M. llda.yor Boater in the chair. Councilmen hake, Meyer, Daetweiler, Snyder and Boater answered the roll call. It was moved by Councilman Snyder and seconded by Councilman Meyer that the minutes of the previous regular meeting of February 19th, 1935 be approved as written. All members of the Council voting aye, the Mayor declared the motion duly carried. ,.--• WRITTEZJ COMI4NNICATIONS: .~ communicy ion was received from Mr. W. I. Humphrey, President of Lynwood Townsend Club requesting that the Council memoralize the Congress for enactment of the plan into law, stating that each day finis new recruits far. the plan from ranks of the best minds of the country. It was moved by Councilman Meyer and seconded by Councilman Snyder that the Council endorse the Townsend plan in principle: Roll Call: Ayes: Councilmen Lake, Myer, Daetweiler, Snyder and Boater. Noes: None. A communication was received from hos Angeles County Relief Administration, by Ralph B. Smith, Chief Engineer Work Division, thank- ing the Council far furnishing water for their community garden at Caress and Morton in the past and requesting that such service be ren- dered during the present growing season. Councilman hake reported that the committee consisting of Councilman Meyer, 'Engineer r3ateman and himself met and went into the matter of the application for water by the Unemployed Unit and finally agreed upon furnishing water for an increased sereag® of 5 acres, stating that they also considered this plot and he would recommend favorable action on their request, therefore, making a motion that the City of Lynwood furnish water to the hos Angeles County Relief Administration for their gardens located at Caress and Morton Rvad, and also for the gardens operated by the Unemployed Unit with said increased acreage of 5 acres, which was duly seconded by Councilman Snyder and upon roll call showed the following result: Ay®s: Councilmen Fake, Beyer, Daetweiler, Snyder and Buster. Noes: None. A eammunieat on was received from the ~'oeatianal Education of the Sts.~e of Arizona requesting that the City loan the services of Chief Dunlap for a two month's period beginning April 1st as they desire his service in Qonneotion with a State Program of Fireman Training. It was moved by Councilman Lake and seconded by Councilman Snyder that we grant the request and loan the service of Chief Dunlap t o mid 'institution, and that Chief Dunlap be. granted a leave of absence of 60 days wi thaut pay beginning April 1st, 1935, upon request for same. Roll Call: Ayes: Councilmen Take, bIgrysr, Daetweiler, Snyder and Buster. Noes: Nuns. A communication was received from the City Engineer of Tas Angeles, Tloyd Aldrich, requesting that the Council pass a resolution requesting Congress to inauguarate President~Hoosevelt's proposal of providing funds for a Works program in lieu of a dole. Mayor Buster stated that a Resolution has been sent to our Congressman and Senators urging Congress to Adopt a work program and a copy of the resolution was read, entitled as follows: "RFSOTUTION N0. 932, A RESOTUTION OF THB CITY COUNCIT OF THE CITY OF TYN'~'JOOD, CATIFORTdIA, APPROVING AND SUPPORTING PRESIDENT ROOSE- '~ VETT'S PROGRAM FOR WORg". It was moved by Councilman Snyder and seconded by Councilman BGeyer that we ratify the action already taken on said matter, and adopt said resolution, and upon roll call showed the following result: Ayes: Councilmen bake, Meyer, Snyder, Daetweiler and Buster. Noes: None. A communication was received from Mayor Rossi of San Francisco with resolution adopted by the City and County of San Francisco requesting the State hegislature to approve Senate }3i11 N~. 17 which when and if en- seted would provide for municipal ownership of the waterfront of San Francisco, which is now owned by the State of California. There being na objection, the Mayor referred the matter to the City Attorney far study. A communication was received from the League of California Municipalities stating that the budget of Governor Merriam calls far an ~~V increase from 3% to 6jo on the tax on State Motor Transportation and that the city and county personal property tax be eliminated, or it is recom- mended that to eliminate personal property taxes on motor vehicles and levy fees in lieu thereof for state purposes based on weight and value, stating that the