HomeMy Public PortalAbout1963.06.03 Regular Meeting Minutes McCall, Idaho June 3 , .1963 The Board of Trustees of the Village of McCall, Valley County, Idaho, met in regular session at the regular meeting place of the board in the TVU•llageal Hall in the Village of McCall at eight oclock F M. on June 3 1963. The roll was called andthe following found to be present : Chairman Bob H. Fogg , Trustee Allen Blair Trustee Dale Fortin , Trustee Raymond Mason , Trustee Absent : Arthur M. Roberts, Chairman There was also, present William A. Kirk , Village Clerk. - After the meeting had been duly called to order and the minutes of the preceding meeting read and approved, the following ordinance was introduced in written form by Allen Blair and was read by title . Trustee Dale Fortin moved that the rule requiring the reading of the ordinance three different which motion was seconded by- Trustee Mason days be dispensed with/and the motion was adopted by the vote of not less than three-fourths of the Board of Trustees, to wit : Aye : Fogg Fortin Blair Mason Nay: None . Idti !� e� The ordinance was thereupon again read by title and was then read in full, after which, pursuant to motion made by Raymond Mason and seconded by Allen Blair the ordinance was adopted by the following vote : Aye : Fogg Fortin Blair i Mason Nay: None. The ordinance was thereupon signed by the Chairman in evidence of his approval, was attested by the Village Clerk, was ordered recorded, and is as follows : ORDINANCE NUMBER 233 AN ORDINANCE ordering the improvement and extension of the water system of. the Village of McCall; estimating the cost thereof, directing, subject to the approval of the qualified electors of said village, who are taxpayers that bonds of said village in the amount of $70,000 be issued to pay the cost thereof; calling an election for the p-t;irpose of submitting to the qualified electors of said village who are tax- . payers the proposition of the issuance of such bonds, and providing for the issuance of such bonds in the event they are voted at such election. WHEREAS the Village of McCall now owns and operates a municipal water system. supplying water to said village and its inhabitants and the inhabitants of the area adjacent thereto; and 2 - N WHEREAS it is.. considered by the Board of Trustees to be i necessary and essential to the health and well being of the inhabitants of said village that said water system be improved , and extended; and WHEREAS said village does not have funds available to pay the cost of the foregoing and has determined it advisable to finance such cost through the issuance of the bonds of the village pursuant to the provisions of Chapter 28 of Title 50 of the Idaho Code, and in order to do so desires to provide for the holding of the election required by said chapter; NOW, THEREFORE, Be It Ordainet1 by the Chairman .and Board of Trustees of the Village of McCall, Valley County, Idaho, as follows : Section 1 . (a) That it is necessary that the munici- pally owned water system of the Village of McCall be improved and extended pursuant to plans and specifications therefor which have been prepared and filed by Wendell H. Smith of Preston Idaho , qualified public utility engineer,] heretofore selected by the Board of Trustees for such purpose, and on file in the office of the Village. Clerk. (b) That the cost of the work described in subparagraph (a) above as estimated by the above described engineer, including the payment of all expenses properly incident thereto and properly incident to the issuance of. the bonds, is $707000. (c) That the construction and acquisition of the work described in subparagraph (a) above is hereby ordered. (d) That, subject to the approval thereof by the quali- fied electors voting at the election for which provision is here- inafter made, the bonds of the Village of McCall shall be issued in the amount of $70,000 to pay the cost of such improvements and extalsions and incidental expenses as above provided. I - 3 - i Section 2. That a special election is hereby called to be held in the Village of McCall on July 9 , 1963, for the purpose of submitting to the qualified electors of said village who are taxpayers of said village the proposition set fortul in the form of ballot appearing in Section 4 hereof. Section 3. That the polls at said election shall open at the hour of 9:00 o 'clock A.M. and remain open continuously until the hour of 7:00 o 'clock P.M. and then close . Said election shall be held at the voting places specified in the form of election notice set out in Section 5 hereof. Section 4. That all persons who at the time of the .election are qualified electors of the village and who are tax- payers thereof, properly registered and possessing the qualifi- cations of residents, shall be qualified to vote at said election, and that the ballots to be used at said election shall be in sub- stantially the following form: OFFICIAL BALLOT SPECIAL BOND ELECTION VILLAGE OF M6CALL, VALLEY COUNTY STATE OF IDAHO July 9 1963 INSTRUCTIONS TO VOTERS: To vote on the following question place a cross (x) in the square to the right of "In favor of issuing bonds to the amount of $70,000 for the purpose provided by Ordinance Number 233 If or "Against issuing bonds to the amount of $70,000 for th purpose provided by Ordinance Number 233 , " according to the way you desire to vote on the question. All marks otherwise made are forbidden. All distinguishing marks are forbidden and make the ballot void. If you, by mistake or accident, mark, tear, deface or otherwise mutilate this ballot, return it to the election judges and obtain another ballot.. N QUESTION: Shall the Village of McCall, Idaho, issue and sell its negotiable coupon bonds to the amount of $70,000, for the purpose of pro- viding funds with which to improve and extend the water system in and for said village, as more fully provided in Ordinance Number 233 , adopted on June 3 -, -1963? IN FAVOR OF ISSUING BONDS TO THE AMOUNT OF $70,000 FOR THE PURPOSE PROVIDED BY ORDINANCE NUMBER 233 AGAINST ISSUING BONDS TO THE AMOUNT OF $70,000 FOR THE PURPOSE PROVIDED BY ORDINANCE NUMBER 233 Section 5. That notice of said election shall be given by the Village Clerk by publication of the following notice in the Payette Lakes Star , a newspaper having general circulation in the Village of McCall, once a week on the same day of five successive weeks, the first of whkh publications shall be not less than thirty (30) days prior to the date fixed for the holding of said election and by posting saidnotice in three (3) public places _ :pzeodrmt in said village, one of which )UUM- YpV9U7rUK,- shall be the voting place to be used at said election, for not less than thirty (30) days prior to said election: NOTICE OF SPECIAL BOND ELECTION Pursuant to the laws of the State of Idaho and Ordinance Number 233 of the Village of McCall, County of Valley, State of Idaho, notice is hereby given that a special bond election will be held in said village on July 9 , 1963, beginning at the hour of 9:00 o ' clock A.M. and closing at the hour of 7:00 o ' clock P.M. of said day, for the purpose of taking a vote upon th following question, to wit : - 5 - Y QUESTION: Shall the Village of McCall, Idaho, issue and sell its negotiable coupon bonds to the amount of $70,000 for the purpose of pro- viding funds with which to improve the water system in and for said village, as more fully provided in Ordinance Number 2,33 adopted on June 3 1963? Said election will be held at the following polling placer : Village hall, 3rd and Lenora Streets, McCall, Idaho Notice isfarther given that only qualified electors who are taxpayers of said village and who are registered as provided b law are entitled to vote at said election. No qualified elector who is duly registered as a voter at the last preceding general municipal election shall be required to re-register so long as he remains, or has remained, continuously after such registration, a duly qualified elector of the Village of McCall, but those elec- tors who have failed or neglected heretofore to vote for two successive biennial general elections in said village or who re- moved from the village and remained away for a period of one year (provided they shall again have resided in the village for at least thirty (30) days) must re-register. - 6 - N William A. The place of registration is the office of said Village Clerk in the Mil.1ageal Hall Persons may register on each day at any time during the office hours of said clerk, beginning with the day that this notice of election is given and continuing until and including the Saturday next preceding the election; and on Thursday, Friday and Saturday next preceding the election, persons may register between the hours of 9:00 o 'clock A .M. and 5:00 o ' clock P.M. and between the hours of 7:00 o ' clock P.M. and 9:00 o ' clock P.M. The voting at said election shall ' be by ballot . The ballots to be supplied the voters for their use at said election shall be in the form set forth in Ordinance Number 233 If at said election two-thirds of the qualified electors, who are taxpayers of. said village, voting at such election assent to the issuance of said bonds for the purpose set forth in Ordinance Number 233 and designated on the aforesaid ballot, the negotiable coupon bonds of the village will be issued for the above described purpose, which bonds, or any issue thereof; will mature annually over a period commencing at th expiration of two (2) years from their date and ending twenty (20) years from their date, and will bear interest at a rate or rates not in excess of six per cent (6f) per annum and shall be payable in accordance with the provisions of Section 50-2811, Idaho Code and the Municipal Bond Law of Idaho . Dated at McCall, Idaho, this 3rd day of June 1963. Village Clerk _ 7 _ Section 6. That if at said election two-thirds of the qualified electors of the village who are taxpayers of the village voting thereat assent to the issuance of said bonds, the bonds of the village shall be issued as hereinabove provided and shall mature over a period commencing at the expiration of two years fro their date and ending twenty years from their date, and shall bear interest at a rate or rates not in excess of six per cent per annum, and shall be payable in accordance with the provisions of Section 50-2811, -Idaho Code and the Municipal Bond Law of Idaho. Section 7. That the following persons are hereby appointed to act as judges and clerks and constables of said election: Polling Place: Village Hall, 3rd and Lenora Streets, McCall, Idaho Kate Hayes Ila Gillespie William Acker Constable Beulah Timm Marge Willey Clerks Ann Scott Judges Constable Clerks Judges Polling Place : Constable Clerks - 8 - N i Section 8. That said bonds shall be issued if carried as aforesaid, and payment shall be made through the levy of taxes on all taxable property in the Village of McCall, beginning with the year 1963 and continuing until principal and interest shall I have been fully paid, in such amounts and at such rates as are necessary to assure the prompt payment of such principal and I interest, and it is hereby ordered that such taxes shall be levied annually at the time and in the manner the general taxes for said village are levied in each such year, in addition to all other authorized taxes and assessments . The proper officer or officers of said village are hereby authorized and directed to do all things requisite and necessary to carry out the provisions of this section and to apply the proceeds of the taxes so collected to the payment of such principal and interest. Section 9. That all ordinances or parts thereof in conflict herewith are to the extent of such conflict hereby repealed, and .that this ordinance shall be published in one issue of the Fa7&3tte Lakes Star , the official journal of said village, and shall. take effect and be in full force immediately upon its passage, approval and publication.
