The City nouncil of the City of Lynwood met in a regular ses- sion, at the City Hall, 11331 Playa Street, on above date, at 7:30 P.M .. Mayor Boster in the chair. Councilmen Lake,;r!~e~er, cation, Snyder and Boster answered the roll call. ?t was moved bzr Councilman Snyder and seconded by Councilman Meyer that the minutes of the previous regular meeting of February 2nd 1937 be approved as written. All members of the Council voting aye, the Mayor declared the motion duly carried. ~JRITTEN COMMUNICATIONS; commun ca on was received from the Los Angeles County League of Municipalities announcing the next meeting at Montebello on Februaryl8th, at n:~G r. ~u,., ;hen legislative matters will be dis- cussed, said meeting to be held at the Palm grove Cafe, WYrittier Elvd., at 10th Street. Mayor ~ioster and Councilman Snyder indicated that they would attend. A Communication was received from the Board of Supervisors with certified copy of Resolution adopted by their Honorable Body attached, wherein they appropriate 5,000.00 from the Gasoline Tax Fund for Street purposes. There being no objection, the Mayor ordered the com- munication filed. ORAL COMMUNICATIONS: . rs. Mac enzie a dressed the Council requesting that a side- walk be constructed in front of property near the end of Poplar Drive and in front of her property while the street is being resurfaced; also curbs, on the same basis as the one constructed on Norton Avenue; also protesting because the men who delivered dirt to a lady in that territory failed to spread the dirt for her. Mayor Boster informed Mrs. MacKenzie that it is not within the duties of the Street embloyees to do any work on private property and that is no doubt the reason M-hv the dirt was not spread; also re- questing that she pt'~t ter renlteat 3n ~~riting regarding the construc- tion of a sidewalk: and also contact Fn~ineer Bateman to ascertain whether or not j.t 1s in the present nro,iect. Legg re- garding the intolerable condition that exists because of flood waters in what is known as the East Compton Creek drainage area, including Lynwood, stating that the County Surveyor is working on the prepara- tion of storm drain plans for this area, which are to be submitted to the y~orks Progress administration for the first unit of this drain- age system, requesting that the City of Lynwood cooperate and send re- presentatives to meet with County officials when meetings are called. A communication was also received from the Honorable Board of Supervisors with certif ied Resolution attached, which was adopted by their Honorable Body on February 9th, relating to expediting of development of drainage pro3ect in ttre East Compton Creek drainage area,~inviting the City officials to attend conferences to discuss ways and means of tepidly bringing the proposed project to correct the situtation to a conclusion, and that the County Surveyor and En- gineer of L. A. County Flood Control District negotiate between the Cities and determine the logical point on the east branch of said Com- pton Creek for said storm drain. It was moved by Councilman Nation and seconded by Council- man Meyer that Engineer Bateman and Councilman Snyder be appointed „~, a committee to work with the Honorable Board of Supervisors and the County Officials on adequate drainage facilities for this District and that the City Clerk notify Supervisor Legg of .such appointment and that the4 will be at his service whenever necessary. All mem- bers of the Council voting awe, the 1~~Ravor declared the motion duly carried and it was so ordererd. A communication was received from ~[r. Llogd Ownbey, X278 Magnolia. Avenue, to the effect that he is contemplating on building a residence in thereat of said address for rental ~urpose3 and that Building Inspector Kimmey informs him that the Cit~r Council. have un- der consideration a proposed zoning Ordinance which would provide that permission be given to such construction by 75~ of tie prcperty owners .200 feet on each said of his property, including the two per- sons ad~oiniz~ his property, requesting that he be allowed to pro- ceed with said building without securing such consent as someof the proper ties involved has been sold to the State and a number of tae owners reside outside of the State and therefore it would not be possible for him to commence said building as soon as he would like to. Noes: None. A communication was received Prom Mr. E. Hurst, 4231 Fernrnood Ave. requesting that the drainage facilities be increased under the P. E. tracks as the heavy rains flood his garage 8 inches and in the house the water was 2 inches on pop of 'the floor. There being no objection, the ~dayor referred tae matter to Enginer Bateman with the further instruc- tion that he inspect all drains under the P. E. right of way; also what would be necessary to makean underpass at Peach Street and the expense involved, and report his findings to the City Council. A communication was received from Mr. Robert A. doff itt giving a general report on the special assessment problem, particulary respect- ing District No. I9, submitting 5 copies for the perusal of the Council; also stating that he has contacted Mr. Behnke and that he states that the Security Bank have approved the plan heretofore outlined to the Coun- cil, suggesting that the work be commenced on 6 and 10 as soon as poss- ible. Councilman Nation was instructed to confer with Mr. Moffitt re- ~arding his plan. Mr. Nation brought up the matter of back 1PVater Account of one Mr. Durrall who now resides on Louise Street, stating that Mrs. Bryant refuses to turn on the water as there is a X14.00 water bill unpaid, how- ever, that Mr. Durrall is willing to put up the 3.00 deposit, stating that they have been without water for two days and something should be done. After due consideration of the matter, it was determined that the slater Clerk should accept the X3.00 deposit and current water bill, and the old bill for water should be taken care of later. Thereupon it was moved by Councilman ??ever and seconded by Councilman Snyder that the matter be referredto the Chairman of the Water Department with power to act along the line outlined above. All members of the Council voting aye, the Mayor declared the motion duly carried. Communications were received from Senator McAdoo, Congressman Hiram Johnson, Postmaster General S. 4~. Purdumand Congressman Byrom N. ~aott, acknowleldging receipt of resolution requesting a new post of- fice for Lynwood. There being no ob3ection the communications were or- dered filed. Health report for week ending January 30th, 1.937 was received and ordered Piled. NE!!