Zeague are opposed to such legislation, and if the City is,to so notify the Assemblyman and senator. `t'hereupon it was moved by Councilman Meyer and seconded by Councilman Take that the City Attorney be instructed to draft a resolution opposing such Legislation on the part of the State and send copies of same to our Assemblyman and senator. A communication was received from the Zeague of California Muni- ~"" eipalities reporting on pending legislation in Con gress and present status of S:~RA activities. `T'here being no objection, the I~iayor ordered same filed. A Petition was received from Realtors in Lynwood, requesting that their license fee be reduced from X12,00 to X6.00 as they fee, that they are being discriminated against and that the increase from X1.00 per year to X12,00 per year vacs excessive. 't'here being no objection, the Mayor ordered the matter tabled to next meeting of the Council. A communisation was received from Chief of Police Miller re- questing that certain parking, loading zone and no parking zones b® es- tablished, giving a list of locations. It was moved by Councilman Daetweiler and seconded by Councilman Snyder that the City Attorney be instructed to draft Sri Ordinance incorporating the locations recommended, and that the City Engineer be instructed to furnish legal description ai' name for said Grdinance and have the painting done after the ordinance become effective, and upon roll call showed the follocaing result: Ayes: Councilmen bake, Meyer, Daetrreiler, Snyder and Boster~ Noes: None The audit report compiled. by houis H. Dec'~-er, C, P, A. was presented and read, covering the period from October 1st, 1934 to Dec- ember 31st, 1934. There being no objection, the Mayor ordered same filed. Report of activities of the City Court, Police Department, Fire Department for the month of February; also health reports were re- ,...~, eeived, and there being no objection the Mayor ordered same filed. ORAZ COA~tIUNICATI ONS ; Mr, G i and spoke on the service given by the N. R. S. Regis- trar, stating that in all of his dealing as far as he has detected, Mr. O'Shaughnessy has been treating everybody fair and no politics has been tolerated, and no petitions have been permitted in the office when he has been there. Mr. C. R. Creed also spoke on the same subject matter, stating that he believes that the City has the right man for the right job in that of Mr. O'Shaughnessy, as he shows no favoritism to any one. Mr. Ezzel also spoke on the matter in favor of Mr. O'Shaugh- nessy. Mayor Buster also spoke on the matter of the 1 etter that was contained in the Zynwood Press signed by one G. 0. Peyton, reading a report from Mr. O'Bhaughnessy on the case of Mr. Peyton to the effect that Mr. Peyton had been given several opportunities to work, but offered excuses when the opportunity afforded itself, stating that he does not believe that I~r. Peyton wrote the article as he said he did not and that some man had given it to him to sign, Mr. O'Shaughnessy con- tending that no political issue of any kind has been tolerated in his office and that whether or not they signed the recall petitions against Buster and Lake does not enter into the picture in employing men on the school jobs, giving a list of those who are now working who did sign same in support of his contention. --~ Thereupon Mayor Bolter submitted a subpoena for Gorham 0. Peyton to appear before the Council to give testimony relative to said matter. Thereupon it was moved by Councilman Meyer and s©conded by Councilman bake that Mr. Peyton be brought before this Council for a hearing on said matter and that the Mayor be authorized to execute said Subpoena to insure his appearance, and upon roll call showed the follow- ing result: AY.~5: Councilmen hake, Meyer and Bolter. NOBS: Councilmen Daetweiler and Snyder. Mr. Peyton did not appear and testify, and no further action was taken by the Council on the matter. 2'~ REPORT Or SPECIAL COR~'MITTEFS: .