The Gity Council of the City of Lynwood met in regular session at the City Hall, 11331 Plaza Street, on-above date, at 7:30 P. M. In the absence of Mayor Boster, the meeting was called to order by the City Cler k. Councilmen Lake, Meyer, and Nation answered roll call. Councilmen Boster and Snyder were absent. The City Clerk announced that in the absence of the Mayor, a motion would be in order to the appointment of a temporary Chairman and Mayor pro tem. Thereupon it was moved by Councilman Plation ~d seconded by Council-man Meyer that Councilman Lake be appointed to act as Chairman and Mayor pro tem. All members of the Council present voting aye, the Clerk declared the motion duly carried and it was so ~'"` ordered. Whereupon Councilman Lake took his seat as Chairman. Thereupon it was moved by Councilman Nation and seconded by Councilman Ivleyer that the minutes of the adjourned regular meeting . of September 14th, 1937, be approved as written. All members of the Gouncil presentv:~ting aye, the Mayor pro tem declared the motion duly carried. WRITTEN COMMUNICATIONS: A communication was received-from Mr. W. E. Spicer compli- menting the Council on their fidelity ~o the trust of the citizens of Lynwood, referring especially to various Street Improvements that have been made in recent years, which was noticed again upon his re- turn from a three months trip, also expressing thanks for every effort that the Gouncil are making in the interest of the people which they serve; also with respect to the Mattoon Act problem. A communication was received from Archer Blow Pipe & Incinerator Corp. offering to sell their products to the City. There being no objection same was ordered filed.. A communication was received from the Los Angeles Gounty Health Department submitting contract for health services for fiscal year 1937-38, for a consideration of 88¢ per inspection, or a minimum of X1.00 per day. Thereupon it was moved by Councilman Nation and seconded by Councilman Meyer that the contract be accepted and that the lUlayor be authorized to execute same for and on behalf of the City of Lynwood. Roll Gall: Ayes: Councilmen Meyer, Nation and Lake. Noes: None Absent: Councilmen Boster and Snyder. A petition was received from property owners on Brewster Street signed by G. A. Dummett requesting that the 8ouncil have the live stodk removed that is running loose and causing damage to lawns and property in that district. Inasmuch as the matter had already been referred to the Chief of Police, no further action was taken, other than he was instructed tohandle the matter according to existing Ordinances. A report was received from Wm..Sullivan regarding the Free Employment Bureau for the month. There being no objection, the report was ordered filed. was recei~r~ health reports for weeks ending September 4th and 11th, 1937./ There~eing no objection, the reportswere ordered filed. UNFINISHED BUSINESS: A communication was received from0'Melveny, Tuller & Myers, supplementing their Gontract for legal services in connE-action with refunding proceedings heretofore taken in connection with A. & I. Districts No. 6, 9 and 10, stating that a reasonable fee in the event the proceedings were abandoned for any reason, would be 40°~0 of the total fee through the hearing on the Resolution of Intention; 40~o up to and including the hearing on the reassessment; and for work done subsequent to the hearing on the reassessment, the remaining 20°,0 Thereupon it was moved by Councilman Nation and seconded by Councilman Meyer that said contract and supplement be accepted and that the P1iayor pro tem be authorized to execute said contract for and on behalf of the City of Lynwood. Roll Call: Ayes: Councilmen Meyer, Nation and Lake. C Noes: None. Absent : Councilmen Boster and Snyder. ~; ,~ ~~ A communication was received from Engineer Bateman re- porting on matters that were referred to him at a previous meet- ing, stating that the cost of replacing of gutters on Calif. Ave between Sanborn and Mulford would amount to approximately X225.00, with la bor and equipment additional, the cost for replacing similar gutters on Lynwood Road vaould be approximately the same,' stating that the cleaning of Agnes Ave, between Bullis Road a.nd School St. has been taken care of. There being no ob,jection,~ said communication was ordered filed for the rresent. A communication was received from F. D. Evans, Building Inspector reporting on the matter of application for fertilizing plant at Lynwood Road and Alameda by one Paul Potter, reporting that because of the location that he ~rould rec~~mmend that a business license be granted. Thereupon it was moved by Council- man P1leyer and_ seconded by Councilman Nation that the License Col- lector be authorized to issue a license to Mr. Potter to engage in the business of fertilizer at said Location. All members of the Council present voting aye, the Mayor pro tem declared the motion duly carried. A communication was received from City Attorney