The City Council of the City of Lynwood met in an adjourned regular session, at the City Hall, 11331 Plaza Street, on above date, at ?:30 r. M. Mayor Hoster in the chair. Councilmen Lake, Meyer, Nation and Boster answered the roll call. Councilman Snyder was absent. WRITTEN COMMUNICATIONS: A communication was received from Mr. and Mrs. M. L. Gillette, 3146 Flower Street to the effect that they are erecting a modern two- story building on Lot 608, Tract 2992, and in planning driveway for the benefit of both Lots 608 and 609, which they own, they find that a City ornamental light post is so situated that sufficient clearance cannot be obtained without the removal of the lighting post, stating that ap- proximately four feet to the north would allow the necessary c3m.rance, requesting the Council's cooperation that extent. After due consideration of the matter, it was moved by Coun- cilman Lake and seconded by Councilman Meyer that the City Engineer be instructed to prepare an estimate of the cost of moving said standard and require that the Gillette~s deposit an amount equal to said esti- mate and after the standard has been moved that they be charged the actual coat thereof. All members of the Council present voting aye, the Mayor declared the motion. duly carried and it was so ordered. A communication was received from Robert a. Moffitt, `Special Counsel, recommending that Mr. Beebe of the law firm of O~Melveny, Tul- ler & Meyers or other competent counsel be employed, to render an ap- proving opinion on refunding bonds proposed to be issued in Acquisition and Improvement District No. 19, at the earliest possible moment. There being no objection, the Mayor referred the matter to the Finan ce Committee to meet with the City Engineer, City Treasurer and City Clerk to go into the matter further and to report their findings at the next regular meeting of the Council. A communication was received from W. E. Mellinger to the ef- fect that he has been attending the Harbor District Chamber of Commerce meetings for some time and has been an unofficial delegate, recommending that the City take out a membership in said organization with an annual dues of 5.00 per year, announcing their next meeting at Huntington Park in November. No action was taken thereon, and the communication was or- dered filed. A communication was received from John T. Fairbanks to the ef- fect that his contract for the disposal of garbage, tin cans, bottles, etc., expires on December 1st, 193?, requesting that the City Council renear the contract for a period of three years, stating that the pick- ups and routes would be the same as at the present time. Thereupon it was moved by Councilman Lake and seconded by Coun- cilman Meyer that a new contract be entered into with John T. Fairbanks for a period of three years from the expiration of the present contract for the disposal of garbage, tin cans, bottles, etc., for a considera- tion of X110.00 per month, and that Mr. Fairbanks furnish bond in the principal amount of X1,500.00 and carry his own compensation insurance as well as public liability and property damage insurance covering his men in his employ and motor vehicles, ,nd that the City Attorney be in- structed to draft the contract for execution by Mayor Boster on behalf of the City of Lynwood. Roll Call: Ayes: Councilmen Lake, Meyer, Nation and Boster. Noes: None. Absent Councilman Snyder. Mr. Fairbanks addressed the Council thanking them for past fa- vors and for renewal of his contract. A communication was received from the City of Compton thanking the Council for their cooperation in the matter of constructing ditch on the west side of Santa Fe Avenue. Thera being no objection, the communication was ordered filed. UNFINISHED BUSINESS: A communi cation was received from City Attorney Ruby reporting on the claim of Mrs. Gra.oe Ney for alleged ir~aries when she crossed Im- perial Highway, submitting bill for X1.00 for doctor bill, ruling that the City is in no way liable for said injury, therefore recommending that the claim be disallowed. Thereupon it was moved by Councilman Lake and seconded by Councilman Meyer that the recommendation of City Attorney Ruby be complied with and the claim be disallowed and the City Clerk be instructed to to so notify Mrs. Ney. All members of the Coun- cil present voting aye, the Mayor declared the motion duly carried. . - ~. ~~ Covenants concerning real estate was received in connection with real estate belonging to J. M. Snodgrass, Fay Snodgrass, Robert L. Snodgrass, Pearl Snodgrass, Forrest .Snodgrass, Eva Snodgrass and the Southern California Association of Seven Day Ad ventists, a corpor- ation, wherein they mutually covenant and agree to bind themselves, their successors, etc., for a periodof 25 years that they will not per- mit any part, parcel of any land described therein to be rented to, or occupied by, any person not oP the White or Caucasian race, except ser- vants and agents employed on the premises so occupied, provided, however, that the attendance of persons of other than the lghite or Caucasian race at camp meetings, or other general meetings held on the property of the Southern California Association of Seventh Day Adventists, shall not be deemed or construed as a violation of the covenants, nor atten- dance of students of other than the white race at any day school which said corporation may erect be deemed to be a violation of the covenant, agreeing to incorporate said covenants in any and all deeds of transfer, conveyances or leases of said lands or any part thereof, all having ~r* been duly acknowledged before a notary public. Thereupon it was moved by Councilman Meyer and seconded by Councilman Nation that said conven- e ant be accepted by the City Council of the City of Lynwood and same be i'' placid of record in the County Recorder's office of Los Angeles County, ~, California. Roll Call: Ayes: Councilmen Lake, Meyer, Nation and Buster. Noes: None. Absents Councilman Snyder. Thereupon ORDINAN ~ N0. 