A RESOLUTION APPROVING THE DECLARATION OF SHARED DETENTION
BASIN EASEMENT, THE CONSTRUCTION AND DEDICATION AGREEMENT AND
THE TEMPORARY CONSTRUCTION EASEMENT FOR THE DETENTION BASIN TO
BE CONSTRUCTED BY HAWK WASH LLC, IN THE TIFFIN CITY PARK
WHEREAS, Hawk Wash LLC, will be developing on the commercial lot as identified on
the attached site plan; and,
WHEREAS, Hawk Wash LLC, is required to comply with the City's stormwater
management plan; and,
WHEREAS, Hawk Wash LLC, has approached and discussed with the City to build a
detention facility in the Tiffin City Park to accommodate their stormwater needs and to
provide potential stormwater benefits to the City Park; and,
WHEREAS, in order to do the proposed detention basin, an easement and agreement
is required on property owned by the City of Tiffin; and,
WHEREAS, a public hearing on the said property declaration and dedication was held
on the 4t" day of April, 2023, pursuant to the notice published as required by law; and,
WHEREAS, this Council, having heard all comments for and against said easement
conveyance, declaration and dedication, determines that the attached agreements for
the detention basin should be approved.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Tiffin, Iowa,
approves the declaration of shared detention basin easement, the construction and
dedication agreement and the temporary construction easement for the detention basin
to be constructed by Hawk Wash LLC, in the Tiffin City Park.
BE IT FURTHER RESOLVED that the Mayor and City Clerk are hereby authorized and
directed to execute aforesaid easements and agreements with Hawk Wash LLC.
On the 4th day of April, 2023, at a regular meeting of the Tiffin City Council, Tiffin, Iowa,
Councilperson Limkemann introduced RESOLUTION NO. 2023-022, A RESOLUTION
APPROVING THE DECLARATION OF SHARED DETENTION BASIN EASEMENT,
THE CONSTRUCTION AND DEDICATION AGREEMENT AND THE TEMPORARY
CONSTRUCTION EASEMENT FOR THE DETENTION BASIN TO BE
CONSTRUCTED BY HAWK WASH LLC, IN THE TIFFIN CITY PARK
and made a motion for approval. Motion seconded by Councilperson Havens.
Ayes: Orris, Schnedler, Limkemann, Havens, Olney.
Nays: None.
Absent: None.
Whereupon five Council members were present and voted approval and Mayor Berner
declared that RESOLUTION NO. 2023-022, A RESOLUTION APPROVING THE
DECLARATION OF SHARED DETENTION BASIN EASEMENT, THE
CONSTRUCTION AND DEDICATION AGREEMENT AND THE TEMPORARY
CONSTRUCTION EASEMENT FOR THE DETENTION BASIN TO BE
CONSTRUCTED BY HAWK WASH LLC, IN THE TIFFIN CITY PARK
to be adopted and signified his approval of the same by affixing his signature thereto.
Passed by the City Council this 4th day of April, 2023.
