HomeMy Public PortalAbout13.5) Presentation, ADU Ordinance (CDD1)Accessory Dwelling Unit OrdinanceCitywide City Council of Temple City October 20, 2020 BACKGROUND •State Laws (AB 68 AB 881, etc.) to further limit cities’ capacity to regulate ADUs •February 18, 2020 City Council: Adopts urgency ordinance mirroring state mandates Directs staff to bring back a code amendment addressing water, sewer, fire safety, & design issues AB 68 AB 671 AB 69 AB 881 AB 670SB 13 2 BACKGROUND •May 12, 2020 –Planning Commission’s 1st review of the proposed Ordinance •June 30, 2020 –California Housing and Community Development Department (HCD) contacts staff and comments on the ordinance •September 8, 2020 –Planning Commission’s 2nd review of the proposed Ordinance. Planning Commission expresses concerns about the removal of fire safety measures and the reduced side and rear yard setbacks 3 REVISIONS BASED ON HCD COMMENTS Provisions removed: •An ADU must be within 150’ of a 20’ wide road •A fire flow test required •Two-bedroom maximum for an ADU •A minimum side yard of five feet for a JADU REVISIONS BASED ON HCD COMMENTS Revise to note design standards are not required if infeasible Infeasible means implementing it will physically prohibit the creation of an ADU or JADU NEWLY PROPOSED DESIGN STANDARDS Staff has reviewed +150 ADU applications Recommends the following new design standards: A bedroom in an ADU must not have an exterior door An ADU must not have more than one common area (defined as a living room, family room, or study) All bedrooms must be physically accessible to all occupants An ADU must not have more than one kitchen ANALYSIS Proposed ordinance includes HCD’s input Staff does not recommend prohibiting ADUs based on water and sewer infrastructure Ordinance will be subject to HCD review If City refuses to meet HCD standards, the Attorney General can be notified RECOMMENDATION The City Council is requested to: 1.Introduce for first reading by title only and waive further reading of Ordinance No.20-1048 (Attachment “A”), amending Title 9,Chapter 1 ,Article T of the Temple City Municipal Code regarding the development standards for ADUs and JADUs. 2.Schedule the second reading of Ordinance No.20-1048 for November 4,2020 meeting. 8 Accessory Dwelling Unit OrdinanceCitywide Temple City City Council October 20, 2020 10 STATE LAWS-ADUS AND JADUS MUST: Allow ADUs in all residential and mixed -use zones Allow 800 s.f.ADU regardless of lot coverage, FAR, etc. Allow 1,000 s.f.ADU for more than one bedroom Allow 500 s.f.JADU in existing house Allow legal nonconforming conditions Allow non-discretionary review that does not exceed 60 days STATE LAWS-ADUS AND JADUS (CONT.)
