The City Council of the City of Lynwood met in are ular session, at the City Hall, 11331 Plaza ~trPPt, on above date, at 7:30 ~. M. In the absence rf tie ~~~?rnr, the meeting was called to tender by the City clerk and anon ro7~ calf sho~ve~ the following present. Councilmen Lake, Daetweiler and Snyder. Councilman Boster and Meyer were absent. It was moved by Councilman Lake and seconded ny Councilman Daetweiler that Councilman Shyder act as temporary Chairman and Mayor pro tem. Roll Call: byes: Councilmen Lake, Daetweiler and Snyder. Noes: None. Absent: Councilmen Loster and Meyer. ,,,~,_ It was moved by Councilman Lake and seconded by Councilman Daet- weiler that the minutes of the previous ad3ourned regazlar meeting of June 28th, 1935 be approved as written. Roll Call Ayes: Councilmen Lake, Daetweiler and Snyder. Noes: None. Absent: Councilman Boster ~ d Meyer. WRITTEN COMMUNICATIONS: communication was received from the Southern California Edi- son Co. offering to enter into a two year agreement which will provide that in the event the total bills for ornamental lighting in either year shall exceed the base year bill, the excess amount will be discoun- ted 50~, however, no discount will be allowed until the total amount paid in during either year equals the base year bill. A communication was also received from Engineer Bateman on the matter to the effect that while it is doubtful the City desires to take advantage of this offer for the etxrrent .fiscal year, however, it is re- commended that the agreement be accented and the City Clerk be instruc- ted to file acceptance wj.tr the Edison Comnanv as there is a possibility that the City map desire to take advantage of. the offer some time prior to the expiration of same, and if acceptance is not filed prior to Aug- ust 11st, 1935, the offer is revoked. _ At this time Mayor Boster arrived :and took his seat at the Council table. It aas moved by Councilman Lake and seconded by Councilman Daetweiler that this matter be laid over for further investigation and to be considered again at the next meeting of the Council. All members of the Council voting aye, the Mayor declared the motion duly carried. A communication was received from Mr. S. A. Kahle requesting use of Council Chamber for a meeting of the Boy Scout Committee to be held on July 8th, 1935, at 7:30 P. M. It was moved by Councilman Sny- der and sdconded by Councilman Lake that permission be granted to use the City Rall on said date and that the City Clerk be instructed to so notify Mr. Kahle. All members of the Council voting aye, the Mayor de- cla.red the motion duly carried. A communication was received from the District Council of Carpenters announcing their rate of peg and hours for their tradesmen, requesting the Council to adjust their wage scales and working condi- tions to conform with same. There being no ob3ection, the communication was ordered filed. A communication was received from,Mr. Homer C. Fulton request- ing that Agnes Avenue, Prom Long Beach Boulevard to School Street, set- ting the curb. back to the sidew~a.lk line and widening the street on each side. There being no ob3eetion, the Mayor referred the matter to En- gineer Bateman with the suggestion that he include it in an SERA pro- ~ect, if it is possible to do so at a future date. ORAL COMMUNICATIONS: s r salt addressed the Council regarding trans- portation for workers on the tax survey, stating that heretofore, fir. Reed and himself worked out a plan and arrangment so that one of the workers would dirve his car up to the Hall of Justice each day and take other workers with him andas ~n allowance for such service the City have allowed the driver 50 ~ per day, however, stating that such an arrangment is impracitical because the woerkers work different hours, some getting more hours than other, etc., therefore, it is hard to adjust it properly so that many can avail themselves with such transportation, therefore suggesting that the City allow each worker .the price of transportation from Linwood to the all of Justice, which would be 40~ per person on the Pacific Electric Railroad. ~Q~ Thereupon it was moved by Councilman Snider and seconded bT Councilman Daetweiler that the Cite allow each worker on project ~-S-F- 4-1159 a maximum of 40d nor ~av for transportation to Los, Angeles, and those wl~o live where other t ansnortation can be had at lower rate, the actual cost be allowed. Roll Call:" Ares: Councilmen Lake, Daetweiler, Snider and Roster. Noes: None. Absent: Councilman bTeyer. Mr. K. G. Tracy addressed the Council requesting that the Coun- cil do something about the removal of the vacant building at Las Flores Blvd. and California 5t., as it is