HomeMy Public PortalAboutM 1939-04-18 - CC3~~ 1 REGULAR MEETING APRIL 18, 1939. ~- The City Council of the City of Lynwood met in a regular session in the Council Chamber of the City Hall, 11331 Plaza Street, on above date, at 7:30 P.M. Mayor Nation in the chair. . Councilmen Christensen, F~eyer, Snyder and Nation answer- the roll call. Councilman Lake was absent. It was moved by Councilman Snyder and seconded by Coun- cilman Meyer that the minutes of the previous regular meeting `of April 4, 1939 be approved as written. All members of the Council present voting aye, the Mayor declared the motion duly carried and it was so ordered. WRITTEN COMMUNICATIONS: A communication was received from Ralph C. Dills, Assembly- man acknowledging receipt of letters of March 23 and. April 6, giv- ing the Council's reaction to certain legislation now pending in the State Legislature requesting him to oppose and favor certain bills, thanking for the Gity's suggestions. There being no objec- tion said communication was ordered filed. A communication was received from R. W. Kenny, Senator of L. A. County acknowledging receipt of letters from City Council of Lynwood regarding proposed Legislation. There being no ob~ec- tion, said communication was ordered filed. A communication was received from W. P. Mahood, Secre- tart' of L. A. County League of Municipalities announcing their next meeting to be held on April 20, 1939 in the City of Hermosa Beach at the Municipal Park Auditorium on West Railroad Drive, at 6:30 P. M., when the program will consist of an open forum. All who possibly can were requested to attend and the communication was ordered filed. A communication was received from Irving P. Austin, Treas- urer of the Harbor District Chambers of Commerce, thanking for membership fee. of the City of Lynwood, stating that they shall be glad.ta cooperate in any matter that. they can. There being no objection, said communication was ordered. filed. A communication was received from E. W. Lewis, Fire Chief, stating that Ralph Johnson has been suspended from services as nightmare, and B. J. Terry has resigned, making it necessary to appoint two new men in the person of T. G. Williams and H. I. White with the approval of Commissioner Snyder. Thereupon it was moved by Councilman Meyer and seconded by Councilman Christensen that said appointments be ratified by the City Council. Roll Call: Ayes: Councilmen Christensen, Meyer, Snyder. and Nation. Noes: None. Absent: Councilman Lake. A communication was received from the Lynwood New Deal Democratic Club to the effect that approximately X40,000 has been taken from the Water Department for use in defraying other ex- penses of the-City-government, requesting an expression from the Council as to whether or not it is their intention of the Council to return this money to the Water Department. There being no ob- . ejection, said communication ,was ordered filed suggesting that any one interested can secure information regarding transfers from the City Clerk or City Treasurer's office, and no further action was taken. A communication was received from the Associated Assess- -- ment Engineers, by Basil R. Greig, offering their assistance in connection with clearing Lynwood's "1915 Act" districts, stating that they have been maintaining to assist in the matter of clear- ing 50,000 parcels of property involving an outstanding debt of more than X5,000,000 in the past eighteen months, being for refund- ing Mattoon Act districts and Improvement Bond Acts of 1915 dis- tricts. There being no objection, said m~.tter was referred to Mr. R. A. Moffitt to check into and report his findings to the City Council at their next meeting. A communication was received from J. S. Biddle making application for a permit to operate an aluminum foundry at 11327 S. Atlantic Blvd., in a building that was formerly occupied by a sheet metal works, and while foundries generally fall under the classification of light manufacturing, however, in this case all products are made to specified orders. There being no objection, _ said matter was referred to Building Inspector Evens with instruc- tions that he check into the matter and report his findings at the next meeting of the City Council. ~' A communication was received from the University of Sou- thern California School of Government announcing the Eleventh An- nual Institute of Government which will be held on the campus of the University of Southern California on June 12-16, inclusive, 1939, offering transferrable memberships which are available at X25.00 and non-transferable memberships which may be purchased by individuals. There being no objection, said communication was or- dered filed with the suggestion that the City Clerk .post the notice