Ruby ~. reporting on the claim of one W. 0. Narry regarding alleged damage to her car caused by Police Officer Baier, in the alount of X15.00, ruling that after investigation of the matter he does not believe teat the claim is a ,just claim, therefore recommending that the claim be r ejected. Thereupon it was moved by Councilman Nation and seconded by Councilman Meyer that the demand be denied. All members of the Council present voting aye, the P~Iayor pro tem declared the motion duly carried. A communication was received from Fire Chief Lewis re- porting on the matter of alleged damage to trees by weed burning crew presented by one Pfiss Thompson, stating that he made an in- vestigation of the situation and finds that no damage was done by the Fire, but that same was caused by lack of irrigation on her part; that furthermore she had not complied v~!ith the Resolu- tion instructing Pier to abate the weed nuisance, therefore rec~m- mendingthat the claim be disallowed. Thereupon it was moved by Councilman I~-~eyer and seconded by Councilman Nation that said claim for damage to trees filed by Miss Ferol A. Thompson in the amount of X34.00 be disallowed. All members of the Council present voting aye, the Mayor pro tem declared the motion duly carried. The City Clerk stated that he had notified Mrs. C. C. Dee of 11316 Atlantic Blvd. to appear before the Council this evening to show cause why her license should not be revoked, as instructed by the City Council. Thereupon Mayor Pro tern Lake inquired if Mrs. Dee was in the audience,whereupon Mr. William A. Wittman, Attorney, representing Mrs. Dee appeared making an appeal on behalf of Mrs. Dee and that they be given additional time in order to secure more evidence, stating that he ,just began checking the matter after 5 p.m. when he secured signatures in favor of the establishment which he ~~resented for filing with the Clerk. I~Ir. Wittman sug- gested that the Council hear the matter partially now and then continue the matter to a future date, as he would like to secure more evidence that should be considered as Mrs. Dee has gone to ,,,~ considerable expense in getting established and it would be quite a financial loss to have her business license revoked. I,Rr. Wittman stated that her place of business is not offensive to the property owners and residents there. Thereupon Mayor Lake requested those who were present who wished to protest against the dog kennel to rise, whereupon; approximately 30 persons rose. I42r. Kimball addressed the Council, stating that Mrs. Dee has had more time to get information and rebuttal than they had, stating that they started circulating the petition t}~t was pre- sented at the previous council meeting at 3 P:M, and had the sig- natures by 6 P.An., stating that the odor that emenates fr:~m the kennel is almost unbearable, so bad that they can't keep their v,Tindows open at night or when they eat. Pfr. Layman also addressed the Council substantiating the statements of Mr. Kimball, stating that the odor he believes is caused from the cooking of intestines and heads of carcasses, and then the burning of the bones. dirs. Hester also addressed the Council stating that she can't sleep on account of the barking of the dogs a.nd that the odor is terrible. ~~~ Mrs. W. J. Kimball addressed the Council that the odor that emenates is unbearable and that the dogs bark every night so that she cant get her required rest, stating that she is under the doctor's care and must have her rest in order to regain her health. Pers. Kimball stated that one evening the odor became so ba.d that her husband had to get up and smoke and cook coffee in order to offset the odor. Mrs. Layman addressed the Council on the matter stating that tYe odors are most offensive, in fact, that she must keep her doors closed in order to stand it. At 8:20 P.P,~. Mayor Boster arrived and took a seat at the Council table. - Ivirs. Hespe addressed the-Council about the dogs barking any time ofthe night, stating that-she works and therefore must have her rest which cannot be accomplished with dogs barking all hours of the night. ~ Mr. Dee addressed the Council to the effect that he works for a Packing House and that he secures meats there which are ab- solutely fresh, stating that he comes home at 12 A.M, and puts on the meat to cook at 3 ~'.P~I. and it gets done at 6 P.NI., stating that he keeps the kennel clean a¢~d that it has been passed on by the Hea]_th t Officer and other City officers, as such. Mr. Dee stated that he has about 30 grown dogs upon the premises, and that others in the territory keep dogs also and they also bark, stating that it is only the small dogs that he has that bark and cannot bark loud enough to bother anybody. Councilman Nation addressed the Council to the effect that there was some question about granting the application at the time license was issued and it was understood that everything would be kept in order so no complaints would be registered against same or