1934, demanding that the co unci 1 pr ovide funds for the payment of al 1 delinquent ass ess- ments for such projects and of del inquent interest as renuired by statute, either by transfer of general funds to interest and sinking funds of each of such dis tricts or ~y the levy of tax in accordance wi th Section 16 of said Act. There be ing no ob jection, the Mayor referred the matter to the City Treasurer and City Attorney for analysis and report. A petits on was received signed by L. E . Reber, Hannah E. Emmons, W. L..Moore, A. E. Hilts, Hanlon and McGary protesting the existing of so many dog kennels on Long 'each Boulevard, alleging that it is deprec- sating the value of their hol.di n~?s, is a nuisance from the standpoint of yelping and the stench a»d t~nsan~t taro condi ti on th at is bound to prevail, requesting teat t?~P ^o>>ne3 1 erapt mp~o si-.ri r.~?ent legs sla ti on that would discourage ot?~ers locating on tt^e boulevard, and also ..require that petitions re circulated signed by property owners within 300 feet of any proposed location. There being no ob jection, the i~.~ayor deferred the matter until the matter o1' the business license ordinance (now pending) is to be considered, where there is a clause dealing with the situation. A communication was received from var. J. M. Wood, Deputy and Chief,. Clerk of Budget ac Deport Division of the County of Los Angeles, enclosing copies of contract which reduces the cost of keeping prisoners, incarcerated in the County Jail by the City for violati on of any City Ordinance, from X1.00 per day to 95~L per day. Thereupon it was moved by Councilman Meyer that said. contract be accepted and the Mayor be author- ized to execute .same for and in behalf of the City of Lynwood. City Attorney Kennedy reported that the members of the City Council, the City Treasurer,and Tax Collector of Los Angeles County had had instituted against them in the District Court of Appeals a ti`Vrit of Iv~andate, praying that the District Court of Appeals grant a pro ceeding for a writ of mandate directing the City Council, the City Treasurer and the Tax Collector to levy an additional tax on all the property in the City of Lynwood to take care of c ertain delinquencies in districts under the Improvement Bond Act of 1915, numbered Districts Q, R, T and U, stating that the matter comes up for hearing on Friday, August 10th, 1934, at 10 A. M. in said Court. City Attorney uennedy stated that the inter- esting point in the proceedings is that the remedy that they ask for is that the levy be made to cover the accumulated delinquencies, which would amount to a tax rate in excess of 50~ per hundred dollars, assessed valuation, to take care of same, whereas the grounds for the writ is the first Lakeport case, but on rehea ri ng the Court held that the levy should be limit ed to 10~ per hundred dollars tier district. City Attorney Kennedy stated that the situation is sF~rious and every effort would be made to defend the proceeding. Mr. T:. F. T?erer addressed the "ouncil to the effect that the si.tuat i on «~i 17 be ser7 ons i~' t'~e ^i ty is compel led to levy for all de- linquencies, as tie reoTle a.re no~~r ~~na'~7e to nay their taxes, and if more :are add ed the burden wi l7 ?~ e unbeara'~l e . ~:onsiderable discussion ensued relative to the matter and it was the unanimous opinion of the Co~?ncil that if the Council are com- pelled to levy for all delinquencies as demanded in the writ that the result will be that it will dis courage those who ire now paying and they also will default , thereby paralyzing the normal functions of the City government, which would result in disaster to the bondholders as well, and they would not recover as much as they are now realizing from their investment; also the point was brought out that the others would also apply for a brit of Mandate as affecting other districts that are in default., which would. greatly increase the tax burden. Manor Roster stated th at some ti me ago an off er was made to the Pac if is States Company for the sett 1 ement of the Century Poulevard Ponds , and that Pfs. Neale, who i.s negotiating with the City stated that ,.. they refused the offer, however he believes that it should be in writing from the Company. Thereupon it was moved by Councilman Daetweiler and seconded ` by Councilman P~ieyer teat we instruct the City Treasurer to inform Mr. Neale J to pro cure a eommunieati on from the Pacific States Company as to wheth er or not theyT will accept the offer xrevi_ously made, inthe amount of 100,000 to clear the issue, and that no further negotiations be made unti 1 such 1 e t ter is received . Thereupon An Ordinance of the City of Lynwood, California, providing for Licensing and Regulating the carrying on or certain busi- {' nesses, professions, trades, call ings and occupations; fixing a penalty for the violation thereof; repealing allordinances and parts of ordinances in conflict therewith, was introduced and read for the first time, as amended. Thereupon it was moved by Councilman Lake and seconded by Councilman Ivieyer that said ordinance be accepted as read,the first time and pass to the second read ing .
