ORDINANCE NO . 22
AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE NO . 201 OF
THE VILLAGE OF MCCALL RELATING TO SEWER USES ; ESTABLISHING
CLASSIFICATION OF SEWER USES ; AMENDING SECTION NO . 2 OF
ORDINANCE NO . 201 OF THE VILLAGE OF McCALL RELATING TO
SEWER CHARGES BY ESTABLISHING MONTHLY RATES FOR SAID
SEWER USES ; PROVIDING THAT SUCH CHARGES FUR SUCH SEWER
USES SHALL bE BILLED DIRECTLY TO THE RECORD TITLE HOLDER
OF THE PREMISES TO wHICH SUCH SEWER SERVICE IS FURNISHED ;,
PROVIDING THAT UNPAID CHARGES FOR SEWER SERVICE SHALL, BE
CERTIFIED TO THE COUHHTY TAX COLLECTOR AND COUNTY AUDITOR
AND THAT SUCH UNPAID CHARGES SHALE, BECOME A LIEN UPON THE
PREMISES TO WHICH SUCH SERVICES WERE FURNISHED AND PRO -
ViDING THAT SUCE CHARGES SHALL, BE COLLECTED 1N THE MANNER
PROVIDED 3Y LAW FOR COLLECTION OF STATE AND COUNTY TAXES ;
PROVIDING A SEVERABILITY CLAUSE ; AND PROVIDING AN EFFEC -
TIVE DATE .
NOW , THEREFORE , BE IT ORDAINED BY THE CHAIRMAN AND THE
BOARD . OF TRUSTEES OF . THE VILLAGE OF McCALL , IDAHO :
Section 1 . That section 1 of Ordinance No . 201 of the
Village of McCall be , and the same hereby is ,
amended to read as follows , to -wit :
That all uses of the sewer system of the Village
of McCall are hereby classified as follows :
Class A . Private residences , arid institutional .
Class Bo All other uses .
Section 2 . That section 2 of Ordinance No . 201 of the
Village of McCall , be , and the same is hereby
amended to read as follows , to -wit :
That the said Village shall charge and the
user shall pay monthly for said sewer service
the following rates , to -wit :
For each class A use , , 2 . 00 per month ;;
For each class B use , $ 2 . 00 per month or 60%
o f the charges for Village water service ,
whichever is greater .
Section 3 . From and after the effective date of this
ordinance all charges for sewer service
furnished by the Village of McCall , Idaho ,
shall be billed directly to the record title
holder of the premises to which the sewer ser -
vice is furnished , according to the official
✓ ecords in the office of the Recorder of
Valley County , Idaho .
Section L On or before the 3rd Monday of September of
e ach year the Chairman and. Clerk of this Board
are hereby ordered and directed to certify all
unpaid sewer service charges together with a
legal description of the premises to which such
sewer service was furnished , to the Tax Collec -
tor and the .Auditor of Valley County , Idaho ,
the same to be charged against such premises
and to become a lien thereon , ana the same to
be collected in the manner provided by law for
collection of State and County taxes in Valley
County , Idaho .
Section 5 . Each section , sub - section , provision or regur
lation established by this ordinance or any
manedment thereto , is hereby declared to be
independent and the holding of any part to be
unconstitutional , invalid or ineffective for
any cause shall not affect nor render invalid
the ordinance or amendments thereto as a whole
or any part thereof except the particular parts
so declared to be invalid .
Section 6 . This ordinance shall be in full force and
effect from and after January 1 , 1963 , upon
its passage , approval and publications as
required by law .
