HomeMy Public PortalAbout1963.07.10 Regular Meeting Minutes IMcCall, Idaho July 10 1963 The Board of Trustees of the Village of McCall, Valley tion of the regular meeting held July 1, 1963, County, Idaho, met in a continua-/ session at the regular meeting place of the board in the Village Hall in the Village of McCall at 4:15 o'clock P M. on July 10 1963. The roll was called and the following found to be present: Arthur M. Roberts, Chairman Raymond Mason ' Trustee Bob H. Fogg , Trustee Trustee Trustee Absent: Dale Fortin I Allen Blair There was also present William A. Kirk, Village Clerk. After the meeting had been duly called to order and the minutes of the preceding meeting read and approved, the Chairman announced that one of the purposes of the meeting was to be the canvass of the returns of the special bond election held in the Village on July 9, 1963, pursuant to the provisions of Ordinance Number 233 adopted by the Board of Trustees on June 3, 1963. The Clerk then presented to the board the returns of the election from the voting place, the ballots cast at the election and all other pertinent data. The Board of Trustees thereupon proceeded to canvass the results of said election and to incorporate its findings and determination into the form of the following resolu- tion, which wasintroduced in written form by Fogg , was read in full, and pursuant to motion made by Fogg and seconded by Mason , was adopted by the .following vote: Aye: Roberts Mason Fogg Nay: None. The resolution was thereupon signed by the Chairman, attested by the Village Clerk, was ordered recorded, and is as follows: i A RESOLUTION canvassing the results j of an election held in the Village of McCall on July 9, 1963, on the author- ization of $70,000 Bonds of said Village and determining the results of said election. ' WHEREAS on June 3, 1963, the Board of Trustees of the Village of McCall adopted Ordinance Number 233 calling an election to be held in said Village on July 9,, 1963> for the purpose of submitting to the qualified electors of the Village the proposition hereinafter set out; and WHEREAS said election has been duly held pursuant to thel provisions of said ordinance and to the provisions of the Constitution and Laws of Idaho, and the results thereof have been canvassed by the Board of Trustees, and a complete investigation has been made by the board as to the manner in which said election was held and as to the regularity thereof; 2 - i i NOW, THEREFORE, Be It Resolved by the Chairman and Board of Trustees of the Village of McCall, Valley County, Idaho, as follows: Section 1 . That a special election was held in the I Village of McCall on July 9, 1963, at which election there was submitted to the qualified electors of said Village the following 1 proposition: i i QUESTION: Shall the Village of McCall, a o, issue and sell its negotiable 1 coupon bonds to the amount of $70,000, for the purpose of providing funds with which to improve and extend the water system in and for said Village, as more fully provided in Ordinance Number 233, i adopted on June 3, 1963? Section 2. That notice of the calling of said election was duly and legally given by the publication of an appropriate notice in the Payette Lakes Star, a newspaper having general circulation in the Village of McCall, on the following days: June 6, June 13_, June 20, June 27 and July 3_ , 1963, such notice constituting publication at least once a week for not less than thirty (30) days prior to the date fixed for said election, and by the posting of said notice in three (3) public places in said Village, one of which was the voting place used at said election, for not less than thirty (30) days prior to said election. That the posting and publication of the notice of election in the manner aforesaid is hereby in all respects ratified and confirmed and it is hereby found, determined and declared that such posting and publication of such notice on the above described dates adequately gave notice of the holding of the election to all qualified electors of the Village desiring to vote upon the proposition as submitted. - 3 - N r Section 3. That the polls at said election were opened at 9:00 o 'clock A.M. and remained open continuously until and closed at the hour of 7:00 o 'clock P.M., at the voting place i specified in Section 6 hereof. Section 4. . That only persons who were on said July 9, 1963, qualified electors of the Village of McCall properly registered and possessing the qualifications of residents and who 4 were taxpayers were permitted to vote at said election, and that 1 no qualified elector who was then a taxpayer was refused the right to vote at said election. Section 5. That the ballot used at said election wasin the form prescribed by law and by said Ordinance Number 233. Section 6. That the results of said election were, and are hereby formally found and determined to be as follows: Number of Votes Number of Votes Polling Place in Favor Against Village Hall 74 6 Section 7. That it is therefore found, determined and declared that said proposition was carried by a majority of more than two-thirds of the qualified electors who were taxpayers voting at the election, that said election was in all things held and conducted in strict compliance with law, and that the Board of Trustees is authorized to proceed with the authorization, sale and issuance of the bonds specified, in said-proposition. Adopted