accompanying the letter and that all department and employees take an active part in said school course. A communication was received from the Railroad Commission of the State of California reporting on the matter of the applica- tion of Pacific Electric Railway Company for an order granting per- mission to increase and adjust passenger rates and fares for the transportation of persons between points in the State of California, announcing that.the hearing was ontinued to Wednesday, May 17th, 1939, at 10 A. M. in the Court Room of the Railroad Commission lo- cated on the seventh floor of the State Building in Los Angeles. There being no objection, said matter was referred to the .attention of the City Attorney and City Engineer with instructions to attend said hearing. A communication was received from J. H. Osterhandt, Ad- ,jutant of the American Legion in regards to the petition being cir- culated through the City, prohibiting the sale of fireworks and firecrackers through th.e City, the post does not feel as they can sign the petition at .this time as they have already contracted for several hundred dollars worth to yell this year. Petitions were also received from the following organ- izations requesting that the sale of fireworks in the City of Lyn- wood be. prohibited because of the danger to limb and life; also the use of same be prohibited by proper ordinance and to do so im- mediately so that the same may be effective for the Independence Day celebration this year: Lynwood Woman's Club Juniors, Homemakers Club, Lynwood Ebell Club, Lynwood Junior High P. T. A. Washington. School P. T. A., Abraham Lincoln P. T. A. Lindbergh P. T. A., Woodrow Wilson P. T. A., Lynwood Exchange.Club, W. C. T. U., Lynwood Democratic Club, Central Gardens Woman's Club and Community M. E. Church. Mayor N~Lon spoke on the matter to the effect that he has been informed that the American Legion are favorable to such ordin- ance after the 4th of July of this year, as they have already con- tracted for supplies covering this year and therefore a ban on fire- works would be a_great financial loss to them, stating that it may be advisable to permit operations as heretofore and after this year prohibit same. ~,4r. Crew Waite addressed the Council. in favor of prohib- iting the sale of fireworks as he, believes that the organizations who have presented the petitions is a good cross section df the populace of the City of Lynwood, and that if the sale of fire works.. was prohibited the Legion could always cancel their order for fire crackers and fireworks without a financial loss. Mr. Waite also brought out the matter of saving life and limbs and that a few dollars earned could not repay for those who may become maimed for life on account of permitting the sale of firecrackers and fireworks. After due consideration of the matter, the matter was taken under advisement and tabled until a future meeting of the Council. A communication was received from the Housing Author- ity of the County of Los Angeles with Resolution attached in con- nection with a proposed survey for the County of Los Angeles by the 9t'. P. A., which survey would furnish data that will be of value to every self-governing localities within the County, stating that every house in the County would be surveyed, after which a full set of maps and report from their office will be furnished the City upon completion which would provide information as to residential structures and dwelling units, which will be summarized by blocks and also tabulated and analyzed. for economic areas for localities, showing the type and construction of all dwellings, their condi- tion and age, whether they need major or minor repairs, presence or absence of modern conveniences, such as plumbing, heating, inr door toilets, bath, running water, etc., stating that there would be no expense to the City of Lynwood. 3!~ Thereupon RESOLUTION N0. 1173, entitled: "A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF LYI\?WOOD AUTHORIZING A REAL PROPERTY SURVEY WITHIN THE CITY LILIITS OF THE CITY OF LYN'NOOD BY THE COUNTY OF LOS ANGELES" was read. It was moved by Councilman Meyer and seconded by Councilman Christensen that said Resolution No. 1171 be adopted. Roll Call Ayes: Councilmen Christensen, Meyer, Snyder and Nation. Nods: None. Absent: Councilman Lake. A Legislative bulletin was received from the League of California b4unicipalities reporting on proposed legislation now pending in the State Legislature. There being no objection, said cpmmunieation was ordered filed. Applications for employment were received from Earl A. Barbee and Lloyd William Pitzer;,also realth reports for weeks ending April 1 and 9th, 1939. There being no objection, said ap- plications and reports were