the license would be revoked, and inasmuch as same has not been com- plied with, he would move that the license issued to Mrs. Dee to operate a pet shop and dog kennel at 11316 Atlantic Ave. be revoked and that she be given 15 days to make other arrangements for location which was duly seconded by Councilman P4eyer. All members of the Council present voting aye, the Mayor declared the motion duly car- . ried. Mr. Edington addressed the Council wishing' information on what the status is re~;arc?ing the enterprise of the Seventh Day Adventists Institution, stating that he had heard that same had been reported unfavorably to the Council by the Planning Commission be- cause there would be some negroes who would attend the school, stat- ing that he believes that it would be a mistake to not allow said institution to come in as they have splendid institutions wlsewhere and the propertyow ners in his area who are adjacent to the proposed school and in the neighborhood have indicated tohim when he has contacted them that they are in favor of them proceeding with their building as it would be a definite asset to the City. Mr. Edington stated that he is_sure that the authorities in charge of the school would cooperate with the citizens of Lynwood so that it would be no danger of any negroes locating here and they would be required to reside outside the City limits even though they attended their school. Mr. Edington stated further tha-t. it might have a more disastrous affect if permit is not granted as maybe then the land might even be sold to negroes. Cha~a~man Lake stated that the matter has never as yet come before the Council, but has been presented to the Planning Commission with petition to have the zone changed. When it was presented to their honorable Body the matter of race restriction difficulty arose, so nothing was done about the changing of the zone, stating that the Council are anxious to interpret the wish of the people of the C3t~y of Lynwood, suggesting that Mr. Edington contact the members of the Planning Commission giving his suggestions to them. Mayor Boster also spoke on the matter to the effect that they purposely did not set the date for a hearing on the proposed change in zoning as they wished to secure a voice from the people on the ratter, stating that the Commission were fearful that it would throw the Elementary Schools system open to the colored race. Mayor Bolter stated that there would just be a few negroes who would attend the school and would be only for one or two years ae the,y are planning on transferring all colored people to the Los Angeles branch ~rhen they have proper facilities there for higher learning. Mr. Hanberry addressed the Council favoring the establish- ment of the school stating that there would be no danger of negroes residing here as there are restrictions in the deeds against their residing here. ~_ '~~ Mr. MicCausland addressed the Council favoring the pro- ject stating that it is too wonderful an institution to lose. Mr. C. E. Bruce also addressed the Council to the ef- fect that he was planning on building in that area, but that he is withholding commencing until he is assu red that the school will be built. Young, Agent 60.00 It was moved by Councilman Nation and seconded by Coun- cilman Boster that the demands be allowed and warrants be drawn on the City Treasurer for said various amounts. Roll Call. It was moved by Councilman Meyer and seconded by Council- man Nation that the City Clerk be instructed to send a letter of condolence to Mr. Henry J. Schouten, former Councilman, because.of the death of his wife. All members of the Council present voting aye, the Mayor pro tem declared the motion duly carried. Resolution Number 1009 entitled: 'RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYNWOOD APPROVING MEMORAI\?DUM OF AGREE- MENT FOR EXPENDITURE OF 1/4 CENT GAS TAX ALLOCATED FUR STREETS OF MAJOR IPQPURTAPJCE" was read. It was moved by Councilman IVleyer and seconded by Councilman Boster that said resolution number 1009 be adopted. Roll Call. Ayes: Councilmen Lake, P~Ieyer,Aiation and Boster. Noes: None. Absent: .Councilman Snyder. It was moved by Councilman Boster and seconded by Coun- cilman Meyer that the City of Lynwood purchase Lots 437 and 438, Tract 2551 for a consid~.ration of X125.00 as full price, and Lot 439, Tract 2551 for a consideration of X60.00 as full price there- of, subject to any unpaid taxes. Roll Call Ayes: Councilmen Lake, Meyer, Nation and Boster. Noes: None. Absent: Councilman Snyder. Councilman Nation stated that considerable complaint had been registered regarding a shop at Redwood and Pear Sts. and that the work goes on between 3 A. M. and 9 A. M. thereby disturbing the peace of the district. There being no objection, the matter wa.s referred to the Building Inspector to investigate and report back to the Council their findings. It was moved by Councilman Meyer and seconded by Coun- cilman Boster that the meeting adjourn to October 5th, 1937.
