City Council of the._City of Lynwood met in a regular session, at the City Hall, 11331 Plaza Street, on above dc,te, at 7:30 P.Iui. In the absence of the mayor, the meeting was called to order by the City Glerk who called the roll showing the following present. Councilmen Lake, Meyer, Daetweiler and Snyder. Mayor Boster was absent . Councilman Lake addressed the Council to the eff ,ect that far some time the Cou_~cil have been sitting ~rithout a City Attorney and that there are matters that are coming up which will require some legal opinion: forinstance the matter of the disincorporation petitions and various other matters, therefore, it is necessary that we get busy on_the matter of appointment of a City Attorney, ~::.nd as it has been the policy of the Council to give preference to local talent when available, they hwve decided on NIr. Boardman who has been a resident of Lynwood and taxpayer for the last past 8 years, therefore, making a motion that t~ir. Horner Td. Boardman be appointed City Attorney of the City of Lynwood at the salary of X75.00 per month, which r:rotion was duly seconded by Councilrr~an Daet- weiler and upon roll call showed the following result: Ayes: Councilmen Lake, ~eyer,.Daetweiler and Snyder. Noes: None. Absent : Mayor Bos to r. Thereupon Mayor pro tem Snyder requested Attorney Boardman to come forward, whereupon the City Clerk administered the constitutional oath of office and Tvir. Roberts informing that the insurance policy covering City Treasurer and City against loss by robuery in the amount of ;1,000.04 expired on June 1st, 1935, request- ing the renewal of same. Thereupon it was moved by Councilman ~~yer and seconded by Cou~icilman Daetweiler that said policy be renewed with Itiir. ~toberts, the premium being 35.00 for coverage l'or one year. Roll Call: Ayes: Cou~zcilrren L~~ke, ~:eyer, .Oaet~~eiler and Snyder. Noes: None. Absent: ~rayor Boster. A cornmunic~,tion was received from the University of Southern California offering transferable rnernbership books for a short course in administration covering all types of goverrunental services running five days, from June 10 to 14, inclusive, for p~5.00, and individual, non- transferable remberships for employees earning ~~00.00 per month or less, at :5.00. Thereupon it was moved by Councilr.~an Lake and seconded by Councilman Meyer tTiat we appropriate X35.00 for a transferable membership and two non-transferable memberships, and the City Clerk see that the transferable membership tickets are used e~.ch day by some official or employee. troll Call: Ayes: Councilmen Lake, It,eyer, Daetweiler and Snyder. Rutter requesting a leave of absence from his duty as Foreman of the `;~Jater Department for three months, as he contemplates the purchase of lvir. Thomas %~alone's reed Store Business. A communication was also received froth Water Superintendent Bateman recor.~tmending the granting of such leave, stating that he has ap- pointed iuir. R. F. Rodwell vrho was for•tnerly emp~.oyed in the udater Depart- ment as helper, suQject to the ratification of the City Council; also re- commending that lair. H. J. Grace be given a trial as foreman of` the ~~Jater Department. Thereupon it was moved by Councilman Lake and seconded by Coun- .- cilrnan Daetweiler that the recommendations and appointments of adater Super- intendent Bateman be ratified by the City Council and that litir. nutter be granted his leave of absence for three months; that fir. Rodwell be employ- ed as helper in the Ydater Department and lair. Grace be appointed temporary as foreman of the Vdater Department. Roll Call: Ayes: Councilmen Lake, Meyer, Daetweiler and Snyder. A cor~~rnunication was received from the Division of Highways of the State of California with statement attached showing the amount of-the 1/4 cent gas tax allocation apportioned to the City, based on revenue re- ceived for the current biersxium ending June 30th, 1935, showing that in addition to work which has been approved and work orders issued, there re- mains an unobligated balance in the amount of X884.20, which is available for undertaking new work. There being no objection, the luiayor pro tem re- ferred the matter to the City Engineer for preparation of projects that can be financed out of said unused money. A cor_tmunication was received from dir. Earl