ordered filed. ORAL COMMUNICATIONS: Mr. leary addressed the Council on the matter of trans- portation for the citizens in the Atlantic Blvd. district, set- tang forth how difficult it is for the citizens in said area to do. their shopping where they have no automobile accommodations, or where the husband uses same for his work and the wife is left stranded on account of no transportation facilities, requesting that some effort be put forth along said line. Mayor Nation stated that more adequate transportation is one of the needs of the City of Lynwood, therefore suggesting that those present who represent the Exchange Club, Rotary Club and Amer~.can Legion take the matter up with their organization and see if something cannot. be accomplished along the line of furnishing better transportation for the City. Mr. Russell Caley addressed the Council regarding Section 8 of the Nuisance Ordinance which deals with the storage of trucks etc. on vacant property, stating that if it is left as is it would force him to move, thereby eliminating his operations here consisting of 15 men who are employed by him and spend their money here, stating that he has resided at his present location for the last 12 years, stating that many people move out to Lyn- wood as they have some freedom here. Mr. Tom Wheatly also addressed the Council on the matter to the effect that he deems that said section is too drastic to meet present needs. bor. Harry Lund also addressed, the Council setting forth the same opinion and that he believes that said section should be modified. Mr. Floyd Rowlee addressed the Council also regarding Section 8 of said Ordinance, stating that he has been interested in zoning for some time and while of course zoning is bound to work a hardship on some people, stating that he believes that said Section of said Ordinance is a good one and should be left as is in order to eliminate businesses in residential areas as itt~ends to decrease value of real estate adjacent and across the street therefrom, stating further that the restrictions in the Deed in said Tract No. 6554 where Mr. Caley's property.is located pro- hibits the operation of any business therein. Mr. H. E. Zeiler also addressed the Council in favor of said Section'to the effect that a person cannot sell a Lot next to places where a storage .yard is maintained in the residential area and that no one wants to build a home next to such places. Mr. Cleary addressed the Council on the part of the nui- sance ordinance dealing with chickens and the distance, believing that 30 feet from a residence is too far a distance to keep chick- ens from some one elses residence, especially where the Lot is a small one. Mr. Cleary was informed that this provision was in the old ordinance and did not work any hardship on residents. No action was taken on the Nuisance Ordinance, but the suggestions were taken under advisement. Mr. Humphrey addressed the Council on the matter of green zone that has been painted in front of his shop, stating that it has hurt his business, protesting same and requesting that same be changed. There being no objection, the I~Ra.yor was requested by .Commissioner Meyer to have said curb changed to its natural state thereby eliminating a time limit at said point. '~7 UNFINISHED BUSINESS: iZ'~ty Attorney u y reported in writing on the matter of securing a favorable agreement in connection with scquiring title to Lot A, Tract 5103 owned by Per. Burr who is proposing to turn over his water system in said Tract to the City of Lynwood, Mr. Ruby advising that T44r. Burr wishes X200.00 cash for same or X25©.00 if paid in a year's time, said Lot being ,40x100, stating that Eng- ineer Bateman recommends the puchase of same as it is needed in the opening of Pendelton Avenue to eliminate a ,jog therein. Thereupon it was moved by Councilman Snyder and seconded by Councilman Chris- tensen that said offer be accepted and that a warrant be drawn on the City Treasurer for the purchase price of $200.00. The matter of lamp contract°for furnishing mazada lamps for use by the City of Lynwood, was brought up for consideration, City Engineer Bateman recommending that we enter into a contract with the Lynwood Elec. Co. as per their offer of r~4arch~6th, 1939. Thereupon it was moved by Councilman Snyder and seconded by Council- man Meyer that said contract be accepted and that the Mayor be auth- orized to execute same for and on behalf of the City of Lynwood. Roll Call: Ayes: Councilmen Christensen, Ivieyer, Snyder and Nation. Noes: None. Absent: Councilman Lake. NE`~~G BUSINESS A communication was received from the Lynwood Planning Commission stating that they recommend the appointment of Mrs. Grace Gulick as Secretary of the Planning Commission. Thereupon