Mayor Nation in the chair. Councilmen Lake, Meyer and Nation answered the roll call. Councilmen Boster and Snyder were absent. It was moved by Councilman Lake and seconded by Council- . man Meyer that the minutes of the previous regularmeeting of August 8th, 1938 be approved as written. All members of the Council present voting aye, tY~e Pdayor declared the motion duly carried and it was so ordered. WRITTEN COMMUNICATIOvS: A communication was received from the Los Angeles Post No. 8 announcing the first annual bathing beauty contest to be held at Redondo Beach on August 28th, 1938, inviting the Council to submit an entry on behalf of the City of Lynwood. There being no objection 'the communication was ordered filed. A communication was received from the California Munici- pal Utilities Association submittfg copy of report on Municipally owned utilities in California, also soliciting the city's member- ship. There being no objection, the Mayor ordered said communica- tion filed . A communication was received from the Western Safety Con- - ferenee to the effect that their organization is holding its Fourth Annual Convention from September 12-16, inclusive, at the Los Angeles Ambassador Hotel. There being no ob,jeetion, the Mayor a~- dered the Communication filed suggesting that if any one can pos- sibly attend that they do so; also recommending that the City Clerk call the meeting to the attention of the Chief of Police. A communication was received from Ulus C. and Grace C. Miller complaining against the City and weed burning crew as they burned their Evergreen Hedge in the rear of their property at 31f>4 Oakwood Ave. while burning weeds, requesting to be reimbursed for the damage. There being no objection, the matter was referred to Councilman Snyder for investigation and to secure all facts regal- ing the matter, and to caution those in charge of burning weeds to be more careful in the future . A communication was received from tYze California Munidi- pal Utilities Association announcing their annual convention at Santa Barbara on September 6, 7 and 8, 1938. There being no ob- ~jection, the Mayor ordered the comrnunica.tion filed. A eommunioation was received from the County Tax Col- lector, H. L. Byram, making demand upon the Honorable City Council to provide funds for the pa yment of all delinquent assessments t~ service delinquent 1915 Improvement Bonds for fiscal year 1937- 38, submitting a schedule of collections, delinquencies and charges. A demand was also received from County TaxCollector Byram that the City provide funds for the payment of all delinquent assessments for the improvement of Poplar Drive, etc. under Resolu- tion of Intention No. 123 and of the delinquent interest thereon as required by said Statute, either by the transfer of general funds to the interest and sinking funds of each of such districts or by the levy of tax in accordance with Section 16 of said Act. There being no objection, said communication from the County Tax Col- lector were ordered filed and no further action was taken thereon. A communication was received from the City Council of the City of South Gate submitting certified excerpts from the minutes of the City Council of South Gate ~F~herein they commend the Planning Commission and City Council of Lynwood for their evidence of inten- ti on to widen Ca.~ if ornia Ave in Lynwood to e onf orm to the width of the thoroughfare thru South Gate and to extend same across the right of way and tracks bf the Pacific Electric Railway Company so as to connect with Long Beach Blvd. There being no objection, said com- munication was ordered filed. A communication was received from Chief of Police 1tRiller recommending that Paul L. Coonrad.t be employed as Relief Officer to work as such during the balance of the vacation period of his De- partment or until such times as the new eligible list is available from the forthcoming examination, suggesting a salary of X120.00 per month. After due consideration of the matter, it was duly moved 3~y Councilman Meyer and seconded by Councilman Lake that Mr. Pia 1 L. Coonradt be employed as vacation relief officer in the Police De- partment at a salary of X110.00 per month. ~~~ Roll Call: Ayes : Councilmen Lake, Meyer and_ Nation . Noes: None. Absent: Councilmen Boster and. Snyder. At t~-is time Councilman Snyder arrived and took his seat at the Council table, at 8 P.