HomeMy Public PortalAboutOrd. 256 - Licensing Dance HallsI VILLAGE OF McCALL ORDINANCE NO. 256 AN ORDINANCE LICENSING DANCE HALLS ; PROVIDING FOR AN APPLICATION THEREFOR; PROVIDING QUALIFICATIONS OF LI- CENSEE; PROVIDING FOR REFUSAL TO ISSUE LICENSES ; PRO- VIDING EXEMPTIONS FROM THIS ORDINANCE; PROVIDING A LICENSE FEE; PROVIDING FOR REVOCATION OF LICENSES ; AND PROVIDING A PENALTY. BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF TRUSTEES OF McCALL, IDAHO: Section 1. LICENSES : It shall be unlawful for the owner, or person in charge of any premises , except residences occu- pied exclusively for dwelling purposes , to permit, allow or conduct any dancing therein, unless a dance license has been issued for such premises as in this ordinance provided. Section 2. APPLICATION: Each applicant for a dance license shall make application to the Chairman of the Board of Trustees upon a form to be furnished by the Village Clerk, which forms shall require that the applicant show the name, residence and duration of residence within the Village, and citizenship of the applicant, the location of the premises for which the application is made and the principal business , and any other business , to be conducted at said premises ; provided however, that no license shall be issued to any person who has not been a resident of the Village of McCall for at least ninety (90) days prior to the making of such application. Section 3. REFUSAL TO ISSUE LICENSE: The Board of Trustees may refuse to issue a dance hall license to any person not meeting the requirements hereinabove set forth, and may further refuse to issue such license to any person who or for any premises which in the judgment of the Board of Trustees is not suitable for the conduct of dances , or the teaching of dances at such premises. If the Board of Trustees shall so order, the Clerk shall issue the approp- riate license upon payment of the license fee of $20.00 per calendar year, or any portion thereof; that no license shall be required for dances conducted by any church, church school, McCall School District or any licenses liquor estab- lishment within the Village of McCall, Idaho. Section 4. LICENSES ; REVOCATION: The Board of Trustees reserves the right to cancel and revoke any license issued under this ordinance, at any time, when in the opinion of the Board of Trustees , the licensee is conducting a disorderly, indecent or disreputable place of business under such license. Section 5 . PENALTY: Any person violating any of the provisions of this Chapter shall be deemed guilty of a mis- demeanor and upon conviction thereof shall be punishable by a fine not to exceed $100.00, or imprisonment for 30 days , or both such fine and imprisonment.
