HomeMy Public PortalAboutM 1938-06-07 - CC2.5s REGULAR MEETIIJG JUNE ?TH, 1938 The City Council of the City of Lynwood met in a regular session, in the Council chamber of the City Hall, 11331 Plaza Street, on above date, at 7:30 P. M. Mayor Nation in the chair. Councilmen Lake, Meyer and Nation answered the roll call. Councilmen Boster and Snyder were absent. It was moved by Councilman Lake and seconded by..Council- man Meyer that the minutes of the previous regular meeting of May 26th, 1938 be approved as written. All members of the Council present voting aye, the Mayor declared the motion duly carried. WRITTEN COMMUNICATIONS : A communication was received from the Auto mobile Club of Southern California requesting permission to place a directional sign at Long Beach Boulevard and on Imperial Highway, same to be placed with no expense to the City of Lynwood. Thereupon it was moved by Councilman Lake and seconded by Councilman Meyer that the City Clerk be directed to communicate with the Automobile Club ~ giving them permission to place the sign as requested. A communication was received from F. B. Roberts making application to renew a policy that he carries, premium being X35.00 covering the City Treasurer against theft. Thereupon it was moved by Councilman Meyer and seconded by Councilman Lake that Mr. Roberts be given the insturance and instructed to have same written. All members of the Council present voting aye, the Mayor declared the motion du ly carried. A communication was received from Harry E. Bonnell and Associates making application to do the City auditing. There being no objection, the communication was ordered filed. A communication was received from the Southgate Auto Ex- change making application for a license to operate a U Drive Trucks. rental business combined with the sale of used cars on the south- west corner of Mulford and Long Beach Blvd. There being no ob,jeetion, the Mayor instructed the City Clerk to communicate with the appli- cant informing him that permission has been denied at said location but the Council may look with favor on a location more in the out- skirts of the City. A communication was received from the League of California Municipalities regarding a decision oP the U.S. Supreme Court in the New York Port authority case holding the New York Port Authori- ty liable for the payment of federal income taxes, making the tax retroactive, urging that a telegram be sent to the Congressman and Senators from California requesting passage of legislation to pre- vent the collection of income taxes retroactively $om any public employee, which are now or may hereafter be held liable for pay- ment of the federal income tax. Thereupon it was moved by Council- man Meyer and seconded by Councilman Lake that the Mayor be author- ized to send telegrams to our Senators from California and Congress- man urging them to support such legislation. All members of the Council present voting aye, the Mayor decla red the motion duly car- ried and it was so ordered. RESOLU7IDN N0. 1111, authorizing the Mayor to execute any and all documents in connection with the application before the Railroad Commission of the State of California for ~o~~~ri~~~n in goose-neck overhead lamps, was read. It was moved y e and ' seconded by Councilman Meyer that said Resolution No. 1111 be adopted. Roll Call: Ayes: Councilmen Lake, Meyer and Nation. Noes: None. Absent: Councilmen Boster and Snyder. A communication was received from Clyde Simpson submitting his resignation as a member of the Civil Service Commission inas- much as he now resides outside the City limits. Thereupon it was moved by Councilman Meyer and seconded by Councilman Lake that the resignation be accepted with regrets and that the City Clerk be in- structed to communicate with Mr. Simpson thanking him for his ser - ~ices while a member of the Commission. All members of the Council present voting aye, the Mayor declared the motion duly carried and it was so ordered. Mayor Nation appointed Councilmen Lake and Meyer a Com- mittee to submit a name for consideration of the Council for a Suc- cesaor to Mr. Simpson. 25~ A communication was received from Engineer Bateman with copy of latter that he had. received from the Southern California Conference of Seven Day Adventists wherein they appeal for a flat rate of X15.00 per month for water consumed at their property to house their institution. Engineer Bateman suggested that the meter rate is reasonable, seeing no reason why our present ordinance should be amended, inasmuch as our rate is now reasonable. There being no ob- ,jeetion, the Mayor ref erred the matter to Councilman Lake to check wit Engineer Bateman and said Institution. A communication was received from the League for Local Liquor Control giving information with reepect to the Initiative measures to be submitted to the Voters. There" being no objection the Communication was ordered filed. A communication was received from A. Crew Waite submitting his resignation as a member of the Planning Commission because his health will not permit his continuance, thanking 'u's. for the confidenc expressed in him in appointing him to serve. Thereupon it was moved by Councilman Meyer and seconded by Councilman Lake that the resigna- tion of Mr. Waite be accepted and that the City Clerk be instructed to communicate with him, thanking him for his service while a member of the Planning Commission. The hour of 8 P.M. having arrived, said hour being the time fixed for continuing the hearing in connection .with the proposed re- assessment in refunding the indebtedness of Acquisition and Improvement Dist"rict No. 8 of the City of Lynwood. The Mayor inquired of the aud- ience whether or not there was any one present who wished to" protest to said reassesment, but there was no response. And it having been determined that there were no written or oral objections filed, Thereupon it was duly moved by Councilman Meyer and second- ed by Councilman Lake that said hearing be continued