M. Mayor Boater in the chair. Councilman Lake, Meyer, Snyder and Boater answered the roll call. Councilman Daetweiler was absent. It was moved by Council Snyder and seconded by Councilmen Meyer that the minutes of the previous regular meeting of September 17th, 1935, be approved as written. All members of the Council present voting ape, the Mayor declared the motion duly carried. WRTT`E'~Q~TUNICATION A co~-unication was received from Drir. E. J. Mykrantz of Romona, regarding distribution of gasoline tax funds. There being no objection , the mayor ordered same filed. A communication was received from the Works ProgrQSS Adminis- trationtlto the effect that application have been prepared and forwarded tp their office in the hope that they will be permitted to furnish arose- ing Guards to the various communities using physically handicapped indi- victuals, and if approved they will be happy to make the necessary arrang- ements for the service requested. There being no objection, the communi- Cation was ordered filed. A communication was received from Chief of Police Dull er seek- ing the Council's wish with regard to transferring the old Chevco]~st car in the Police Department to some other Department as the Police i~ep-+- artment does not need same4 recommending that the siren and radio and spot- light be kept on the car, however, that ownership of same be retained by the Police Department, and that they be allowed a credit for the car. Thereupon it was moved by Councilman Snyder and seconded by Councilman Lake that the old Chevrolet automobile be transferred to the Building Department and they be charged $175.00- therefor, plus repair thereof, and that a credit be entered on the books in favor of the Police Department for said $175.00, the difference in the actual trade in value of the Chevrolet Car and the Phaeton Ford car which was turned in by the Police Department at $125.00 on the purchase of the new Chevrolet. All members of the Council present voting aye, the Mayor declared the motion duly carried. A communication was received from Drlr. L. Daet~ueilex to the effect that on account of pressing business interests hers, which will also nec- essitate a trip of some length to the Fast, he tenders his resignation as a member of the Council of the City of Lynwood, thanking the Council for their many courtesies to him while a member of the official family and wishing them furture success in their endeavors on behalf of the City of Lynwood. It was moved by Councilman Meyer and seconded by Councilman Lake than the resignation be accepted with regrets, and that the City Clerk be instructed to communicate with ~[r. Daetweiler offering the .Council's re- grets.' Roll Call: Ayes: None. Absent: Councilman Daetweiler. Thereupon it was duly moved by Councilman Snyder ana seconded by Councilman Meyer that Mr. V. A. Nation, 3236 Louise Street, Lynwood, be appointed to fill the vacancy created by the resignation of ~Ir. Daet- weiler. Roll Call: Ayes; Councilmen Lake, Meyer, Snyder and Boater. Noes; None. Thereupon the Mayor requested Dir. Nation to come forward, where- upon the City Clerk administered the Constitutional Oath of Office to Mr. Nation, and he was duly inducted into office and took his seat at the Council table as a member of the City Council of the City of Lynwood. An application was received from Andrew Delozie r for employment in the Water Department, which was ordered filed by the Mayor. Report of activities of the Police Department for the month of September; also health report for week ending September 21st, 1935. There being no objection, the Mayor ordered the reports filed. ~VF~.NTS~ RTiCT~:R The City Clerk was instructed to communicate with special insu r- anee Agent Harry G. Berens relative to the cos t of carrying $20,000.00 in- surance on the City Hall, and $5,000.00 on contents, covering for any loss caused by Fire. It was moved by Councilman Snyder and seconded by Councilman Meyer, that the earnings from the premium for Public Liability and Property Damages, insurance covering all City vehicles be divided equally between GeorgQ R. Wood, F. B. Rowlee, Claude L. Reber, Zeiser & Zeiser, Herbert Rehfeld and Al Young, all duly authorized Insurance Agents of the City of Lynwood. A communication was received from City Attorney Boardman ruling on the matter of claim of Arch McLay, Esq., on behalf of R. L. Dunlap, to the effect that as a whole the Civil Service Ordinance is valid, but that he doubts very much whether the office of Chief of the Fire. Department can be created by Ordinance, and also doubts the authority of the City Council to delegate its own power of appointment and dismissal of "subor- dinate officers anti employeesa to a trial board as mentioned in the Civil Service ordinance.; also stating that ,there is nothing.in the general law regarding municipal corporations of the sixth class which ereates;a fire- chief, a,nd accordingly such a person must come, within the .class of "subor- dinante~officers and employees regarding which thQ Council retains author- , ity to appoint and discharge, therefore, that the reciuest fir. Arch G. McLay for and on •behalf of Mr. Dunlap shcstzld be denied and I~r. McLay advised act©rdirigly. Thereupon it was moved by Councilman Meyer and seconded by Councilman Snyder that said request of Mr. Arch G. adcLay for and on behalf of Mr. Dunlap be denied, and that the City Attorney be instructed to so notify ~r. McLay. All members of the Council voting aye, the Mayor de• Glared the motion duly carried. At 8:45 P, l[. Councilman Snyder requested to be excused, which was granted whereupon he vacated his .chair and left the Council Chamber.- Councilman Beyer stated that Engineer Bateman is going to in- clude Mallison Street, with_the list of streets to be improved for the year, as per request of a property owner on said street at the previous regular meeting. . Mayor Boster announced that he had appointed E. S. Cavanaugh, Sohn L. blintz, S. A. Kuhle, A. L. .Young, J.o. Law, F. ~. Sanders, George Gr'eenemeyer to act on the committee to submit proposal for zoning of in- dustrial property 3n the City of Lynwood, Mr. Cavanaugh to act as Chair- man, of said committee. • ~W BLTSIN+'SS: A communication was received from Engineer Batsman attaching maps and budget estimates governing the expenditure of funds accruing°to the City from the "state highway ~ cant fund" and the city streets ~ cent fund" for the 1935-1937 biennium;-also resolution and ordinance in connect- ion therewith. Thereupon RESOLUTION N0. 949, entitled: " A RESOLUTION OF THE CITY OF LYNi~00D, CALIFORNIA, APPROVING BUDGET SUBMITTED BY THE, CITY ENGI- NEER FOR L'DPFNDITURF OF FUNDS ACCRUING TO THE. CITY OF LYNWOOll FROM STATE HIG$~fAY GASOLINE TAX FOR FISCAL YEAR 1935-36 AND AUTHORIZING MAYOR TO EXECUTE AGRENTS iN CONNECTION THSREYJITH", was read. It was moved by Councilman Lake and seconded by Councilman ~ldeyer that. said Resolution No. 949 be adopted. Roll Call: Ayes: Councilmen Lake, Meyer, Nation and Boster. Noes: None. Absent: Councilman Snyder. Ordinance No. , entitled "An Ordinance of the City of Lynwood, California, relating to the case and expenditure of moneys received from the State of California under the provisions of Article 5, Chapter 1, Division 1 of the Streets and Highway Code," was introduced and read the first time. It was moved by Councilman Lake and seconded by Councilman Meyer that same be accepted as read the first time and,.. pass to the second reading.
