HomeMy Public PortalAbout09.5) Presentation_Swimming Pool MaintenanceOrdinance 20-1049:Pool Maintenance for the Reduction of Mosquito Breeding City Council Meeting November 4, 2020 1 Swimming Pool Maintenance & Mosquito Breeding •October 20 –City Council requests staff to return with information about the: Partnership between the City and the San Gabriel Valley Mosquito and Vector Control District Proposed citation amounts 2 Swimming Pool Maintenance & Mosquito Breeding •Partnership: SGVMVCD cannot write citations, only abate problem pools Abatement takes months Abatement is costly SGVMVCD will find unmaintained swimming pools & notify owners City would assist, using citation authority with unresponsive owners If citations do not work, SGVMVCD would obtain a warrant to abate the issue 3 Swimming Pool Maintenance & Mosquito Breeding Citation Options •SGVMVCD supportive of any citation amounts the City Council deems effective 4 SGVMVCD’s Proposal Existing Citation Amounts Hybrid Approach First Citation $500 $100 $100 Second Citation $1,000 $300 $500 Third Citation $1,500 $500 $1,000 Swimming Pool Maintenance & Mosquito Breeding •Staff recommends the existing citation amounts Effective in the past Only 1.15% of code enforcement cases require a citation 80% of cases with a 1st citation do not require a 2nd citation Staff has not written a 3rd citation all year If issue is not corrected after 3rd citation, staff can write a citation everyday until the issue is corrected 5 Swimming Pool Maintenance & Mosquito Breeding •Fines more than $1,000: Must be classified as a misdemeanor, not an infraction Require additional recitals in an ordinance Appeal rights should be clarified, as well 6 Swimming Pool Maintenance & Mosquito Breeding •If the City Council wants to adopt SGVMVCD’s proposal Return with a revised fee and fine schedule Return with a revised ordinance First reading of the ordinance will occur on November 18 •If the City Council wants to adopt the hybrid approach Changes can be read into the record tonight Return at second reading with a revised fee and fine schedule 7 Recommendation: 1.Introduce for first reading by title only and waive further reading of Ordinance No. 20 -1049 (Attachment “A”), Pool Maintenance for Vector Control; and 2.Schedule the second reading of Ordinance No. 20 - 1049 for November 17, 2020. 8
