M. Mayor ~3oster in the chair. Councilmen Lake, Meyer, Nation, Snyder and Boster answered the roll call. It was moved by Councilman Snyder and seconded by Councilman Meyer that the minutes of the previous regular meeting of November 19th, 1935 be approved as written. There being no objection, '~ the A~avor ordered the communication filed. A communication was received from the "uaranty Building and Loan Association complaining about the ill manner in T~rhich the place oc- cupied by one, Pau. Carpenter on 11810 Lindbergh Street, is kept, stat- ing that it is a detriment to their property located at 3,02 Josephine Street. There being no objection, the Mayor ordered the matter turned over to the Building Inspector for investigation and report to the Coun- cil his findings. A communication was received from Captain in Charge, E. W. Lewis calling attention to the bad condition of incinerators along the alley just west of Long Beach Boulevard, between Mulford Avenue and Fernwood Avenu®; also regarding weeds that are allowed to grow up and thus create afire hazard. There being no objection, the Mayor ordered the matter turned over to Building Inspector Rimmey and Captain Lewis for investigation and call upon property owners along said alley whose incinerators are in bad condition and request that same be provided with screens and what ever is necessary to have same comply with requirements; also that the weeds be cleaned off in order to eliminate the fire hazard. A communication was received from Engineer Bateman calling at- tention to the South Gate-Lynwood Sign at Tweedy Boulevard and Long Beach Boulevard being in bad condition and constitutes a menace to traffic, caused by deterioation of supporting cables and by supporting guy poles having been repreatedly struck and weakened by passing vehicles; also that the sign is not ub to date, seeking the Council's advise as to whe- therther or not to have same torn down. There being no objection, the matter was referred back to the City Engineer with the instructions to confer with the Citv En~*ineer from South Gate regarding the matter, and see if a °satisf€~etorv solution can ~?e reached. A communic~ti^n was receives from tre Hirst Gecurity-Deposit Corporation rrotesting about the proposed industrial zoning along Alameda. There being nn objection, the Mayor instructed the City ^lerk to notify them that no definite action has been taken by the Council as yet other than appoint a committee to investigate and report, and when definite ac- tion is taken, a hearing will be set when all interested persons may be heard in person or by counsel and submit their protests at such time. A petition was also received signed by residents surrounding the Grayson factory located on State and Imperial consenting to the zon- ing of that territory bounded on the east by State Street, on the south an west by Fernwood and on the north and west by Beech wood Avenue, into an industrial zone, as per proposed zoning recommendations of the Zoning Committee. There being no objection, said petition was ordered filed un- tilmore definite action is taken by the Council. A communication was received from one A. E. Martin requesting and submitting a proposal to collect dog tax and to take care of the dog situation, stating that he has aided by the City of Sacramento and Wood- land in such matter. There being no objection, said communication was or- dered filed and no further action was taken thereon. ~., Reports of activities of Police Department and City Court for '; month of November were received; also health reports. There being no ob- i' jection, sans were ordered filed. UNFINISHED BUSINESS: common cat on was received from a Pasadena Float Committee of Lynwood, by x. 1N. Manchester, Secretary, pro tem, stating that a meeting was held whereat it was decided to enter a float in the Tournament of Roses requesting that the Council 9nnropriate the sum of ~I00.00 towards the cast of said float, stating that the Committee felt that the publicity and ad- vertising that would bereceived thereby cannot be overestimated aside from~rrin~in~ pleasure to the large number of neon7e present. 'hereupon it was moved by Coun ilman Meyer and seconded by Councilman Nation that the-City contribute 100.00 from the Publicity and Promotion Fund for the purpose of defraying expenses in connection with the entering of a float in the Tournament of noses to be held at Pasadena on January lst, T~936. LuKasky to operate a fortune tell- ing establishment in the City o~'T~*mw~ood be denied, because of unfavorable reputation of applicant. Thereupon it was moved by Councilman Snyder and seconded by Councilman Lake that t?