ORDINANCE NO. 266
AN ORDINANCE AMENDING CHAPTER 3 OF TITLE V OF THE
VILLAGE CODE OF McCALL, IDAHO, RELATING TO FIRE-
WORKS; DEFINING "SAFE AND SANE FIREWORKS" ; MAKING
IT LAWFUL TO SELL AND USE SUCH FIREWORKS DURING
DESIGNATED TIMES; AND REPEALING ORDINANCES OR PARTS
THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY
OF McCALL, IDAHO, AS FOLLOWS :
Section 1. That Chapter 3 of Title V of the Village Code
of McCall, Idaho, be and the same is hereby amended to read
as follows :
5-3-1: FIREWORKS PROHIBITED: It shall be unlawful for
any person to have in his possession, either for sale or for
use by himself, any Pyrotechnic device commonly known as
fireworks , except as hereinafter set forth.

5-3-2 : EXCEPTIONS: Any' recongnized civic or local
organization may make application to the City Council for
a special permit for a fireworks display to be held in
connection with a National Holiday or any special local
event. Such application shall be made in writing to the
Clerk who shall present said application to the City Coun-
cil for its action. The Mayor and Council shall make such
investigation as deemed necessary and may issue a permit
subject to any special provisions deemed necessary. Such
permit shall not be of a continuing nature but shall be
exclusive to the one time only for which it is issued.
Sale at retail and the use of "safe and sane fire-
works" as herein described shall be lawful from the 20th
day of June .thru the 6th day of July of each year. "Safe
and Sane Fireworks" includes any of the following:
(a) Cone fountains with pyrotechnic composition
not exceeding fifty (50) grams each;
(b) Cylindrical fountains , whether base, spike
or handle, with pyrotechnic composition: not
exceeding seventy-five ( 75) grams each and in-
side tube diameter not exceeding three-quarters
(4) inch;
(c) Sparklers and "dipped sticks" not more than
ten (10) inches in length or one-quarter (%)
inch in diameter made on steel or iron wire and
Suzuki and Morning Glories with pyrotechnic
composition not exceeding four (4) grams each;
(d) Snakes which do not contain bichloride of
mercury and pyrotechnic composition not exceed-
ing two (2) grams each;
(e) Wheels with pyrotechnic composition not ex-
ceeding sixty (60) grains for each driver unit
or two hundred and forty (240) grains for each
complete wheel. The inside tube diameter of
driver unit shall not exceed one-half (%) inch;
(f) Whistles , without report and which do not
dart or travel about the ground during discharge
with pyrotechnic composition not exceeding six
(6) grams and containing no picric or gallic acid.
5-3-3 : CONFLICTING ORDINANCES: All ordinances
or parts thereof in conflict herewith are to the extent
of such conflict hereby repealed.