it was moved by Councilman Snyder and seconded by Councilman "deyer that Dlirs. Grace Gulick be employed as Secretary of the Planning Commission at a salary of X10.00 per month. Roll Call: Ayes: Councilmen Christensen, Snyder, Meyer and Nation. Noes: None. Absent: Councilman Lake. A communication was received from the Lynwood Planning Commission recommending that the Council check into the matter of building on 25 foot Lots in the City, to ascertain to -dust what degrees 25 foot lots may be responsible for apparent lack of inter- est in development of the Section lyin g north to Century Boule- vard in Mod,jeska Park Tract. This matter was taken under advis- ment. A communication was received from the Lynwood Planning Commission st~.ting that the subdividing of property to be known as Tract 11912 in Lot 4 of Uposton Tract was submitted to their Hon- orable Body on April 10, 1939, and that the subdivision was approv- ed by the Commission, however, the proviso was made that in the event of the Council's acceptance they should check into said matter. There being no objection, said matter was accepted and the commun- ication was ordered filed, and the City Attorney was instructed to check into the matter of race restrictions in connection with Tracts heretofore approved. . A communica°tion was received from the Planning Commission regarding the matter of beautifying of the City, suggesting that a definite and continued interest in an "all-year" program be insti- tuted. There being no objection, said matter was ordered filed and the°Mayor was requested to issue proper proclamation regarding the matter. A communication was received from the Lynwood Planning Commission recommending that the iron pipes now fastened to the street lamps standards on Long Beach Blvd. be removed as they are very unsightly. There being no objection the matter was referred to th°e Street Commissioner with instructions to have the iron pipes removed as suggested. A communication was received from the Lynwood Planning Commission recommending that the City Council zone both frontages on Fernwood Ave. from State Street to Bullis Road into Zone R3. There being no objection, said communication was ordered filed un- ti'1 the Ordinance creating Zone R-3 is in effect. A communication was received from the Lynwood Planning Commission recommending that the City Council have special Council Robert ~v'Ioffitt check into the matter of acquiring a suitable park 3'~5 site by buying up taxes on a tract of land. Thereupon it was'moved by Councilman Meyer and seconded by Councilman Snyder that Mr. ft?offitt be instructed to check into the matter. All members of the Council present voting aye, the Mayor declared the motion duly carried. A report and findings was received from the Lynwood Plan- ning Commission recommending that the City Planning Commission of the City of Lynwood, Galifornia, in regard to the proceedings upon -the petition of Southern California Association of Seventh Day Adventists, a Corporation, asking for modification of the restric- tions in Zone RI on a certain parcel of land, which finds that hearing was held according to law and that the proceedings held were according to law and that the public convenience and necessity will be best served by said action and that .such action will not be to the disadvantage of any person whomsoever or to the detriment of . any property whatsoever, recommending passage and adoption of an Ordinance in connection therewith. Thereupon an Ordinance, entitled: "An Ordinance~of the City of Lynwood, California, PJlodifying the Restrictions and regu- lations of zone RI in Section 7 of Ordinance No:~285 of the City of Lynwood, California, in respect to certain l~.nd5", was intro- duced and read by caption. Thereupon it was moved by Councilman Meyer .and seconded by Councilman Christensen that the further reading of said proposed ordinance be waived. All members of•the Council present voting aye, the Mayor declared the motion duly carried. Thereupon it was moved by Councilman Meyer and seconded by Councilman Snyder that said Ordinance be accepted as read the first time and pass to the second reading. RESOLUTION N0. 1172, entitled: "RESOLUTION RELATING TO THE ABATEn.?ENT OF DRY AND DRYING WEEDS ON CERTAIN LOTS OF LAND IN THE CITY OF LYNWOOD UNDER ACT N0. 5197 OF THE LEGISLATURE OF THE STATE OF CALIFORNIA, AS AMENDED, ENTITLED: "AN ACT AUTHORIZING PdIUNICIPALITIES TO DECLARED NOXIOUS OR DANGEROUS WEEDS GROWING UP- ON THE STREETS OR SIDEWALKS, OR UPON PRIVATE PROPERTY WITHIN MUNICIPALITIES, TO BE A PUBLIC NUISANCE, CREATING A LIEN UPON THE PROPERTY FRONTING UPON SUCH STREETS OR SIDEWALKS OR UPON WHICH SUCH NUISA~TCE EXISTS FOR THE COST OF ABATING THE SAME, "APPROVED MAY 26, 1915'," was read.
