HomeMy Public PortalAbout2011.025 - LRA (05-03-11) RESOLUTION NO. 2011.025 A RESOLUTION OF THE CITY OF LYNWOOD REDEVELOPMENT AGENCY APPROVING AN APPROPRIATION OF FUNDS AND AN AGREEMENT WITH GANNETT FLEMING (GF) FOR CONSULTING SERVICES IN CONNECTION WITH THE ALAMEDA TRIANGLE PROJECT IN SUPPORT OF THE DEVELOPMENT OF A REMEDIAL ACTION PLAN (RAP) WHEREAS, Agency desires to utilize the services of Gannett Fleming as an independent contractor to provide consulting services to Agency as set forth in the attached Scope of Work (Exhibit A) and investigative services provided in connection with the Alameda Triangle Project in support of the development of a Remedial Action Plan. The work is being completed under the Polanco Redevelopment Act and pursuant to the guidelines set forth in the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA). Accordingly, the Agency plans to recover such response costs under a Polanco Cost Recovery Action; and WHEREAS, Gannett Fleming represents that it is fully qualified to perForm such consulting services by virtue of its experience and the training, education and expertise of its principals and employees; and WHEREAS, Gannett Fleming has been providing such services to the Agency commencing in January 2011 and is uniquely qualified to provide said services to the Agency in part due to contractor's in depth knowledge of environmental conditions within the Project Area around the Alameda Triangle Project as well the Alameda Triangle Project itself; and WHEREAS, a 4/5 vote of the Agency is required to enter this Agreement with Gannett Fleming without soliciting requests for proposals and receiving bids for the services the existing consultant is currently providing. WHEREAS, Gannett Fleming is part of an environmental team that has been actively engaged in cost recovery efforts under the Polanco Redevelopment Act in efforts to recover response costs incurred by the Agency in relation to the Alameda Triangle Project; and WHEREAS, Gannett Fleming has requested a budget authorization of $160,000 to cover service fees associated with the attached Agreement that are not anticipated to be covered through Brownfield funding for FY 2010 — 2011. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF LYNWOOD DOES HEREBY FIND, DETERMINE, ORDER AND RESOLVE AS FOLLOWS: Section 1. The Agency authorizes the use of $160,000 of FY 2010 -2011 appropriated Redevelopment Project Area funds to cover environmental consulting fees for services provided in connection with the Alameda Triangle Project in support of the development of a Remedial Action Plan, under the attached Agreement with Gannett Fleming and hereby approves said Agreement retroactive to January 2011. Section 2. The Agency Board hereby authorizes the Executive Director or his designee to take necessary steps, including the execution of agreements and other related documents with Gannett Fleming to undertake the implementation of the all related services under the attached Agreement and Scope of Work. Section 3. This Resolution shall become effective immediately upon its adoption.