~~:7. The hour of 8 P.M. having arrived, said time being the hour fixed for hearing of protests or objections to the proposed as- sessment for service necessary to maintain and illuminate the sus- pended electric Street Lamps and the Lamps on ornamental standards in the City of Lynwood, as publisried in the Lynwood Press and as posted along the district to be assessed therefor. The City Clerk sts.ted. that Affidavits of Posti ng and Pub- lication v+!ere on file in his office . The Mayor announced that this was the time and dace for said hearing, inquiring of the City Clerk whether or not any writ- ten objections or protests had been filed. Thereupon the City Clerk presented and read a letter from E. W. Hardin protesting to the installation of Street ornamental lights on Franklin Street. However. it was brought out that no ornamental lights are to be installed, but the hearing is for main- tenance of the lights already installed. A communication was received from A. E. Barbee and Vella 0. C. Barbee opposing the reinstallation of Street lights on Orchard Ave , east of L . B . Blvd . , alleging that taxes are high and that they do not need any street lights. Thereupon the Mayor inquired of the audience if there was any one present who wished to protest to said matter. Thereupon Mr. Brochardt on Lugo Ave. addressed the Coun- cil on the posters to the effect that the language is not clear and calledfor equipment as well as electric energy. PJIr. C . E. Thereupon the T-2ayesr explained that there are to be no ad- ditional lights installed and the rate is the same as for fiscal year 1937-38. Thereupon it was moved by Councilman Lake and seconded by Councilman Meyer that said Resolution No. 1143 be adopted. Roll Call: Ayes: Councilmen Lake, Meyer, Snyder and Nation. Noes: None. Absent: Councilman Boster. The hour of 8 P.i~.!I. having arrived, said time ~l.ng the hour fixed for continuing the herring in connection with protests or objections to the proposed reassessments in the matter of re- funding the indeb*edness of Acquisition and Improvement District No. 15 of the City of Lynwood. The Mayor inquired of the City Clerk whether or not any written objections or protests had. been filed. The Glerk stated that none had been filed. Whereupon the Mayor irgZired of the audience if there was any one present w'r~o wished to protest to the proposed reassessment. There vas no response. Thereupon it was moved by Councilman rJfeyer and seconded by Councilman Snyder that the hearing in connection with said matter be continued toAugust 25th, 1938, at 2 P.Td. All members of the Coun- cil present voting aye, the ~~ayor declared the motion carried. The hour of 8 P.P;~. having arrived, said time being the hour fixed for continuing the hearing in connection with hearing protests or objections to the proposed reassessments in the matter of refunding of the indebtedness of Acquisition and Improvement District No. 24 of the City of Lynwood. The Mayor inquired of the City Clerk whether or not any written objections or protests had been filed. The Clerk stated that none had been filed. Whereupon the ~~ayor inquired of the audience if there was any one present who wished to protest to the proposed reassess- ment. There was no response. Thereupon it was moved by Councilman Lake and secorri. ed by Councilman Snyder that the hearing in connection with said mat- ter be continued to August 25th, 1938, at 2 P.i~>?. All members of 301 the Council present voting aye, the £Nayor aleclared the motion duly carried and it was so ordered. A eommuni~a tion was received from the Lynwood Better Schools League, protesting the appointment of C. 0. Edington to the Lynwood Planning Comrnission, giving certain reasons therefor, requesting that the Council reconsider the matter and rescind their action. Mayor Nation inquired if there was any one present who wished to address the Council on the matter, but there was no response. Where- upon the MatrTor ordered tree communs~.tion filed. A communication was received in the form of Resolution from the Lynwood Better Schools League disapproving of the action of the City Council in endeavoring to force collection of Reassessments against certain