ORDINANCE NO. 261
AN ORDINANCE AMENDING CHAPTER 2 OF TITLE V OF
THE VILLAGE CODE OF McCALL, IDAHO, RELATING TO
NUISANCES, BY ADDING A NEW SECTION THERETO, TO
BE DESIGNATED AS SECTION 5-2-7, PROVIDING FOR
ASSESSMENT OF THE COST OF ABATEMENT OF A NUIS-
ANCE AGAINST THE PROPERTY INVOLVED OR MAKING
THE AUTHOR OF THE NUISANCE LIABLE FOR COST OF
ABATEMENT THEREOF IN A CIVIL ACTION.
BE IT ORDAINED BY THE CHAIRMAN AND BOARD OF
TRUSTEES OF THE VILLAGE OF McCALL, IDAHO:
Section 1. That Chapter 2 of Title V of the Village
Code of McCall, Idaho, be and the same is hereby amended
by adding a new section thereto to be known and designated
as Section 5-2-7, which said section shall read as follows :
Section 5-2-7. COST OF ABATEMENT OF NUISANCE:
In the event the author of a nuisance fails , refuses
or neglects to abate the same after notice in writing
thereof as provided in this chapter, the Board of
Trustees may cause such nuisance to be abated and the
cost of abating such nuisance may be assessed against
the property upon which such nuisance is maintained or
such cost may be recovered in a civil action from the
author thereof.
