HomeMy Public PortalAbout20021202REGULAR COUNCIL MEETING DECEMBER 2, 2002 1 CALL TO ORDER The Regular Council Meeting of December 2, 2002, was convened at 6:00 P.M. by Mayor Tom Rackers. Prayer was offered by Councilman Edith Vogel, followed by the Pledge of Allegiance. ROLL CAL The following Council Members were present for the roll call: Present: Angle, Ferguson, Groner, Klindt, Olsen, Smith, Viessman, Vincent, Vogel, and Weber Absent: None A quorum was declared present. PRESENTATIONS FROM THE GALLERY (CONTINUED) Rev. John Bennett, 317 Woodward Lane, a member of Christians United for Racial Equality (C.U.R.E.), endorsed the principle of establishing a human rights commission. Ms. Ann Galloway, 808 Clark Avenue, also spoke in favor of the establishment of a local human rights organization. She stated she was upset that a recent meeting was held without her knowledge to discuss this topic. Following Ms. Galloway's comments, Councilman Clyde Angle stated that another meeting has been scheduled for December 11 and asked if Ms. Galloway would be willing to attend that meeting to share information she has about the issue. Ms. Galloway stated she would be happy to attend that meeting. Mr. Dan Engle, 1117 E. McCarty Street, also spoke in favor of the establishment of a local human rights organization. Following Mr. Engle's comments, Councilman Kenneth Ferguson asked if he could get answers to the following questions: (1) What authority such a commission would have, (2) what would it cost the city, and (3) how much liability would the city be responsible for? Ms. Donna Cavitte, 326 E. Dunklin Street, stated she is here as a citizen rather than in her capacity with the Missouri Human Rights Commission. She stated she approves the committee which is studying the feasibility of a local human rights commission, and stated she would be available to lend her expertise on the matter. Following Ms. Cavitte's statements, Mayor Tom Rackers stated the City Administrator has been trying to contact Ms. Cavitte to invite her to participate but have not been able to reach her. Ms. Cavitte stated she has a new phone number and would provide that to the Mayor. REGULAR COUNCIL MEETING DECEMBER 2, 2002 CONSENT AGENDA The following items were presented to the Council for their approval by consent: a. Minutes of November 18, 2002, Work Session and City Council Meeting b. (RENEWAL) Agreement with Cole County Health Department A motion was made by Councilman Larry Vincent for approval of the Consent Agenda as presented, seconded by Councilman Cliff Olsen and approved unanimously. 2 MINUTES AND REPORTS RECEIVED AND FILED Mayor Tom Rackers announced that the following minutes and reports of City boards and commissions have been received, and are on file for review, by the City Clerk's Office: a. Convention & Visitors Bureau Documents b. Planning & Zoning Commission, October 10, 2002 ANNOUNCEMENTS BY TH E MAYOR Mayor Tom Rackers stated that Councilman Roy Viessman had a special announcement and asked Mr. Viessman to make his announcement. Councilman Viessman stated he has recently been married and introduced his wife, Lana Viessman, who stood to be recognized. APPOINTMENTS BY THE MAYOR There were no appointments to come before the Council at this time. Bill 2002 -115, sponsored by Councilman Weber, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AMENDMENT #1 TO THE PUBLIC TRANSIT CAPITAL ASSISTANCE GRANT AGREEMENT WITH THE MISSOURI DEPARTMENT OF TRANSPORTATION, PROJECT #MO -18 -X021, FOR THE PURCHASE OF ONE BUS. Bill 2002 -118, sponsored by Councilman Angle, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AMENDING THE CODE OF THE CITY OF JEFFERSON, MISSOURI, BY ESTABLISHING ARTICLE III OF CHAPTER 16, CITY OF JEFFERSON COMMISSION ON HUMAN RELATIONS. Councilman Clyde Angle stated that in light of the current committee looking into this issue, he plans to place Bill 2002 -118 on the Informal Calendar to give the committee time to go through its process. BILLS PENDING Bill 2002 -107, sponsored by Councilman Smith, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AN AGREEMENT WITH COLE COUNTY, MISSOURI FOR PROVISION OF COMMUNICATIONS SERVICES. Bill 2002 -107 was read third time by title, placed on final passage and passed by the following vote as Ordinance 13475: Aye: Angle, Ferguson, Groner, Klindt, Olsen, Smith, Viessman, Vincent, Vogel and Weber Nay: None Bill 2002 -108, sponsored by Councilman Smith, entitled: REGULAR COUNCIL MEETING DECEMBER 2, 2002 5 AN ORDINANCE OF THE CITY COUNCIL OF JEFFERSON CITY, MISSOURI TO ESTABLISH A REDEVELOPMENT AREA, APPROVE THE HIGH STREET TAX INCREMENT FINANCING PLAN, APPROVE A REDEVELOPMENT PROJECT AND ADOPT TAX INCREMENT FINANCING, AND DESIGNATE JUANITA DONEHUE AS THE DEVELOPER. Bill 2002 -108 was read third time by title, placed on final passage and passed by the following vote as Ordinance 13476: Aye: Angle, Ferguson, Groner, Klindt, Olsen, Smith, Viessman, Vincent, Vogel and Weber Nay: None INFORMAL CALENDAR Bill 2002 -103, sponsored by Councilmen Vogel and Smith, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI PROVIDING FOR THE VOLUNTARY ANNEXATION OF REAL PROPERTY CONTIGUOUS TO AND LYING NORTH OF THE PRESENT CITY LIMITS INTO THE CITY OF JEFFERSON, MISSOURI, LOCATED IN SECTIONS 3, 4 AND 9 OF TOWNSHIP 44 NORTH, RANGE 11 WEST, COUNTY OF CALLAWAY, STATE OF MISSOURI, AND REPEALING SECTION 1 -17 OF THE CODE OF THE CITY OF JEFFERSON, MISSOURI, DEFINING THE EXISTING CITY BOUNDARY AND ENACTING A NEW SECTION PERTAINING TO THE SAME SUBJECT. Bill 2002 -103 was read third time by title