The City Council of the City of Lynwood met in regular session at the City Hall, 11331 Plaza Street, onabove date, at 7:30 P. M. Mayor Boster in the chair. Councilmen Meyer, naet~~re9 7.er, "nvder and Boster answered the roll call. Councilman Lake was absent. It was moved by Councilman Meyer and seconded by Councilman Daetweiler that the minutes of the previous regular meeting of September 18th, 1934, be approved as written. Roll Call: Ayes: Councilmen Meyer, Daetweiler, Snyder and Boster. Noes: None. Absent: Councilman Lake. T~RITTEN COMMUNICATIONS: A communication was received from the George Washington P. T.A. to the effect that there is no traffic officer at Century Boulevard and Atlantic Avenue, and that a number of children cross there daily and on account of the heavy traffic it makes it very unsafe, Suggs>sting that an officer be detailed to said location. Mayor Boater stated that he took it up with Chief Bailey at the executive meeing of the Council and was informed that an officer is stationed there when children go to and from school, however, that they will investigate the situation further. A communication was received from the Lynwood Elementary School requesting that the Council pay one-half of the salary of a special officer in the person of Lisle Hadlock, his salary being 100.00 per months as it has been found advisable for the Board to employ one to guard the materials from theft during the demolition of the schools, as the S.E.R.A. guards have proven unsatisfactory, petitioning the council on the ground that Mr. Hadlock is performing functions of a police of~'icer. After due deliberation, the Mayor instructed the City clerk to Communicate with Mr. Stanley, President of the Board of Trtlstee,s, to the of°ect that the ~'itq has no funds in its budget to x~r.ovide for a snecial officer for such duty and that the Council feels that it is nov a part of the function of city government ; also that the Council feels that if an appeal is made to the SERA office to provide capable guards who Will safeguard their property they will cooperate, notwithstanding the fact that the City Council wishes. to aooper~te withe the Board of Trustees of Lynwood Elementary Schools to the fullest exte~a;t.. The letter from Louis H. Decker, C. P. A. which was brought up for consideration of the council at the last meeting, wherein he makes application to audit to City books for the fiscal year 1934-35 at the price of X800.00, payable in four quarterly installments of 200.00 each for quarterly audits, was again considered. Thereupon it was moved by Councilman Snyder and seconded by Councilman Daetweiler that Louis H. Decker, C. P. A. be awarded the contract to do the auditing of the City books for the fiscal year 1934-35 on the basis and for the price quoted above, as per his communication. Roll Call: Ayes: Councilmen Meyer, Daetweiler, Snyder and Boster. Noes: None. Absent: Councilman Lake. A communication was received from Mrs. Maurice N. Hang making application for a pet shop license, said pet shop to be located at 11416 Atlantic Boulevard. License Collector Collins addressed the Council to the effect that he wotald recommend the issuance of license for same in this case, as there is only one residence near the location in Lynwood and that is an apartment above a store building. Thereupon it was moved by Councilman °nvder and seconded by Councilman Daetwe~ler that Mrs Hang be granted a license to overate a x~et shop at 11416 Atlantic Boulevard, and upon roll call showed the following result: Ayes: Councilmen l~leyer, Daetweiler, Snyder and Boster. Noes: None. Absent: Councilman Lake. A.eommunication was received from C. E. Rhode submitting his resignation as an employee of the City of Lynwood, to tak e effect as of September 19th, 1934. Thereupon it was moved by ~ ~ c} Councilman Daetweiler and seconded by Councilman Snyder that said resignation of C. E. Rhode be accepted as of September 19th, 1934. All members of the Counc.ilpresent voting aye, the Mayor declared the motion carried and it was so ordered.. Report of the activities of the City Court, License and Building Department, Fire Department and health reports were received. There being no.ob~ection, the Mayor ordered same filed. It wasp moved by Councilman "nyder and seconded by Councilman naetweler that said ,~ Resolution No. 923 be adopted. Roll Call :.. Ayes: Councilmen iuieysr, Daetweiler, Snyder and Boster. Noes: None. Absent: Councilman Lake. The contract for health services for the year beginning October 1st, 1934, and ending September 30th,1935, for the sum of 500.00 was brought upfor consideration of