St. Clair offering to decorate the light standards for play day to be held on June 22nd, 1935, at X1.00 per pole. After due deliberation, it was moved by Coun- cilman Lake and seconded by Councilman Daetweiler that the City purchase enough bunting to decorate 9 lighting standards, carne to cost :81.00 and ,,.,.,, to include holders for such decorations. Roll Call: Ayes: Councilmen Lake, ~~ieyer, Daetweiler and Sn~rder. Noes: None. Absent : Mayor Boster. A petition was received signed by 31 business and professional people of Lynwood endorsing the proposed band for the dotmtown section of our City, if the City will install a band shell and equip the band with uniforms; also a petition was received signed by 58 Members of the United Liberals, stating that they would be heartily in accord with an action on the City's part to support the Lyn;krood recreation and Playground Dep~.rt- ment with an appropriation for uniforr.~s for their Playground b~>,nd. Consideraole discussion ensued about the matter; also about a proposed carnival that the American Legio~i has contemplated, o~xe-half of which proceeds would go to the Legion and the other h~~lf could be given to the Recreation and Playground Department to help pay for uniforms for the band. Iur.R. Y. O'Shaugruxessy addressed the Council on the carnival, and ~r. F. IvT. Everett addressed the Council requesting tlzat the Council insure payment of the uniforms as they are anxious to procure uniforms for their Play Day to be held on June 22nd, and then any proceeds re- ceived from the carnival ~Jrhen and if held carp be used to apply on the cost of same. i:iayor pro tem Snyder addressed the Council on the matter com- --R plimenting the band on their first appearance, requesting an opinion from the City Attorney as to vrhether or not the Council are permitted by law to appropriate money for such purpose. City Attorney BoarcLtan ruled that as long as it would be bens- fiting the Citizens of.Lynwood at large, it was his opinion that such ex- penditure ~rould be legal. After due deliberation on the matter, Biayor pro ter,1 Snyder ap- pointed Councilman Lake as a cotamittee of one to work with lUr. ~didoe to check up on the cost of uniforms ~.~nd to report back his findings to the Council at an early date. After further consider:-.t ion of the City Council about purchas- ing bunting to decorate the ornamental li; htirxg standards for Play :Jay, and it being determined that it may be more ad~-isable to expend such money for other purposes, it was duly mo ~ ed by Cou~c ~. lman Lake and se- conded by Councilman Daetweiler that ~~~e recind said action to purchase ~~c ~81.U0 worth of bunting for 9 poles, and that to rent such bunting from i~r. A communication was received from i~r. R. Y. O'Shaugnessy, inviting the Council to attend a dinner and party to be given by the Lynwood Post of the American Legion in honor of the American Legion Post from Bell on next Thursday evening, June 6th, dinl~er to be ser- ved at 7:30. No action was taken, but all who can were requested to attend. A COmL1unlCatloil was received from the `v~~oodrow Wilson P.T.A. requesting permit to operate a concession on Friday June 21st, at the northeast corner of School and Josephine Streets; also for Saturday, June 22nd, on the west side of Long Beach Boulevard in the center of the block between Sanborn and iu[ulford Streets. This was laid over until later in the meeting as the Attorney was to check up on the or- dinance regulating licenses. A corlrnunication was received from hlr. A. C. Dreher, request- ing an opportunity to service the City of Lynwood ~~rith Firestone T~:res and Tubes,having opened an establishment at 3366 Imperial Highway. There being no objection, the comr:~unication was ordered filed and it was suggested that he be called upon to bid on tires when opportuni- ties afford itself and when in need of same. An ap.lication was received from ar. Toe Godson applying for a job on the `Aiater Department: also reports from N. R. James addressed the Council requesting permit to construct a platform and seats just across from the City Hall on Plaza Street, south of Lynwood Transfer and iu~,terial building, also to hold a parade in the City on June 22nd, in connection with such Play Day. I~r. James was informed that the property across from the City