to June 14th, 1938, at 1 P.M. All members of the Council present voting aye, the Mayor declared the motion duly carried. The hour of 6 P.M. having arrived, said hour being the time fixed for continuing the hearing in connection with the proposed reas- sessment in refunding the indebtedness of Acquisition and Improvement District No. 25 of the City of Lynwood, The Mayor inquired of the audience whether or not there was any one present who wished to g~otest to said reassessment for said district, but there was no response. • Andit having been determined that there were no written or oral objections filed, Therefore, it was duly moved by Councilman Lake and second- ed by Councilman Meyer that said hearing be continued to June 14th, 1938, at 1 P.r2. All members of the Council present voting aye,the Mayor declared the motion duly carried. The hour of ~ P.M. having arrived, said hour being the time fixed for receiving objections or protests in connection with the pro- posed reassessment in refunding the indebtedness of Acquisition and Improvement District No. 11 of the City of Lynwood. The Mayor in- quired of the audience whether or not there was any one present who wished to protest to said reassessment for said District, but there was no response. And it having been determined that there were no written or oral objections filed, Thereupon it was moved by Councilman Meyer and seconded by ', Councilman Lake that said hearing be continued to June 14th, 1938, at 1 P.M. All members of the Council present voting aye, the Mayor declared the motion duly carried. It was moved by Councilman Meyer and seconded by Council- man Nation that Councilman Lake be appointed as Lynwood's Director on the Los Angeles County League for 1938-39. Reports of activities of the Police Department and of the City Court for month of May, 1938 were received; also health reports; also applications for employment from Ferinand Kakoska, Joe Dodson, and Richard Morgan. ORAL COMMUNICATIONS: Mr. Earl Summers addressed the Council on the matter of the complaint to be filed by Mr. Stewart in connection with application for reduction of Lighting rats on Street lamps, to the effect that he has the complaint and desired the Mayor to execute same which the May- or did, suggesting that someone be delegated to attend their next meeting prior to the League meeting to be held at Inglewood on June 16th, in the absence of Councilman Boster. Mayor Nation requested that Councilman Lake attend. s s.~ a.~ UNFINISHED BUSINESS: ORDINANCE N0. 296, entitled: "AN ORDINANCE OF THE CITY OF LYNWOOD, WAIVING CERTAIN DELINQUENT PENALTIES FOR THE NON-PAYMENT OF LIGHTING ASSES5MENT5, AND DECLARING AN EMERGENCY," was read. It was moved by Councilman Meyer and seconded by Councilman Lake that said ordinance be adopted as read the second time, finally pass and be published as required by law. Roll Call: Ayes: Councilmen Lake, Meyer and Nation. Noes: None. Absent: Councilmen Buster and Snyder. ORDINANCE N0. 297, entitled: "AN ORDINANCE OF' THE CITY OOUN- CIL OF THE CITY OF LYNWOOD, CALIFORNIA, VACATING, ABANDONING AND CLOSING THE ALLEY, ROADWAY, DRIVEWAY AND WALIC~VAY LOCATED UPON AND IMMEDIATELY TO THE EAST OF LOTS 113, 94, 130 and 148 IN TRACT ~?16, AS APPEARS OF RECORD IN BOOK 145 AT PAGES 63 AND 64 OF MAPS, IN THE OFFICE OF THE COUNTY RECORDER OF LOS ANGELES COUNTY, CALIFORNIA," was read. It was moved by Councilman Meyer and seconded by Councilman Lake that said Ordinance No. 297 be adopted as read the second time, finally pass and be published as required by law. Simpson .f or12.50 for alleged injuries to her child while playing on the Water Plant grounds at California .and Sanborn. Thereupon it was moved by Coun- cilman Meyer and seconded by Councilman Lake that the demand be al- lowed. Roll Call: Ayes: Councilmen Lake, Meyer and Nation. Noes: None. NEW BUSINESS: I~uO U 01~N0. 1112; entitled: "A RESOLUTION OF THE CITY OF LY2J~GOOD, CALIFORNIA, APPROVING BUDGET SUBMITTED BY THE CITY EN- GINEER FOR EXPENDITI7RE OF FUNDS ACCRUING TO THE CITY OF LYNWOOD FROM STATE HIGHPIAY GASOLINE TAX AND AUTHORIZING MAYOR TO EXECUTE AGREE- MENTS IN CONNECTION THEREWITH," was read. RESOLUTION NO. 1113, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF I,YNWOOD DECLARING ITS INTENTION TO ORDER STREET LIGHTING SERVICE ON CERTAIN STREETS IN THE CITY OF LYNWOOD FOR A PER== IOD BEGINNING JULY 1, 1938, AND ENDING JUNE 30TH, 1939," was read. It was moved by Councilman Lake and seconded by Councilman Meyer that said Resolution No. 1113 be adopted. Roll Call Ayes: Councilmen Meyer, Lake and Nation. Noes: None. Absent: Councilmen Buster and Snyder. A communication was received from F. D. Evans, Building In- spector to the effect that Fire Chief Lewis and himself have Checked into the application of United Truck Parts and Equipment for license to establish a wrecking establishment at the corner of Alameda Blvd. and Century Blvd. recommending that the petition be denied.. There- upon it was moved by Councilman L~a.ke and seconded by Councilman Meyer that permit be denied to said Company to establish a wrecking estab- lishment at said location and no license be issued therefor. All mem- bers of the Council present voting aye, the Mayor declared the motion duly carried. A communication was received from the Brown Crummer Company giving a list of bonds that they were selecting in Acquisitfc~n and Improvement District No. 19. There being no objection, the eommuniea- tion was ordered filed. The City Clerk was instructed to communicate with Council- man Boster on behalf of the City Council wishing him a speedy recovery from his illness. All who possible can were urged to attend. A communication was received from the City of ~6aywood, by the Mayor inviting the Council and City officials to attend the dedi- cation of their new City Hall Saturday afternoon, June 11th at 3:30 F.M. All were urged to attend. It was moved by Councilman Meyer and seconded by Councilman Lake that the meeting adjourn to June 14th, 1938, at 1 P.~~.