~ writ en report was received from Engineer Bateman reporting on the east of resurfacing Esther Street, setting the amount at approxi- mately 375.00 for a light type of resurfacing; also reporting that Virginia Ave., is also in bad condition and would cost approximately 270.00 to surface with a like construction, recommending that the work be done and the labor be furnished from delinquent water accounts. Thereupon it was moved by Councilman Meyer and secon~.ed by Councilman Daetweiler that we accept the recommendation of Engineer Bateman and do the work as outlined in his letter. Roll Call: Ayes: Councilmen Fake, Meyer, Daetweiler, Snyder and Boster. Noes: None. Street Commissioner Meyer reported on the matter of the fence complaint at the Beachwood Court, stating that he found that there has been some damage done to the fence on account of the alley improvement, therefore recommending that the City fix same as the expenditure in- volved would be very nominal. Thereupon it was moved by Councilman Snyder and seconded by Councilman Daetweiler that the City Engineer be instructed to have the fence repaired so that it will meet with the approval of the prope~t? owner. .All members of the Council 4oting ay®, the Mayor declared the motion duly carried. and it was so @rdered. UNFINISHED BUSINESS: Ordinance o,. 4, entitled: "An ORDINANCE OF THE CITY OF LYN~i~OC1Z RELATING TQ JUDGT~iENTS OF THE CITY COURT OF THE CITY OF LYNWOOD", by providing for installment payments of fines assessed by the Court, was read for the second time, It was moved by Councilman Snyder and seconded by Councilman bake that said Ordinanc® No. 254 be adopted,. finally pass and b® published as required by law. Roll Call: Ayes: Councilmen Lake, Mayer, Daetweiler, Snyder and Boster. Noes: None. NE~i BUSINESS: RED ION~I 933, Authorizing City Treasurer to cancel csheog issued to-one C. M. Bartelt in the amount of 2.00 and issue new check to water department for said sum to apply on delinquent water bill of said Bartelt, was read. It was moved by Councilman Snyder and seconded by Councilman Lake that said Resolution No. 933. be adopted. Roll Call: A;~es: Councilmen Lake, Meyer, Daetweiler, Snyder and Boster. Noes: 'None.. The Mayor read a memorandum relative to Recreation, stating in part that the Rearea~3~on Division of the SERA is desirous that the City do something toward furnishing recreation facilities, suggesting that the old baseball diamond be rec®nditioned; that facilities for horse shoe . pitching and croquet be provided in the circles of the parkway; and that in the southern part of the City near the boulevard, space be obtained for a horse shoe pitching eeurt and a croquet court be established, o~hieh wouhd mean a outlay for the City in the amount of 150.00 in the way of fixing up ground, and would consist mainly in labor, supervision to be furnished by the SERA. Mr. Everett also addressed the Council on the matter, stating that approximately 10 men could be provided work by such a project. After due consideration, it was moved by Councilman Snyder and seconded by Councilman bake that the City appropriate 150,00 toward such a project to be paid primarily by labor from delinquent water users, and that the City Engineer be instructed to prepare the ground for the fnr- therance of same. Submitted another memorandum relative to on the Boulevard, stating that the City Attorney has contacted the owners and two have replied and will. take necessary steps to take care of the matter in a satisfactory manned, which will leave two in bad contition and they have also been notified to ,correct the matter or the City will proceed to enforce the correctiorr~. A communication was received from Southern California Business M®a's Association requesting the council to urg® the adoption of mate Bill No. 536, which would increase the revenue from the tax on alooholiQ ~9 beverages to Cities, from 60J of what remains after ablleotion and ad- ministration costs are deducted to 50~ gross receipts. There being no objection same was referre d to the City Attorney for study. A communication was received from J. L. Pomeroy, L. A. County Health Officer urging the Council to support Assembly Bill 1~0. 542 and to so notify your Senator and Assemblyman, which if enacted would pro- vide for free service of health regulations and enforcements by the County, excepting for the enforcement of local ordinances. It was moved by Snyder and seconded b;;r Councilman Daetweiler that the City Attorney be instructed to draft a resolution and send copies of same to our State Senator and Assemblyman fa voring thr adoption of said bill and urging them to support same. ,All members voting aye, the Mayor declared the motion duly carried.