~e recommendations of Chief Miller be accepted and the anp7 i cant, tip. T~. Cit~r Attorney Boardman reported on the matter of request of Gen- eral Pipe Line Company to assign to the General Petroleum Company their franchise under County Ordinance No. 781 and City Ordinance No. 79, stat- ing that before the request is granted the city Auditor obtain from the City Clerk the figures and statement which the Ueneral Pipe Line Company use as a basis for the payments of tue 2~ of the gross annual receipts arising from the use, operation, or possession of said franchise, .,nd check the same with said corporation before final action is taken thereon. """"" `there being no objection, the Mayor referred the matter to the City Audi- tor for such investigation. City Attorney Boardman also reported in writing on the matter of request for right of way to extend Fernwood on the south roadway of the P. E. Tracka from Imperial south and east, stating that he has-refer- red the matter to the real estate department of the Security-First Nation- al Bank owners of said property, and he believes teat the city can obtain an easement for street purposes. City Attorney Boardman also addressed the Council regarding said matter suggesting that legal description of the land involved be furnished by the Engineer to be incorporated in the deed. Thereupon it was moved by Councilman Lake and seconded by Council- man Meyer that we request the City Engineer to make a survey of the right of way necessary for said street in order that we can procure easement therefor. All members of the Council present voting aye, the Mayor de- clared the motion carried. An Ordinance, entitled: "An Ordinance of the City of Lynwood, California, Amending Ordinance No. ?41 providing for Licensing and Regu- lating the carrying on of certain Businesses, professions, trades, cal- lings and occupations", said proposed ordinance c~?an~-ing the license collector from teat of Chief of Police to City Clerk; also requiring plates be furnished for truck licensees, and that moneys received from licenses be deposited daily with the Cit~r Treasurer, was read. It was moved by Councilman Nation and seconded by Oouncilman Snyder that said Ordinance be accepted as read the first time and pass to the second ""* reading. It was moved by Councilman Snyder and seconded by Councilman Lake that the City Clerk be instructed to notify Mrs. Bryant, Water Clerk that in the future all refunds made by the Water Department of deposits required by the City of the consumers to insure payments, be rEfunded by City Warrant as required bq Ordinance No. 245. City Attorney Boar dman addressed the council to the ®ffect that when he was first appointed City Attorn ey,perhaps it was not explained, that he has a business of a character where he has no private clients ~ohatsoever. Stating that he tries law suits for other lawyers, so his a only Clients are Lawyers; stating that this work is taking a great deal I~' of his time; also stating that dust recently he spent one month at Pomona at a trial, and in the meantime the City business goes on, and while he has increased his office force, it is not always convenient for him to ap- pe~ar at a Council meeting, and the main reason being that when he gets home he is worn out. Mr. Boardman stated that he has enjoyed the association and work very much, and while the work has not been hard, except when he has had law suits, perhaps it would be more convenient to have a City At- torney who is not so much involved in other cases, and who you could call on more readily than himself. Think perhaps that it has been realized by the Council that my statement is correct, and therefore he feels that it would be mutually benefitial if some other person were appointed to take his place, therefore stating that he wished the records to show that I hereby resign as City Attorney o~' the City of Lynwood to take effect at the appointment of a successor and that it be accepted in the spirit in which it is given. rl!avor RpgtP,r addressed the Body on Behalf of the Council thanking Attorney ~?oardman for the work performed while he ~?as served as City At- torney, stating that he realizes that he is a very busy man, however, it will be with regrets that the Council will accept the resignation. Councilman Snyder also spoke along the same line, stating further that the Council alva~rs have felt that the opinions r e¢lered by Mr. Boardman ,,,.,,~ on legal matters have been founded on law and would have been upheld by Court if contested. ffihereupon it was moved by Councilman Lake and seconded by Council- man Nation that we accept Mr. Boardman's resignation as City Attorney with regrets.
