Mayor Boster in the chair. Councilmen Fake, Meyer, Snyder and Boster answered the roll call. Councilman Daetweiler was absent. It was moved by Councilman Snyder and seconded by Councilman I~Zeyer that the minutes of the previous regular meeting of October 2nd, 1934 be approved. as written. All members present voting aye, the I~~,~ayor declared the motion carried and it was so ordered. G'~t ITTEN COMPtZUNICATIOTdS: An invitation was received from the Los Angeles County League ofMunicipalities inviting the Council to attend their next meeting to be held on October 18th, at 6:30 dinner, when Bernard Brennan is to be the principal speaker on the subject "Joint Venture". The Mayor ordered any one that can attend to notify the City Clerk in order that reservations may be made. A communication was received from the 1915 Improvement Bond Aet Committee reporting on the progress of the 1915 Improvement Bond Act Litigation, entitled: "American Company vs. City of Lakeport", requesting further contribution in the amount of 100.00 for the further carrying on of said ease. It was moved by Councilman IvTeyer and seconded by Councilman Snyder that the City contribute `50.00 to aid in financing this litigation. moll Call: Ayes: Councilmen Lake, IrTeyer, Snyder and Boster. TJoes: None Absent: Councilman Daetweiler. A communication was received from T~Tr. ~~~d. INT. Harris, 11661 Esther Street, offering for sale a radio transmitter for ~p50.00 to be installed free of charge, offering to operate same for 50.00 per month. T~~Iayor Boster stated that while this is a very good offer, however, the City cannot afford the service as the present arrangement only costs approximately X2.50 per month, therefore, he ordered the communication filed for future consideration, if it is deemed advisable. A petition :Tras received from property owners residing adjacent to the alley south of i;iulford, between Court Street and the alley west of Long Beach Boulevard, requesting that said alley be re- surfaced before the rain commences, signed by ~V. I. Humphrey and 7 other property owners. There being no objection, the Mayor instructed the City Clerk to request City Engineer Bateman to prepare estimate of cost of materials to do said work and report back to the Council at the next regular meeting, in order that a SERA project can-be started, if money is found available. The Health reports for weeks ending September 29th and October 6th were received and ordered filed. ORAL COIy~JIUNICATIONS: r~2r. Tom ea addressed the Council requesting information if and when the alleged overpayment of fine ti~Ji11 be refunded to him, as prayed for at a previous meeting. ~~Tayor Boster stated that he had ex- amined the Court Cleri:'s records and that the abusive conversation that was used may have had a lot to do with the additional fine, however, ~Tr. Leal denied that any abusive language had been used. Iv2avror Boster stated that they are waiting for a report from Judge Nilson regarding the matter. It was moved by Councilman Snyder and seconded by Councilman Ixa,ke that said Ordinance be adapted. as read the second time, finally pass and be published as required by law. Ivlergen, 12011 Long Beach Blvd. for permit to operate a kennel at said address came up for consideration of the Council, and after due deliberation it was moved by Councilman Snyder and seconded by Councilman Meyer that the City Clerk communicate with the applicant requesting that he circulate a petition to be signed by the two nearest residents and 50f of the residents within a radius of 300 feet from said address. All members of the Council present voting aye, the Mayor declared the motion carried and it was so arde~ed, An Ordinance of the City of Lynwood, California, regulating dance halls, dancing clubs and public dances in the City of Lynwood, was introduced and read for the first time. It was moved by Councilman Snyder and seconded by Councilman Lake that said Ordinance be accepted. as read the first time and pass to the second reading. "r Roll Call: Ayes: Councilmen Lake, Meyer, Snyder and Boster Noes: None Absent: Councilman Daetweiler An Ordinance of the City of Lynwood creating a iVater Depart- ment for said City and Establishing; water rates, and repealing Ordinance 125, 138, 150, 156, 162, 176, 119, 207, 221, 225, 230, 197 and 198, was introduced and read by title. Thereupon it was moved by Councilman Meyer and seconded by Councilman Lake that the further reading of said Ordinance be waived and that said Ordinance be accepted as read the first time and pass to the second reading. Roll Call: Ayes: Councilmen Lake, P~Zeyer, Snyder and Boster Noes: None Absent: Councilman Daetweiler It was moved by Councilman Snyder and seconded by Councilman Meyer that the City Attorney be instructed to draft an Agreement ~~Jaiving restrictions of violation in connection with liquors as affecting Lot 497, Tract 2551 and as requested by the Security-First National Bank of Los Angeles (Lynwood Branch). Roll Call: Ayes: Councilmen Lake, Meyer, Snyder and Boster Noes: None Absent: Councilman Daetweiler Judge S. A. ~'Vilson addressed the Council to the effect that he -- has received a letter from City Attorney Kennedy requesting a report regarding the Leal ease, protesting against the interference of the City Attorney in his Court, stating that he has always conducted a relentless war against drunk driving; alleging that City Attorney Kennedy has interfered in 6 other cases, stating farther that Mr. Leal was fined 35.00 and 10,00 was suspended and the balance was to be paid in installments, however, it developed that th® installments were not met and therefore the suspended amount did not apply, stating that Mr. Leal was booked on reckless driving and had been drinking, and that the only recourse Tarr. Leal had was to appeal to the Appellate Court, and that he believes that it is a dangerous precedent to establish to have ~•:)~. the Court responsible to any one regarding his decisions, also stating that T~~Trs. Leal did use abusive language in discussing the case with him. I~Ir. Leal. addressed the Council to the effect that he did not have sufficient money to meet an installment of his fine, however, he asked for more time until his next pay day and that he does not think that any additional fine should have been levied; also that Judge GJilson had made several depreciating remar'~s about him when in conversation with his wife. IMTayor Boster thereupon stated that shortly after the majority of the Council were elected he had an interview with Judge i~lilson and at that time he stated that any time the Council would request his resignation it would be forthcoming and it was agreed at the executive session of the Council last night that we would request the resignation of the Judge at this time, whereupon IrTayor Boster inquired of Judge rVilson if he wished to submit same at this time. T~o~aever, Judge 4~lilson declined to do so on account of circumstances that have arisen, however stating that the Council have the power to fire him at any time if they so desire. Thereupon it was moved by Councilman Snyder that the office of City Judge of the City of_ Lynwood be declared vacant, commenting that his decision is not because of any of the matters discussed at this meeting, which motion was duly seconded by Councilman T~Ieyer, and upon roll call showed the following result: Ayes: Councilmen Lake, T;Ieyer, Snyder and Boster Tdoes : Tdone - Absent: Councilman Daetweiler Thereupon it was moved by Councilman Snyder and seconded by Councilman Lake that TJIr. Howard Hemmenway be appointed City Judge of the City of Lynwood to fill the vacancy at a salary of p7~.00 per month. doll Call: Ayes: Councilmen Lake, I;~leyer, Snyder and.