school properties for clearing of Acquisition and Improvement Districts, alleging that the legality of said assessments is open to question and has never bean substantiated in Court. Mayor Nation inquired of the audience if there was any one present who wished to address the Council on said matter, but there was no re- sponse. Whereupon the Mayor ordered the communication filed. A report was received from Wm. Sullivan, registrar of un- employed; also application for employment from Martin Lorensen for position of I44echanic; also Everett Baker for employment on the Street Department; also report of the health department. There being no objection, the Mayor ordered said reports and applications filed. UNFINISHED BUSINESS: ORD NAN~GE N0. 299, entitled: "AN ORDINANCE OF THE CITY OF LYNWOOD, CALIFORNIA, PROHIBITING PUBLIC GAINING PLACES, OR GAI,~RIIJG IN PUBLIC PLACES, WITHIN THE CORPORATE LIMITS OF SAID CITY OF LYNWOOD, AND PRESCRIBING PENALTY FOR THE VIOLATION OF THE PROVISIONS THEREOF, AND REPEALII~?G ALL ORDI~?ANCES OR PARTS OF ORDINANCES INCONSISTENT HEREWITH," was read. Thereupon it was moved by Councilman Snyder and seconded by Councilman It4eyer that said Ordinance be adopted as read the second time,finally pass and be published as required by law. Roll Call: Ayes : Councilmen Lake, Iti4eyer, Snyder and Nation. Noes: None. Absent: Councilman Koster. I~'EW BUSINESS An Ordinance, entitled: "An Ordinance of the City of Lyn- wood fixing the rates of taxes and levying taxes for the fiscal year beginning July 1st, 1938 and ending June 30th, 1939", was introduced and read for the first time. Thereupon it was moved by Counoilman PNeyer and seconded by Councilman Lake that said Ordinan ce be ac- cepted as read the first time and pass to the second reading. Roll Call: Ayes: Councilmen Lake, Meyer, Snyder and Nation. Noes: None. Absent: Councilman Boater. RESOLUTION N0. 1144, entitled: "RESOLUTION OF THE CITY OF LYNWOOD, CALIFOR?~TIA, DIRECTING ATTORNEYS TO BRING LEGAL PROCEEDINGS", in connection with collection of reassessments in refunding the in- debtedness of Acquisition a~1.Improvement Districts Nos. 6, 8, 10, 19 and 25 and levied against Lynwood school properties, was read. Mayor Nation stated. that the Council regrets very much that they find it necessary to bring action in connection with said mat- ter, but that the School Koard have been appealed to several times, in connection with making payment thereof, but thus far have failed . to do so even though their legal advisors, the County Counsel's office have ruled that the claim is a legal one and it is mandatory that the School pay same. Mayor Nation also st~.ted that the City Council has permitted to be spent large sums of money to clear the PNattoon debt realizing that with this evil eliminated it will stimu- late tax collections, which has also increased collections for the school district and Y><~.s been a benefit above the reassessments that has been levied against their properties. Thereupon it was moved by Councilman Lake and seconded by Councilman Snyder that said Resolution No. .1144 be ad opted. Roll Call: Ayes: Councilmen Lake, Meyer, Snyder and Nation. Noes: None. Absent: Councilman Bolter. -- The budget for fiscal year 1938-39 was submitted, setting forth an anticipated revenue of X138,715,00 and Estimated Expenditures of X138,694.00 covering said period. Thereupon it was moved by Councilman Snyder and cecond.ed by Councilman Meyer that said budget be adopted as the official budget for the City of Lynwood covering general operations of the City for fiscal year beginning July 1st. ~~~ 1y38 and ending June 30th, 1939. Roll Call: Ayes: Councilmen Lake, Meyer, Snyder and Nation. Noes: None. Absent: Councilman Boster. It was moved by Councilman Meyer and seconded by Council- man Snyder that the office of Registrar of Unemployed now held by Wm. Sullivan be dispensed with to take effect on September 1st, 1938. Roll Call: Ayes: Councilmen Lake, Meyer, Snyder and. Nation. Noes: None. Absent: Councilman Boster. It was moved by Councilman Snyder and. seended by Council- man Lake that the salaries of Building Inspector Evans be increased from X150.00 per month to 160.00 per month and. of City Pdechanic Bert Dyer from X125.00 to 135.00 per month, to take effect Septem- ber 1st, 1938.
