AN ORDINANCE RELATING TO CHARGES FOR WATER SERVICE FUR-
NISHED BY THE VILLAGE OF McCALL; PROVIDING THAT SUCH
CHARGES FOR SUCH WATER SERVICE SHALL BE BIT,T,F,D DIRECTLY
TO THE RECORD TITLE HOLDER OF THE PREMISES TO wHICH SUCH
SERVICE IS FURNISHED; PROVIDING THAT UNPAID CHARGES FOR
WATER SERVICE SHALL BE CERTIFIED TO THE COUNTY TAX COL-
LECTOR AND COUNTY AUDITOR AND THAT SUCH UNPAID CHARGES
SHALL BECOME A LIEN UPON THE PREMISES TO WHICH SUCH SER-
VICES WERE FURNISHED; PROVIDING THAT SUCH CHARGES SHALL
BE COLLECTED IN THE MANNER PROVIDED BY LAW FOR COLLECTION
OF STATE AND COUNTY TAXES; PROVIDING THAT THE VILLAGE RE-
TAIN ITS RIGHT TO DISCONTINUE WATER SERVICE FOR NON-PAY-
MENT OF WATER CHARGES; PROVIDING A SEVERALABILITY CLAUSE;
AND PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE CHAIRMAN AND THE
BOARD OF TRUSTEES OF THE VILLAGE OF McCALL, IDAHO:.
Section 1. That from and after the effective date of
this ordinance all charges for water service
furnished by the Village of McCall, Idaho,
shall be billed directly to the record title
holder of the premises to which such water
service is furnished, according to the
official records in the office of the Recorder
of Valley County, Idaho.
Section 2. On or before the 3rd Monday of September of
each year the Chairman and Clerk of this Board
are hereby ordered and directed to certify all
unpaid water charges together with a legal de-
scription of the premises to which such water
service was furnished, to the Tax Collector
and the Auditor of Valley County, Idaho, the
same to be charged against such premises and
to become a lien thereon, and the same to be
collected in the manner provided by law for
collection of State and County taxes in Valley
County, Idaho.
Section 3. Nothing in this ordinance shall be construed
as modifying or replealing the right or obli-
gation of the Village to discontinue water
service for non-payment of water charges a
required by Section of Ordinance No. /e5
of the Village of McCall, which ordinance
authorized the issuance of water revenue bonds
of the Village of McCall.
Section 4. Each section, sub-section, provision or regu-
lation established by this ordinance or any
amendment thereto, is hereby declared to be in-
dependent and the holding of any part to be un-
constitutional, invalid or ineffective for any
cause shall not affect nor render invalid the
ordinance or amendments thereto as a whole or
any part thereof except the particular parts
so declared to be invalid.
Section This ordinance shall be in full force and
effect upon its passage , approval and. publica
Lion as required by law from and after January 1 , 1963 .