a nuisance and as the children plaT in and around the house it is a hazard as they maT get hurt; also that it is a harbor for tramps. A petition was also received signed bT 38 residents in the immediate vicinit,T where the abandoned house is located, petitioning the Council to do something about having same removed, alleging that it is a great menace to the families in that neighborhood, fire trap, harboring place for tramps, and therefore should be taken care of. There being no objection, the Mayor instructed the Building In- spector to contact City Attorney Boardman to ascertain what the legal sta- tus is regarding having same removed, assuring the petitioners and those present that the City will do everything in their power to have the Nuis- ance abated. UNFINISHED BUSINESS: communication was received Prom City Attorney Boardman ruling on the matter of having the earthquake damaged buildings yet unrepaired or removed demolished, stating that unless same comes within the definition provided by Section 3479 of the Civil Code as to what constitutes nuisances it is difficult to have said building demolished, suggesting the only safe and proper way to proceed is to file an action for the purpose of having such buildings declared nuisances end obtain an order of Court for their complete d.emolisrment and removal as provided by Section 731 of the Code of Civil Procedure, recommending that Building Inspector be instructed to advise the property owners in questionby registered mail to the effect that. suchbuildings are public nuisances in fact and should be abated, and upon failure of the owners so to do, actions will be instituted in the superior court for such purpose. There being no objection, the Mayor instructed the wilding Inspector to so notify the property owners involved. At this time Councilman Daetweiler requested to be excused, which was granted, whereupon he vacated his seat at the C©uncil table. A communication was received from City Attorney Boardman ruling on the matter of request of Southern Calif©rnia Telephone Company for a right of way or easement upon certain proper°ty within the City of Lynwood now held by the City, ruling that in his opinion the law simply means that you cannot give away property or rights in property belonging to the City, therefore, recommending that the City do not execute a deed for said ease manta to the Telephone Compang without some substantial, present considera- tion. There being no objection, the Mayor instructed the City Clerk to communicate with neighboring Cities to ascertain what service or remunera- tion they are receiving from the Southern California Telephone C©mpany for use of easement in their respective City. A communication was received from License Collector Collins re- porting on the matter of request of certain building contractors for a re- duced license for roofers, stating that he has collected 6 licenses from out of town concerns since the ordinance of 50.00 per year went into ef- fect, and one local contractor has a license to do roofing, however, stat- ing that he did not care to make any recommendation with respect to amending the license ordinance. It was determined that some of the buiIlders were under a misapprehension and ~~rere of the opinion that separate licence was required to do roo~'ing when they have a general contract to construct a building, which 3s not the case inthe event they perform the work themselves and do not hire another parson to do the roofing, therefore, it was duly moved by Councilman Snyder and seconded by Councilman Lake that the petition be filed and no further action be taken on the matter. A communication was received from License Collector Collins re- porting on the matter of license fee paid by fortune tellers, stating that the amount now paid works a hardship on the licensee, suggesting 25.00 per month license, payable quarterly, which may result in more applications being received however, that same can be controlled as same must be passed on by the City Council. Thereupon it was moved by Councilman Snyder and seconded by Councilman Lake that the City Attorney be instructed to amend the license ordinance to provide for a license fee for fortune telling and kindred arts, at300.00 per year, payable quarterly in advance. Absent: Councilmen Meyer and Daetweiler. ~~ ~~ ~~ A communication was received from Water Superintendent Bateman reporting on the request by certain petitioners to be served with water, said petitioners residing on Century Boulevard east of Mariposa Lane, stating that the material expenditure would be approximately 300.00, and as the net yield from the services in question makes a proper return on the capital