288, entitled: "AN ORDINAN C~ ESTABLISh- ING CONDITIONAL RESTRICTIONS UPON CERTAIN LANDS OF' THE SOUTHERN CALIF- ORNIA ASSOCIATION OF SEVENTH DAY ADVENTISTS, A CORPORATION, IN B~ODIFI- CATION OF THE RESTRICTIONS IMPOSED IN ZONE RI BY ORDINANCE N0. 285 OF THE QTY OF LYNWOOD, AND MODIFYING SECTI ON 7 OF ORDINANCE N0. 285"', was read for the second time. Thereupon it was mo ved by Councilman Nation and seconded by Councilman Meyer that said,Ordinance No. 288 be adopted as read the second time, finally pass and be published as required by law. Mayor Buster announced that the matter of application for license to operate a dog kennel by one Mrs. C. C. Dee at 11316 atlantic Avenue, would again be considered at this time. Thereupon the City Clerk produced letter.~from.Attorney Wm. A. Wittman, Jr. setting forth information. regarding sold matter, respect- fully praying that a business license be issued f®rthwith to Mr. and Mrs..C. C. Deed to conduct a dog kennel as heretofore a}~plied for, stating that she is agreeable to have the place remodeled or any"cor- rections made that the Council may desire. A communication was received signed by aeo. Herman, Poundmaster of the City of South Gate and Eldon Hess, 11323 Virginia, to the effect twat a business of dog kennel was maintained by Mrs. C. C. Dee in South Gate and in the Downey District, and that nothing but unsanitary condi- tions existed in both places, and while in South Gate they received cum plaints all the time about the obnoxious odor coming from the dog kennel. Councilman Nation addressed the Council to the effect that the Council members have received copies of the letters for and against the dog kennel for study and that there are a lot more against the proposal, arr3 most of those in favor are in no way concerned as they live away therefrom in South Gate and Los Angeles, stating that the Council are interested in doing the most good for the most pile and therefore he believes the application should be denied. Thereupon it was moved by Councilman Lake and seconded by Councilman Nation that Mrs. C. C. Dee be denied a permit to operate a dog kennel and pet shop at 11316 Atlantic Ave. and no license be issued therefor. Attorney Wittman addressed the Council on behalf of Mrs. Dee s application, requesting information Prom Mr. Dave Colfelt of the L. A. County Health Department as to whether or not the inspection he, made today was favorable.. Mr. Col~1t addressed the Council stating that there was consi- derable odor in the kennel on account of urine and fecal matter, how- ever, stating that was not so bad from a distance, stating that Mr. Dee had attempted to bury same of the offal, 'but had not done a good fob, seating further that the barking of the dogs is a nuisance, and there can be no question of that. ~. ~- On inquiry Mr. Dee admitted that they had approximately 100 dogs housed at the establishment. Roll Call on motion: Ayes: Councilmen Lake, Meyer, Nation and Roster. Noes: None. Absent: Councilman Snyder. Thereupon it was moved by Council:an Nation and seconded by Councilman Meyer that Mrs. Dee be given ten days to vacate the premises at 11316 Atlantic Ave. during which time she is allowed to dispose of her dogs, and. if she is not out of business at the expiration of said ten days periacl, the health department be and they are hereky instruc- ted to abate the nuisance. NEW BUSINESS: An Ordinance entitled: "An ordinance amending Subsection B of Section 6 of Ordinance No. 286 of the City of Lynwood, California, pro- viding for and re dating the licensing of camp cars, camp trailer, or tent on Lot or Tract of land upon which there is a family residence or esta bushed place of business, was introduced and read the first time. It was moved by. Councilman Meyer and seconded by Councilman Nation that same be accepted as read the first time and pass to .the second reading. Roll Ca11: Ayes: Councilmen Lake, Meyer, Nation andBoster. Noes: None. Absent: Councilman,snyder. In connection with the application of Mr. Ripley to build five feet inside the set back line on Long Beach Blvd. at State St., it was moved by Councilman Meyer and seconded by Councilman Nation that City Engineee r Bateman get in touch with Mr. Ripley to ascertain what can be worked out in the way of vacating a portion of Cherokee Ave., leav- ing an alley in lieu of the Street. All members of the ,Council present voting aye, the Mayor declared the motion duly carried. The City Clerk submitted annual report showing repeipts and disbursements for fiscal year beginniing July 1st, 1936 and ending June 30th, 1937; also giving other data regarding the City government. It was moved by Councilman Nation and seconded by Councilman Meyer that the meeting adjourn to November 2nd, 1937, at 7:30 P, M.
