Background
•July 2019: SGVMVCD recommended regionwide ordinance for swimming pool maintenance.
•October 2019: SGVCOG Governing Board adopted Resolution encouraging cities to adopt ordinance.

Purpose of the Ordinance
•Mosquitos spread West Nile and Zika viruses.
•Primary source is stagnant water.
•Current regulations vary from city to city.
•Need a unified, cohesive, and collaborative approach to Vector Control.

•Occupied:present credentials,request entry,explainreasonforinspection.
•Unoccupied:attempt to reach property owner.
•Request denied:secure inspection warrant.
•Imminent hazard:right to immediate entry.

•Filled Pool:pool will be filtered/treated so waterremainsclear/circulating.
•Empty Pool:pool will be fully drained/dry.
•Responsible Party :owner will be deemedresponsibleformaintenanceofpool.

•Unlawful to have unmaintained pool on one’sproperty.
•Unmaintained pool a public nuisance.
•City may issue administrative citation to propertyowner.

•Template ordinance contains different fine schedule.
•Staff recommends keeping existing schedule:
•$100,second offence
•$200,second offence
•$500,third offence

Recommendation
Introduce for first reading by title only and waive further reading of Ordinance No. 20-1049, Pool Maintenance Ordinance for the Reduction of Mosquito Breeding; and
Schedule the second reading of Ordinance No. 20-1047 for November 3, 2020.
