HomeMy Public PortalAbout20021118REGULAR COUNCIL MEETING NOVEMBER 18, 2002 1 CALL TO ORDER The Regular Council Meeting of November 18, 2002, was convened at 6:00 P.M. by Mayor Tom Rackers. Prayer was offered by Councilman Cliff Olsen, followed by the Pledge of Allegiance. ROLL CAL The following Council Members were present for the roll call: Present: Angle, Ferguson, Groner, Klindt, Olsen, Smith, Viessman, Vogel, and Weber Absent: Vincent A quorum was declared present. PRESENTATIONS FROM THE GALLERY (CONTINUED) Mr. John Landwehr, 2103 Scenic Drive, representing the citizens for annexation, made a presentation regarding the issue of annexation. He stated that annexation is crucial to the growth of the City, and announced that the City Council Members will be holding ward meetings to answer questions and provide information to the citizens of the City in the next few weeks. Those meetings will be held, in chronological order, as follows: Ward Five — Wednesday, November 20, 7:00 PM, McClung Park Pavilion Ward Two — Thursday, December 5, 7:00 PM, Coca -Cola Community Room Ward One — Tuesday, December 10, 7:00 PM, Immaculate Conception Church Ward Four — Thursday, December 12, 7:00 PM, Hyde Park Facility Ward Three will be scheduled shortly. Councilman Edith Vogel stated that citizens who cannot attend the Ward meeting in their own ward due to a conflict of schedules are welcome to attend any or all of the other ward meetings. Mr. Dan Massie, #12 Jackson Street, thanked the City, the Missouri Department of Transportation, and the Evening Lions Club, for their cooperation in getting a bus shelter installed near the intersection of Dix and Missouri Boulevard. Mr. Leonard Loethen, 2601 Schellridge, owner of a gas station at the corner of Dix Road REGULAR COUNCIL MEETING NOVEMBER 18, 2002 2 and Missouri Boulevard, made a presentation regarding the recent discovery of contaminated dirt near his property. He stated that the Missouri Department of Natural Resources has informed him it will cost several hundreds or thousands of dollars to take care of this problem, and he feels it is unfair that he should have to pay that because it has not been determined where the contamination came from. Council Members asked Transportation Director Marty Brose if the City knew about this contamination when the Dix /Southwest connector project was being done. Mr. Brose stated no one knew about the contamination until just recently when another entity did some excavation in the area and discovered the contamination. He stated it is not incumbent upon the City to have the soil tested unless the City purchased property, and since the City already owned the right -of- way at this site for about 50 years, testing was not required. Mr. Loethen stated that his business has diminished because of the Dix /Southwest connector and he asked the City to help in some way with the problems he is having with the DNR. CONSENT AGENDA The following items were presented to the Council for their approval by consent: a. Council Work Session Minutes November 4, 2002 b. Council Meeting Minutes November 4, 2002 c. Council Work Session Minutes November 6, 2002 d. South School Pedestrian /Bike Trail Change Order #3 e. RENEWAL - Contract with Convention & Visitors' Bureau Councilman Richard Groner requested that item (e) be removed and held over pending further information from the CVB. Councilman Bob Weber requested that item (d) be considered separately because he wished to abstain on that item. A motion was made by Councilman Cliff Olsen for approval of the items (a) through (c), seconded by Councilman Roy Viessman, and approved unanimously. A motion was made by Councilman Cliff Olsen for approval of item (d), seconded by Councilman Dan Klindt, and approved with Councilman Bob Weber abstaining. BIDS OVER $25,000 Bid 2026, Clothing and Operational Supplies, Police Department: Bid 2043 — Granular Quicklime, Water Pollution Control Plant A motion was made by Councilman Cliff Olsen for approval of the two bids as presented, seconded by Councilman Bob Weber and approved unanimously. REGULAR COUNCIL MEETING NOVEMBER 18, 2002 3 MINUTES AND REPORTS RECEIVED AND FILED Mayor Tom Rackers announced that the following minutes and reports of City boards and commissions have been received, and are on file for review, by the City Clerk's Office: a. Historic Preservation Commission, September 10, October8, and October22, 2002 ANNOUNCEMENTS BY TH E MAYOR There were no announcements made by Mayor Tom Rackers at this time. APPOINTMENTS BY THE MAYOR There were no appointments to come before the Council at this time. BILLS INTRODUCED Bill 2002 -107, sponsored by Councilman Smith, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH COLE COUNTY, MISSOURI FOR PROVISION OF COMMUNICATIONS SERVICES. Bill 2002 -108, sponsored by Councilman Smith, entitled: AN ORDINANCE OF THE CITY COUNCIL OF JEFFERSON CITY, MISSOURI TO ESTABLISH A REDEVELOPMENT AREA, APPROVE THE HIGH STREET TAX INCREMENT FINANCING PLAN, APPROVE A REDEVELOPMENT PROJECT AND ADOPT TAX INCREMENT FINANCING, AND DESIGNATE JUANITA DONEHUE AS THE DEVELOPER. REGULAR COUNCIL MEETING NOVEMBER 18, 2002 4 Councilman Richard Groner distributed his independent financial analysis on this project, and asked Finance Director Steve Schlueter to give his analysis as well. Following their comments, a lengthy discussion was held on this project. Housing Authority Director Alan Pollock was present to answer questions. BILLS PENDING Bill 2002 -102, sponsored by Councilman Weber, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH MISSOURI TRANSIT LINES, INC. FOR INTER -CITY BUS ROUTE AND A LEASE OF CITY BUS TERMINAL. Bill 2002 -102 was read third time by title, placed on final passage and passed by the following vote as Ordinance: Aye: Angle, Ferguson, Groner, Klindt, Olsen, Smith, Viessman, Vogel and Weber Nay: None Bill 2002 -103, sponsored by Councilmen Vogel and Smith, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE VOLUNTARY ANNEXATION OF REAL PROPERTY CONTIGUOUS TO AND LYING NORTH OF THE PRESENT CITY LIMITS INTO THE CITY OF JEFFERSON, MISSOURI, LOCATED IN SECTIONS 3, 4 AND 9 OF TOWNSHIP 44 NORTH, RANGE 11 WEST, COUNTY OF CALLAWAY, STATE OF MISSOURI, AND REPEALING SECTION 1 -17 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, DEFINING THE EXISTING CITY BOUNDARY AND ENACTING A NEW SECTION PERTAINING TO THE SAME SUBJECT. Councilman Edith Vogel requested that Bill 2002 -103 be placed on the Informal Calendar at this time. Bill 2002 -104, sponsored by Councilman Weber, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CODE PERTAINING TO CHAPTER 22 (PARKING, STANDING, AND STOPPING), ARTICLE I (GENERALLY), AND SCHEDULE S: (LOADING ZONES) OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI. Bill 2002 -104 was read third time by title and placed on final passage. Councilman Bob Weber made a motion to amend Section 1 and Section 2 of Bill 2002 -104 by changing the phrase "commercial vehicles" to "authorized vehicles" in the following two locations: Sec. 22 -27. Loading zones. FG. The areas established by subparagraph (a) of Schedule S are loading zones between the hours REGULAR COUNCIL MEETING NOVEMBER 18, 2002 5 of 8:00 a.m. and 5:00 p.m., every day except Sunday. No driver of a vehicle shall park such vehicle in any of such loading zones; provided, that commcrcial authorized vehicles shall be permitted to park in such loading zones while loading or unloading materials at business places in the area. (Ord. No. 13245, §1, 8 -20 -2001) SCHEDULE S. LOADING ZONES Pursuant to section 22 -27, the following locations are designated as loading zones at the following times: (a) 8:00 A.M. to 5:00 P.M. The described areas on the following roadways are loading zones between the hours of 8:00 A.M. and 5:00 P.M. every day except Sunday. No driver of a vehicle shall park such vehicle in any of these named loading zones; provided, that commcrcial authorized vehicles and trucks shall be permitted to park in these loading zones for fifteen minutes or less while loading or unloading materials at business places in the area: The motion to amend was seconded by Councilman Cliff Olsen, and approved unanimously. Bill 2002 -104 was then passed, as amended, by the following vote as Ordinance 13473: Aye: Angle, Ferguson, Groner, Klindt, Olsen, Smith, Viessman, Vogel and Weber Nay: None Bill 2002 -105, sponsored by Councilmen Vincent and Groner, entitled: AN ORDINANCE AUTHORIZING THE ISSUANCE OF $5,520,000 PRINCIPAL AMOUNT OF SEWERAGE SYSTEM REVENUE BONDS, SERIES 2002, OF CITY OF JEFFERSON, MISSOURI; PRESCRIBING THE FORM AND DETAILS OF SAID BONDS AND THE COVENANTS AND AGREEMENTS TO PROVIDE FOR THE PAYMENT AND SECURITY THEREOF; AND AUTHORIZING CERTAIN ACTIONS AND DOCUMENTS AND PRESCRIBING OTHER MATTERS RELATING THERETO. Bill 2002 -105 was read third time by title and placed on final passage. Following questions by Councilman Richard Groner, City Counselor Allen Garner stated that a representative of Piper Jaffray was present, and the Council asked the representative to answer questions about this issue. Following the discussion, a motion was made by Councilman Richard Groner to accept the Substitute Bill 2002 -105 that was distributed to the Council when the meeting began, seconded by Councilman Bob Weber and approved unanimously. Bill 2002 -105 was then passed, as substituted, by the following roll call vote as Ordinance No. 13474: Aye: Angle, Ferguson, Groner, Klindt, Olsen, Smith, Viessman, Vogel and Weber Nay: None NEW BUSINESS REGULAR COUNCIL MEETING NOVEMBER 18, 2002 6 Councilman Clyde Angle made comments regarding a letter to the editor written by the City and Missouri Department of Transportation regarding the Dix /Southwest connector project. He stated that he believes the traffic is flowing well. Transportation Director Marty Brose stated that it is not operating as well as the City would like, but reminded citizens that the project is not yet complete. Councilman Clyde Angle made comments regarding a letter which was recently mailed to citizens regarding the quality of the city's drinking water. He stated it was unfortunate that citizens received this information because it was false, and was sent for the purpose of soliciting business for a company who sells water. Councilman Clyde Angle made comments regarding the issue of Council Members abstaining from voting. Ata recent meeting, City Counselor Allen Garner stated that Council Members should provide in writing to the City Clerk their reason(s) for abstaining on voting on any issue. He stated he hopes that future Council Members are elected that they will understand issues such as this to avoid making any errors. UNFINISHED BUSINESS Councilman Clyde Angle asked for an update on the issue of abuse of city parking attendants. City Administrator Rich Mays stated that the abuse is "alleged abuse" at this point, and that he has tried to meet with City Prosecutor Daniel Green to get a report on this matter and that he has not been able to make contact with him for the past two weeks. COUNCIL LIAISON REPORTS There were no liaison reports made at this time. ADJOURN MENT There being no further business to come before the Council at this time, a motion was made by Councilman Bob Weber for adjournment, seconded by Councilman Roy Viessman, and approved unanimously at 7:30 P.M.
