Councilman Presents the following Ordinance Seconded by Councilman
ORDINANCE OF THE BOROUGH OF CARTERET, IN THE COUNTY
OF MIDDLESEX, AMENDING THE REDEVELOPMENT PLAN FOR
THE MIDDLESEX AVENUE REDEVELOPMENT AREA
WHEREAS, on August 11, 2005, the Borough Council (the "Borough Council ") of the
Borough of Carteret (the "Borough ", following the recommendation of the Borough Planning
Board (the 'Planing Board "), adopted resolution number 05 -246, designating the properties
identified as Block 242, Lots 1, 2, 3 and 5 on the tax map of the Borough (the "Redevelopment
Area ") as an "area in need of redevelopment" under the Local Redevelopment and Housing Law,
N.M.A. 40A:12A -1 etseg. ( the "Redevelopment Law"); and
WHEREAS, on December 15, 2005, the Borough Council, pursuant to Section 7 of the
Redevelopment Law (N.J.S.A. 40A:12A -7) and based on the recommendation of the Planning
Board, adopted ordinance number 05 -62, approving and adopting a redevelopment plan, dated
October 4, 2005, for the Middlesex Avenue Redevelopment Area (the "Redevelopment Plait');
and
WHEREAS, February 21, 2008, the Borough Council adopted ordinance number 08 -04
approving and adopting amendments to the Redevelopment Plan, to expand the Plan
Interpretation to provide for short-term temporary uses that will advance other redevelopment
projects in the Borough, to permit limited, fight industrial uses, on a temporary basis, in the
Redevelopment Area, and to amend the prohibited uses to reflect such temporary, limited, fight
industrial uses in the Redevelopment Area; and
WHEREAS, the Borough has caused to be prepared additional amendments to the
Redevelopment Plan, which amendments me attached hereto as Exhibit A (the "Additional
Amendments "), and, pursuant to the Redevelopment Law, the Planning Board considered such
Additional Amendments; and
WHEREAS, the Planning Board found and concluded that the Additional Amendments
are not inconsistent with the Borough's Master Plan or the Master Plans of Woodbridge, Rahway
and Linden, the Middlesex County Master Plan or the State Development and Redevelopment
Plan, and endorsed and recommended final adoption of the Additional Amendments; and
WHEREAS, the Borough CouncH hereby finds that the Additional Amendment are in
the best interest of the Borough and now desires to adopt the Additional Amendments.
NOW, THEREFORE, BE IT ORDAINED by the Mayor and Council of the Borough
of Carteret as follows:
1. The aforementioned recitals are incorporated herein as though fully set forth at length.
2. The Additional Amendments to the Middlesex Avenue Redevelopment Plan, attached
hereto as Exhibit A and made a part hereof, are hereby approved pursuant to N.J.S.A. 40A: 12A-
7.

3. The sections of the Zoning Map of the Borough that relate to the Redevelopment Area
are hereby amended to incorporate & provisions of the Amendment Amendments.
4. This Ordinance shall take effect in accordance with applicable law.
5. Upon final adoption hereof, the Borough Clerk shall forward a certified copy of this
Ordinance to Special Redevelopment Counsel to the Borough, McManimon & Scotland, L.L.C.,
