HomeMy Public PortalAboutOrd. 272 - Snowmobiles McCALL, IDAHO ORDINANCE NO. -2 7 012' AN ORDINANCE RELATING TO SNOWMOBILES; DEFINING THE SAME; ESTABLISHING MINIMUM AGE FOR DRIVERS THEREOF; MAKING IT UNLAWFUL TO PERMIT UNDERAGE PERSONS TO DRIVE THE SAME; SETTING FORTH RE- QUIRED EQUIPMENT; ESTABLISHING REGULATIONS FOR OPERATION OF SNOWMOBILES; AND PROVIDING PENALTIES. Be it ordained by the Mayor and Council of the City of McCall, Idaho, as follows : Section 1. DEFINITION: The term "snowmobile" shall mean every self-propelled device upon a combination of skiis, skids , tracks or endless belts, in and upon or by which any person or property is or may be transported or drawn upon snow or snow covered surface areas , and expressly includes devices known as "snowmobiles" or skimobiles." Section 2. MINIMUM AGE OF DRIVERS: No person under the age of fourteen (14) years shall drive or operate a snowmobile in the City of McCall, Idaho. Section 3. OFFENSES BY PERSONS OWNING SNOWMOBILES: It shall be unlawful for any person to knowingly permit, allow or encourage the operation or driving of a snowmobile by a person under the age of fourteen (14) years. Section 4. EQUIPMENT: No snowmobile shall be operated in the City of McCall, Idaho, unless it is equipped with the following: (a) At least one and not more than two headlamps suffi- cient to render clearly discernable persons and vehicles at a distance of 250 feet ahead. (b) Tail lamps , which when lighted shall emit a red light plainly visible at a distance of 250 feet to the rear. (c) At least one brake which may be operated by hand or foot. (d) A muffler in good working order and in constant operation to prevent excessive or unusual noise and annoying smoke, and no person shall use a muffler cut out, by-pass or similar device. Section 5. REGULATIONS FOR OPERATION OF SNOWMOBILES: (a) It shall be unlawful to drive, operate or park a snowmobile on any sidewalk in the City of McCall, Idaho. (b) No snowmobile shall be operated at a speed in excess of 20 miles per hour in the City of McCall. (c) No snowmobile shall carry passengers or weights in excess of the capacity recommended by the manufacturer thereof. (d) No sled, toboggan, trailer or any other device shall be towed by a snowmobile except by means of a rigid tow bar connecting the same to such device. (e) No person on skiis shall be towed behind a snowmobile. (f) It shall be unlawful to drive or operate a snowmobile while under the influence of intoxicating liquor. PENALTIES : Any person convicted of a viola- tion of this ordinance shall be punished by a fine not to exceed $100.00 or imprisonment in the City or County jail not more than thirty ( 30) days or by both such fine and imprisonment. A 7) • AN >ORDINANCE RELATING TO SNOWMOBILES; DEFINING THE SAME; PROVIDING FOR REGULATIONS THEREOF; AND ESTABLISHING FEES THEREFOR; REQUIRING A DRIVER'S LICENSE; SETTING FORTH REQUIRED EQUIP- MENT; ESTABLISHING REGULATIONS FOR OPERATION OF SNOWMOBILES; AND PROVIDING PENALTIES. Be it ordained by. the Mayor and Council of the City of McCall, Idaho, as follows : Section 1. DEFINt 1'IONS : (a) The term "snowmobile" shall mean every self-propelled device in, upon or by which any person or property in or may be transported or drawn upon snow or snow covered surface areas. (b) The term "owner" shall mean the person, firm or corporation legally responsible for the operation of a snowmobile, whether as owner, lessee or otherwise. Section ^ . REGISTRATION: Every resident of the City of McCall , Idaho, who is the owner of a snowmobile shall register the same- with the City Clerk, who shall for a fee of $ per annum, issue to such owner a registra- tion certificate and .number, which number shall be displayed un each side oi tho hood ur front_ portion of such snowmobile in figures not: 1kss than three ( 3 ) inches in height. Such registration shall expire at: 12 :00 o'clock P.M. on the 31st day of December in _the year which issued. Section 3. DRIVER'S LICENSE REQUIRED: No person shall drive or operate a snowmobile in the City of McCall, Idaho, unless such person has a valid operator or chauffeur' s li- cense issued by l he D •1>,rr 1 nrc•ni of Law Enforcement of the Stale of I.d.rho. REGULATIONS FOR OPERATION OF SNOWMOBILES : (a) It shall be unlawful to drive, operate or park a snowmobile on any sidewalk in the City of McCall, Idaho. (b) Except as hereinafter set forth, Chapter 7, Title 49 , Idaho Code, entitled Operation of Vehicles-Rules of the Road, is hereby adopted for the purpose of regulating the use and operation of snowmobiles in the City of McCall, Idaho. In construing the provisions of such Chapter 7, Title 49, Idaho Code, the word "vehicle" shall be deemed to mean "snowmobile." Not less than three copies of said Chapter 7, Title 49 , Idaho Code, have been and now are filed in the office of the Clerk in the .City of McCall, and the same are hereby adopted and incorporated as fully as if set forth at length herein, save and except as hereinafter set forth. (c ) Not withstanding the provisions of Chapter 7, Title 49, Idaho Code, no snowmobile shall be operated at a speed in excess of 20 miles per hour in the City of McCall.