and approved July 10 , Chairman Att t• Village Clerk - 4 - N Thereupon the following resolution was introduced in written form by Mason , was read and duly discussed, i and pursuant to motion made by Mason and J, seconded by Fogg , was adopted by the following vote: Aye: Roberts Mason Fogg Nay: None. The resolution was thereupon signed by the Chairman, was attested by the Village Clerk, was ordered recorded, and is as follows: A RESOLUTION providing for the sale of 70,000 Water Bonds of the Village of McCall. BE IT RESOLVED by the Chairman and Board of Trustees of the Village of McCall, Valley County, Idaho, as follows: Section 1 . That sealed bids for the purchase of the ponds of the Village of McCall described in the following notice of sale, shall be received up to 8:00 o 'clock P M. on August 7 , 1963, and shall be considered at a meeting of the Board of Trustees to be held in the Village Hall in the Village of McCall at said time. Section 2. That the Village Clerk is hereby instructed to have published in the Payette Lakes Star, the official news- paper of the Village, for three consecutive publications at weekly intervals, with the first of such publications to be not less than twenty-one days prior to the date of sale, a notice in substantially the following form: - 5 - r • • r V r �r ' r f NOTICE OF INTENTION TO SELL THE GENERAL OBLIGATION COUPON BONDS i OF THE VILLAGE OF McCALL, VALLEY COUNTY, IDAHO, IN THE SUM OF $70,000 AND REQUEST FOR BIDS THEREFOR. NOTICE IS HEREBY GIVEN by the Board of Trustees of the Village of McCall, Valley County, Idaho, that said Village intends to issue and sell $70,000 negotiable coupon water bonds of said Village. Sealed bids will be received by the Village Clerk at the Village Hall in the Village of McCall for the purchase of said bonds up to 8:00 o'clock P M. on August , 1963, said bids to be filed with the said Village Clerk. At the hour of 8=15 o'clock P M. on said day said bids will be opened by the Board of Trustees at the regular meeting place of said board in said Village Hall. The Board of Trustees will sell such bonds to the highest bidder making the best bid therefor, which bid will be considered to be that of a responsible bidder submitting the bid which results in the lowest net interest cost to the Village. Said bonds will be dated September 1, 1963, and will be due and payable on an amortized plan as provided by the Municipal Bond Law of Idaho. The first annual principal payment shall be payable at the expiration of two years from date of issue and the last annual principal payment- shall be payable twenty years from the date of issue. Said bonds will bear interest at a rate or rates not exceeding 6% per annum, payable March 1, 196+ and semi- annually thereafter and will be payable at The Idaho First National Bank., McCall , Idaho. - 6 - Sealed bids shall be submitted specifying (a) the lowest rate of interest and premium, if any, above par at which the bidder will purchase such bonds, or (b) the lowest rate of interest at which the bidder will purchase such bonds at par and accrued interest to the date of delivery. None of said bonds will be sold for less than par and accrued interest to the date of delivery. Each bid (except any bid which may be received from the State of Idaho or its Department of Public Investment) must be accompanied by a cashier's or certified check payable to the Village Treasurer of the Village of McCall in an amount equaling 5% of the amount of such bid or by a cash deposit in like amount, which said cashier's check or certified check or cash deposit shall be returned to such bidder if his bid is not accepted. If the successful bidder shall fail, neglect or refuse to accept the bonds so sold and to complete and pay therefor in accordance with the terms of such successful bid within thirty (30) days following the acceptance thereof, such cashier's check or certified check or cash deposit shall be forfeited to said Village of McCall. The right is reserved to reject any and all bids, to waive all informalities and to readvertise any such bonds for sale until said bonds have been sold. The unqualified approving opinion of Chapman and Cutler covering the legality of the bonds will be furnished without cost to the purchasers. There will also be furnished the usual closing certificates, dated as of the date of delivery of and payment for the bonds, including a statement that there is no litigation pending or, to the knowledge of the signer thereof, threatened, affecting the validity of the bonds. 7 _ N A • . t The purchasers will be given at least seven business i days advance notice of the proposed date of the delivery of the I bonds when that date has been tentatively determined. It is now estimated that the bonds will be delivered on or about September 1, 1963. The bonds may bear interest at any number of rates in multiples of one-eighth or one-twentieth of 1% and all bonds of the same maturity shall bear the same rate or rates of interest. Only one coupon will be attached to each bond for each installment of interest thereon. Award or rejection of bids will be made on the date above stated for receipt of bids and the checks of the unsuccessful bidders will be returned immediately. That the Village Clerk is hereby instructed to mail a copy of the foregoing notice to the State Auditor, at Boise, Idaho, at least fifteen days prior to the time fixed for the sale of the bonds.