the Council, and it was the conclusion of the Council that the City of Lynwood is getting its service at as low a rate, and lower than most cities, therefore it was moved by Councilman Daetweiler and seconded by Councilman Snyder that said contract be accepted and that the Mayor be authorized to execute said contract for and in behalf of the City of Lynwood. Roll Call: Ayes: Councilmen Meyer, Daetweiler, Snyder and Boster. Noes: None. Absent: Councilman Lake. A communication was received from Mr. Charles J. Miller submitting list of hours that he put in on the painting of City trucks and automobiles, being 36 hours; also which time he used his spray gun to do the work. It was decided by the Council that a fair price for his service would be 50~ per hour, plus 2,00 for the use of his equip- ment. It was pointed out that said work was done while Mr. Miller was off duty. ,~,~, Thereupon it was moved by Counc~Llman Nfeyer and seconded by Councilman Snyder that Mr. At~1.ler he allowed `20.00 for h3.s service and the use of his macrine in the paintinrr off' said vehicles and that a warrant be drawn or.. the City Treasurer for said amount. Roll Call: Ayes: Councilmen Ivieyer, Daetweiler, Snyder and Boster. Noes: None. Absent: Councilman bake. NEtiY BUSINB55: A communication was received from Burs. A. R. Sheets, 3547E Mulford Avenue, Lynwood, requesting that Mulford Avenue be repaired east of California Street. There being no objection, the Mayor in- structed the Street Superintendent to submit the estimate of the cost of resurfacing said street with rock and. oil. City Attorney Kennedy addressed the Council to the effect that some time ago a Resolution was adopted authorizing the Mayor to enter into an Agreement for a compromise settlement of Acquisition and Improvement Districts 18 and 20 which are held by th.e Pacific States Savings and Loan Company, which agreement was objected to by the County Counsel on two points, so a new Agreement has been negotiated which will eliminate the objectionable points, and it is necessary for the Council to pass a new resolution to enter into this agreement. Thereupon the City Attorney proceeded to read the agreement, reading as follows : -~•.~ "MEMORANDUM OF AGREEMENT made and entered into this 2nd day of October, 1934, by and between the Pacj_fic States Savings & Loan Company, 745 Market Street, San Francisco, California, and the City of Lynwood, California, a municipal corporation. "WITNESSETH; That for ar.~ j.n consideration of one. (1) dollar in hand paid by the C~ ty of T,~~~~cod to tie ~'aci_fic States Savings & Loan Company, the recei rt ~nrhereof is '^erehy acknowledged, the parties agree as follows: "1. The City of Lynwood, California, agrees to pay to the Pacific States Savings 8~ Loan Company 50,000 on or before the 10th day of October, 1934, and upon the payment of said sum as herein provided, the Pacific States Savings & Loan i;ompany will deliver to the City o Lynwood, California, all matured coupons appertaining to bonds of Acquisition and Improvement District 18 and 20, Los Angeles County, California, together with 10~ of the bonds now outstanding, and the coupons appertaining thereto. rrlI. The Pacific States Savings a.nd Loan Company further agrees to and does hereby grant to the City of Lynwood, California, an option subject to the terms and conditions hereinafter set forth to purchase all bands in said districts and all coupons appertain- ing thereto remaining outstanding after the purchase and delivery of those bonds provided for in paragraph I hereto. "l. In the event the City of Lynwood, California, pays to the Pacific States Savings & Loan Company on or before the 31st day of December, 1935, the sum of 40,000.00, the Pacific States Savings & Loan Company will deliver to the City of Lynwood, Calif- ornia, l0~ of the bonds of said districts outstanding at the date of this agreement together with the coupons appertaining thereto. "2. In the event that the City of Lynwood, Calif ornia, pays to the Pacific Stares Savings & Loan Company on or before the 2nd day of January of each year from 1937-1944 inclusive, the sum -_ of 40,000.00, the Pacific States Savings & Loan Company will de- liver to the City of Lynwood, California as each payment herein provided is made 10~ of the bonds of the said districts now out- standing together with the coupons appertaining thereto. ."3. The Pacific States Savings & Loan Company agrees that the bonds selected for delivery to the City of Lynwood, Calif- ornia, upon making the payments provided herein shall comprise the earliest maturities at the date of the payment. "4. It is agreed