Hall does not belong to the City and therefore it will. be nec- essary for them to obtain a permit fror~~ the owner of the property, rlowever, it was duly moved by Councilman Meyer and seconded by Co~an- cilrran Daetweiler that the Chief of Police be authorized to grant a permit to stage a parade in the City of Lynwood on the Streets of said City on Play Day to be held on June 22nd, 1935. Roll Call: Ayes: Courlcilnren Lake, Meyer, Daetweiler and Snyder. Noes: None. Absent: Mayor Boster. At this time City Attorney Boardman ruled on the matter of request for permit to operate a concession on June 21st, and 22nd, by the P. T. A. of tii~oodrow Nilson school, stating that Section 7 of Ord- inance 241 pertaining to licenses provides that as to rate of license it shall not apply to churches, religious societies, fraternal socie- ties or charitable societies of the City of Lynwood ~.,nd it the Parent Teacher's Association come under any such-head they would be exempt fror.~ paying a license. After due consideration it was determined that they would be considered as a charitable organization, therefore it was moved by Councilman Daetweiler that,the License Collector be auth- orized to issue a license eratus to said organization to conduct the concessions at the locations described in their comrlunications, which was duly seconded by Councilr.~an Lake and upon roll call showed the following result'; Ayes: Councilr~~en Lake, Beyer, Daetweiler and Snyder. It was moved by Councilman Lake a.nd seconded by Councilman B~.eyer that the City Clerk be directed to cooperate with the Fire Dep- artment in sending out cards to all vacant lot owners who have not al- ready cleaned their Lots of week to do so, or the City will be com- e gelled to do so and charge them for the expense involved. A comrrunieation was received from Engineer Bateman stating 2~~~ that he believes it would 'pe advisable to construct a "Not a Through Street" ax~xd "Truckin<.~ Prohibited" signs at the end of Esther Street; also a "I~To Dumping"notice Thereupon it was moved by Councilman iuleyer and seconded by Council~~an Lake that the City Engineer be instructed to have-suitable signs constructed at Esther Street as outlined in his letter. poll Call: Ayes: Councilmen Lake, it~eyer, Daetweiler and anyder. Noes: None Absent: Mayor Boster. Engineer Bateman also reported on the matter of the request for sanitary sewers far the Lyntivood Brewery Company, stating th~~t if Tvlr. Sum- mers is willing to advance 100jo of the material ex gense it will be proper for the City to charge other property owners along the line desiring ser- vice at some future time a large enough permit fee fora co~uzection charge to defray their share of t he material expense which sums could be remitted as collected to 1yir. Summers. There being no objection, Engineer Bateman was instructed to contact ivir. Summers to ascertain whether or not he would be willing to proceed under such an arrangement, after which SEi~A labor could be obtained to help defray the expense involved. Iuiayor pro tem Snyder announced that news has been received that Mayor Boster's father-in-law has passed away, suggesting a letter of con- dolence be sent. Thereupon it was moved by Councilman Lake. and seconded by eoul~- cilr~~an Daetweiler that the City Clerk be instructed to send a letter of sympathy to Mayor and i~~irs, Boster on behalf of the City Council. A com~lunication was received from Chief of Police _~riller request- ing the Council's desire in cor~~leetion with the provisions of Ordinance No. 229 with respect to vacations for officers, stating that same calls for fifteen d~~ys vacation ~.nrrually with pay. Thereupon it was moved by Councilman Beyer and seconded by Cou~~cilrnari Lake that the Council authar- ize vac~s.tions as specified in said ordinance, and that the Chief of Police be authorized to employ a relief Irian at a salary of X100.00 ger• month to take a regular shift. City Attorney Boardman was irstructed to subr.~it his written op- inion on the r.~atter of the supplement petitions that have been filed, which said petitions request the Cauneil to call a special election to ascertain whether or not the City of LynYrood shall disincorporate, and to give a ruling as to the status of the proceedings and if supplemental petitions are permitted by law.