~ BUSINESS : c~ ommunicat~on was received from the Planning Commission sub- mitting their report and map in connection with zoning the City of Lyn- wood, which was adopted by the. Planning Commission on the 5th day of February, 193?; also submitting minutes of the hearings held; also stat- ing that Notices had been published according to law in the Lynwood~Press a newspaper oP general ciruculation; also copy of proposed Ordinance, which zoning Ordinance was passed and adopted by said Planning Commission together with a map. Thereupon it was moved by Councilman Lake and seconded by Coun- cilman Nation that said report and Map be accepted, and that the City Clerk be instructed to rv~7.ish notice of hearing in the Lynwood Press, a newspaper of genPr.a7 circlzlation, printed, published. and circulated in the City of Lynwood, said hearing to be held on March 9th, 1937, at 8 P. M., and the rublications to re made on February 26th and March 5th, 1Q37. Role Call: Ayes: Councilmen Lake, Meyer, Snyder, Nation and Buster. Noes: None. It was moved by Councilman Meyer and seconded by Councilman Lake that the pity i:lerk b e instructed to advertise for bids for the purchase of gasoline covering the period from Aprillst, 1937 to April 1st, 1957, coverir~ all grades of_~asoline, fixing the time of receiv- ing same on Niarch 2nd, 19:37, at 8 Ni. All members of the Council vot- ing aye, the Mayor declared the motion duly carried. Proposals in the form oP contracts were received from Shell Oil Company, Rio Grande Oil and Company, and Gilmore Oil Company giving prices for furnishing gasoline for the City of Lynwood for one gar. A communication was received from Mr. A. L. Young reporting that no progress has been made in the matter of effecting a readjustment of the debt burden created by A. & I, District No. 24. i City Clerk Anderson reported that h© wrote to all those who were officially appointed to act on various Mattoon Act Committees,re- prese#nting property owners in their respect district, but that Mr. Young was the only one that replied in vdriting, however, that Nir. C. 0. Edington who was appointed as Chairman on h. a 1. District No. 18 re- ported verbally that they had done noshing as the mayor had told them at a meeting called to not proceed until it can be determined what can be done with ~. & 1. Dist. No. 19. Thereupon it was moved by Councilman Nation and seconded by Councilman Lake that those who replied be given a vote of thanks for acting on the Committee, and that all committees heretofore appointed to help settle the Mattoon Act obligation in the City of Lynwood be dis- olved. All members of the Council voting aye, the Mayor declared the mitbn duly carried. The City Clerk reported that on November 19th., 1936, Mr. Wm. Rouleau, 4829 Imperial Highway, ran into a light standard and wrecked same, subsequent to which a bill was rendered him in the amount of X170.50 by his office, and letters have also been written to him re- questing him to make the damage good, but up to date no reply has been received, therefore suggesting that the matter be burned over to the City Attorney for action. Thereupon it was moved by Councilman Nation and seconded by Councilman Snyder that the mat+-Pr he turned over to the City Attorney for such action as he deems~~necPSSArv to collect said claim. All mem- bers of tt~e Council voting aye, the Manor declared the motion duly carried any it was so ordered. d A communication was received from City Attornev~Ruby advis- ing tra.t some time ago a meeting was called to consider the recent op- inion rendered by the A~}torney General to the effect tr_at it is the duty of the District Attorney to prosecute all offenses declared mis- demeanors by the State law, whether such misdemeanors are committed within:fhe`City or in'county terl°itory, which the District Attorney advised him would necessitate doubling; the District Attorney's force, unless the City Attorneys themselves would act as prosecutors. It seemed to be the consensus of opinion among about fort City Attorneys present that the City would pr ®fer their own City pro- secutor to handle local cases, as they would be better informed rela- tive to the case, stating that the District Attorney's office wishes to know what the Council's desire is in the matter, and that he would be glad to serve as City prosecutor for 25.00 additional compensa- tion. Thereupon it was moved by Councilman Lake and seconded by Councilman Snyder that in accordance with the letter of the City At- torney, Chas. A. Ruby, City Attorney of the City of Lynwood, be made City Prosecutor with the duty of working with the Chief of Police of this City, under the supervision of the District Attorney in prosecut- ing in the City Court of this City, misdemeanor violations of State Statutes, and that as such City Prosecutor he be paid a salary of 25.00 per month in addition to the salary teat he now receives as ' City Attorney. Zt was moved by Councilman Lake and seconded by Councilman Snyder that the City Clerk be instructed to communicate with the men in the Street Department who worked so faithfully in an endeavor to elim- inate damage from the high waters during the regent rain in the business area, thanking them for their efforts.