and placed on final passage. Councilman Klindt stated he would be abstaining from voting on this bill because he currently provides insurance on the property. Bill 2002 -103 was then passed by the following vote as Ordinance 13477: Aye: Angle, Ferguson, Groner, Olsen, Smith, Viessman, Vincent, Vogel and Weber Nay: None Abstain: Klindt NEW BUSINESS Councilman Clyde Angle made comments regarding criminal activity in the Fourth Ward, specifically shoplifting at Wal -Mart and speeding on Edgewood. Councilman Clyde Angle made comments regarding a recent community meeting he attended which was sponsored by Ameren UE. He stated that the city will be losing REGULAR COUNCIL MEETING DECEMBER 2, 2002 6 substantial revenue in the next few years as a result of rate cuts. Councilman Clyde Angle made comments regarding recent injuries on the new downtown sidewalks. He asked what the city was going to do about them. City Administrator Rich Mays stated that any issue involving litigation or potential litigation should only be discussed in closed session. Councilman Larry Vincent asked Finance Director Steve Schlueter to make a report of the latest sales tax revenues. Mr. Schlueter replied that the most recent check was $46,000 higher than had been estimated in the budget. UNFINISHED BUSINESS Letter from Bruce Cohn regarding development on W. McCarty: A lengthy discussion was held about a convention center at this location in which several Council Members asked questions about past studies on the issue. City Administrator Rich Mays stated he would be getting some information together to provide to Council Members who were not here during the time it was originally provided. Councilman Richard Groner stated he would like to see a committee of entrepreneurs look at the issue and come back and make a report to the Council in the next several months. He stated he had a list of four names he would suggest. Councilman Cliff Olsen agreed with Councilman Groner's recommendation. Following further discussion, Councilman Richard Groner made a motion to appoint a committee of local business persons with expertise in development and ask them to look into a convention center and come back in several months with a report to the Council, seconded by Councilman Clyde Angle. Councilman Larry Vincent suggested that instead, staff should be directed to draft an RFP to present to the committee. Following further discussion, Councilman Richard Groner withdrew his motion and Councilman Clyde Angle withdrew his second. Councilman Larry Vincent then made the following motion: The Council shall direct staff to put together a committee of four or more members of the development community charged with giving input into those elements that would be included in a convention center RFP, with emphasis on the perceived needs of the community, and to issue a report to the Council by the end of January 2003. The motion was seconded by Councilman Clyde Angle and approved with Councilman Groner voting "Nay." CVB Contract: Councilman Richard Groner moved to amend the contract as provided by City Counselor Allen Garner, and additionally to add further amendments which he suggested, and distributed to the Council Members prior to the meeting. The motion was seconded by Councilman Cliff Olsen. Following a lengthy discussion, a motion was made by Councilman Edith Vogel to call for the question, seconded by Councilman Bob Weber and approved with Councilman Clyde Angle voting "Nay." Councilman Groner's motion to amend the CVB contract as distributed to the Council was then defeated by the following roll -call vote: Aye: Angle, Groner, Olsen, and Smith REGULAR COUNCIL MEETING DECEMBER 2, 2002 7 Nay: Ferguson, Klindt, Viessman, Vincent, Vogel, and Weber Councilman Larry Vincent then made a motion to approve the CVB contract with the amendments as provided by City Counselor Allen Garner, seconded by Councilman Dan Klindt and approved with Councilmen Groner and Olsen voting "Nay." Councilman Clyde Angle stated he thinks the CVB should not have its own legal counsel, but should use the City's legal counsel. COUNCIL LIAISON REPORTS Councilman Roy Viessman made a report on the USS Jefferson City Submarine Committee and commended Ms. Melody Green for her hard work fostering the strong local support for the USS Jefferson City submarine crew. Councilman Edith Vogel announced the dates and times for upcoming Ward Meetings pertaining to annexation, in chronological order: Ward 2: Wednesday, Dec. 5, 7:00 PM, Coca -Cola Meeting Room - Washington Street (Councilmen Vogel and Smith) Ward 1: Tuesday, Dec. 10, 7:00 PM, Immaculate Conception Church Cafeteria (Councilmen Groner and Ferguson) Ward 4: Tuesday, Dec. 10, 7:00 PM, Hyde Park Facility off Stadium Blvd. (Councilmen Weber and Angle) Ward 3 will be held after the first of the year, and will be announced at a later date. Ward 5 meeting was held November 20. Councilman Bob Weber commended Mr. Larry Bates who will be retiring in the near future after 38 years of employment with the City. GO INTO CLOSED SESSION Mayor Tom Rackers stated that, pursuant to Section 610.021.2 of the Revised Statutes of Missouri, Chair would entertain a motion to go into Closed Session in the Boone /Bancroft room to discuss Real Estate. A motion was made by Councilman Kenneth Ferguson to go into Closed Session for the above - stated purpose, seconded by Councilman Larry Vincent and approved unanimously by the following roll -call vote at 8:00 PM: Aye: Angle, Ferguson, Groner, Klindt, Olsen, Smith, Viessman, Vincent, Vogel and Weber Nay: None