by and between the varties hereto that in the event the City of Lynwood, California, is in arrears for more than sixty (60) days in making any of the herein mentioned payments interest at the rate stipulated in the bonds shall be due and payable on the bonds then outstanding during the period of delinquency; provided, however, that if any payment shall not have been made within six months after the due date thereof this op- tion shall cease and terminate as to the bonds for which payment has not been made as herein provided; and, further provided, that upon termination of the option by reason of default in making ~m.y payment provided herein the bonds outstanding at the time of ter- mination of the option shall. constitute a lien in the same manner undo to the same extent as of the date of this agreement. "5. At. any time during the life of this agreement the next succeeding payment or payments may be made prior to the due date thereof upon the City of Lynwood giving ten days wri~ten no- tic~e of its intention to prepay such payment or payments. City Treasurer reed Addressed the Couneil relative to the mat-ter stating in part that with the first payment of 50,000.00 the City would retire approximately"~168,944.00 of bonds and cou- pons, and if the subsequent payments are kept up it will take ~4T0,000.- 00 to retire the whole issue as against1,366,000.00 if the bonds run to its termination date as under the present system provided, stating further th.-t the Agreement is not binding as to the City exc-epting for the firstge9r; a? so teat such a plan would absolutely prevent an;v pyramiding; also that he ras taken the matter up with the. County and the County Counsels office believe this instrument waul.d be a valid one, and Mr. Panne, the County Auditor, expressed himself as favoring the plan verb much and the money would be avail- able whenever the agreement is accepted. Thereupon RESOLU'1~ION 1~fU. 924, entitled.: "'A RESOLUTION OF THE.. CITY COUNCIL OF THE CITY OF LYN~YOOD SUBMITTING AGREEMENT TO _ PACIFIC STATES SAVINGS AND LOAN COMPANY FOR A COMPROMISE SETTLEMENT ~ IN THE MATTER. OF BONDS AND COUPONS-OIITSTANDING IN ACQUISITION AN D IMPROVEMENT DISTRICTS NOS. 18 AND 20 OF THE CITY OF LYNWOOD", was read. It was moved by Councilman Snyder and seconded by Councilman Meyer that said Resolution No..924 be adopted and the Mayor be authorized to execute said agreement for and. in behalf of the City of Lynwood as recited in said Resolution. Absent: Councilman Lake.- An Ordinance of the City of Lynwood waiving certain delin- - qu ent~ penalties for the none-payment of light assessment was intro- duced and read for the first time. It was moved by Oouneilman Sny- der and seconded by Councilman Dastweiler that said Ordinance be adopted as read the first time and pass to the second reading. ~~ Roll Call: Ayes: Councilmen Meyer, Daetweiler, Snyder and Boster ''`~" . Absent: Councilman Lake. ~ ORAL COMMUNICATIONS; "~ r. oy Gardner, proprietor of Des Lunch Room addressed the Council relative to a separate meter for each business house , rather than one meter serving several store buildings. -Mayor Boster informed the gentlemen that the Council is considering a new water ordinance wh en the matter will be taken care of. Mr. Chas. W. Weber addressed the Council relative to the Compromise Agreement for A. & I Districts N . os. 18 and 20, as to whether or not this would take avay any gasoline allotments away from other districts, etc. City Treasurer Reed addressed the Council explaining the entire matter to him. The budget for the fi seal year 1934-1935, showing es- timated revenues of93,020.56 and expenditures of93,003.00 , was presented. It was moved by Councilman Meyer and seconded by Councilman Daett~dler that said budget be approved and adopted. Roll Call: Ayes: Councilmen Meyer, Daetweiler, Snyder and Boster. Noes: None. Mayan Boater stated that many co_mplad. nt s are being r~eived about weeds growing over sidewalks, anal therfore he favors purchasing the mower that was demonostrated to the Council some time ago, as it will pay for itself within a year, the plan being to have men fol- low the mower up and rake the weeds into piles to burn which will '"!` also help clean up some delinquent rater accounts. Thereupon it was moved by ouncilman Snyder and seconded by Councilman Meyer that the City purchase a Gravely Tractor with sickle- bar mower attachment at a price of 360.00, if satisfactory arrange- ments can be made as to payment of same. It was moved by Councilman Daetweiler and seconded by Coun- cilmat~ Snyder that the meeting adjourn to October 16th, 1934, at 7:30 M.
