Councilman Lake, l~~eyer, Snyder and roster answered the roll call.
Councilman Daetweiler was absent.
An Ordinance, entitled: "~~n Ordinance of the City of Lynwood
fixing the rates of taxes and levying taxes for the fiscal year beginning
July lst, 1934, and ending June 30th, 1935" was introduced and read for
the first time. "`
It was moved by Councilman Lake and seconded by Councilman
Meyer that sald~Ordinanee be accepted as read the first time and pass to
the second reading.
Roll Call:
Ayes: Councilmen Lake, Nieyer, Snyder and Boster.
Noes: None.
Absent: Councilman Daetweiler.
The City Attorney advised that the demand of C. J. ~Jalker,
dated August 9th, 1934, that a levy be made to provide for certain "It~-
provement Bond Act of 1915" delinquencies was properly disregarded pur-
suant to the opinion of Mitchell & Johnson rendered in the Graefe
proceeding.
City Treasurer Reed addressed the Council to the effect that he
wishes ar expression from t?~eir Honorable ~3ody as to advertising the
delinquent lighting assessments. Fast .year the State Legislature granted
a moratorium on taxes, waiving delinquent e?~arg;es, and in conformance
withtheir action, the !'ounci 1 alsro wai ~~ed tie ~P7_inquent charges on the

City Attorney Kennedy ruled that the City should advertise in
order that tY~e sale of the property may be made in accordance with the
law which makes it rnandaLOry upon the tax collector, within thirty days
after the date of the delinquency to begin the publication of a notice ""'""
of sale of the property upon which the assessments have not been paid.
Thereupon the Council instructed the City Treasurer to advertise
as required by law.
A resolution employing special counsel in the case of Graefe
vs. City of Lynwood now bending in the District Court of Appeals wherein
the plaintiff demanded that the Council levy enough to .take care of
certain delinquencies in four 1915 bond improvement act districts, the
special counsel ,.being Messrs. James H. Mitchell and Leton T. David, and
the resolution proposed a fee of ~P500.00, or X50.00 a day each for office
work, and 100 a day each for court work, plus necessary and reasonable
out-of-pocket expense. Inasmuch as the resolution was not clear as to
the exact amount to be paid by the City, the resolution was laid over
and the-City Attorney eras to investigate the matter further, as to the
total cost, as the original letter setting forth the terms of the employ-
ment was not available to compare with the Resolution. It was also
suggested that a bill be requested from the special counsel for their
service after August 24th, when the matter comes up for hearing.
It was moved by Councilman Take and seconded by Councilman Myer
that the meeting adjourn to August 27th, 1934, at 7:30 A. M. All members
of the Council voting aye, the AFayor declared the motion duly carried and
it was so ordered.