investment, he recommends that these lines be included in the L. A. C. RrA, application for water works improvement now under preparation by his office. Thereupon it was moved by Councilman Lake and seconded by Councilman Snyder that the recommendations of Water Superintendent Bateman be accepted and that he be authorized to include said lines i-n his applica- tion to LACRA covering a water works project. Councilman Lake addressed the Council on the matter of acquir- ing the water sgstem now owned by a M.r. Ca.ress coveri.na some services in the City of T:vnwood and some outside the Citq limits, stating that the City is now furnishing water to Mr. Caress at the man through a meter, however, that Mr. Caress cannot carry on much longer as he agreed to furnish water when he-sold the lots and he is unable to collect any money therefor because he has never formed a company, Councilman Ls~ke stating that he believes that in time it will become an asset to the City. There being. no objec- tion, the Mayor referred the matter to the Chairman of the Water Committee and the Water Superintendent for further study, as to whether it would be necessary to furnish meters, or if they are already installed, etc., and to report at the next meeting, if possible his findings. A communication was received from Engineer Bateman reporting on the petition from property Hers on Euclid Avenue to have the lights discontinued on said street in order to be relieved from the lighting as- sessment, stating that said petition is signed by 58~ of improved proper- ty, therefore, recommending that the lamps be discontinued and the pro- perty affected thereby be stricken from the lighting assessment rolls for the f iseal year 1935-36. There being no objection, the matter was laid over until the next meeting, being the date set for hearing of protests on the lighting for the ensuing year. A communication was received from Engineer Bateman reporting on the cost of repairing Cedar Avenue, between State St. and Peach St., ,,,,.~, stating that the cost of material would be 240.00 for a light type of resurfacing, suggesting that the project might be included in those streets for which aid has been requested from the Board of Supervisors, as the street is now being cleaned and graded, which will improve condi- tions temporarily. There being no orieetion, the Mayor ordered .the pe- tition and letter filed. w~t.th tre instruction that same be included in Streets to be repaired through SERA labor and gasoline tax allocation for materials. An Ordinance of the City of Lynwood regulating the Parking of Motor Vehicles and Establishing 15-minute "Parking Zones" and "No Park- ing Zones" on certain streets in said City of Lynwood, was introduced and read for the first time by caption. `thereupon it was moved by Councilman Lake and seconded by councilman ~'nyder that same be accepted as read for the first time and pass to the second reading. A communication was received from the City Clerk certifying that the persons who signed that certain petition requesting the Council to call an election to determine v~h ether or not the City shall disineorporate fi- led in his office on May ?th, 1935, was signed by an insufficient number to call such election,as required by law. Thereupon it was moved by Coun- oilman Lake and seconded b~T Councilman Snyder that such petition of May 7th, ,.,~ 1935 be denied for lack of sufficient subscribers. All members of the Coon- , eil present voting aye, the Mayor declared the motion duly carried and it was so ordered. A similiar communication was received from the City Clerk on the petition on the matter of Disincorporation filed in his office on May 9th, 1935, certifying that said petition also is signed by an insufficient num- ber to call a Special Election as required by law. All members of the Council t~resent votj ng aqe, tl^e A~a.vor declared the motion duly car- ried and it was so order. ed. r b~avor 'foster ad!~reGSed the Co~zncil on the matter of the petiti~n~~~ signeed ry merchants requesting that the Ordinance on !and bills be amended was brought up for consideration of the Citizens Committee' and it was de- cided to check up on the license charged by neighboring Cities and then the Council could adopt an ordinance in line therewith, so the information procurred from South Gate was that they charge X3.00 per quarter for dis- tribution of advertising matter with exemption for persons who pay a regu- lar business license,•and Comgton have no charge at the present time, there- fore, the matter of amending the Citgfs license ordinance on said subject matter was tabled until it is found what and that other neighboring Cities have increased their rate. .
