CITY OF MCCALL
ORDINANCE NO. 279
AN ORDINANCE RELATING TO ZONING; AMENDING SECTION
5-3-1 OF THE VILLAGE CODE TO INCLUDE CONDOMINIUMS ;
ADOPTING THE IDAHO CONDOMINIUM ACT OF 1965 ; DEFINING
APARTMENTS ; AND ESTABLISHING CERTAIN BUILDING
RESTRICTIONS.
BEIT ORDAINED BY THE MAYOR AND COUNCIL OF THE
CITY OF MC CALL, IDAHO, AS FOLLOWS :
Section 1. That Section 3-5-1 of the Village Code
of McCall, Idaho is hereby amended to read as follows :
3-5-1: RESTRICTIONS IN RESIDENCE "A" ZONE: In
the residence "A" zone no building or premises
shall be used or occupied or hereafter erected,
or structurally altered excepting for one (1)
or more or the following uses :
Residential Dwellings
Apartments
Churches
Schools
Colleges
Libraries
Museums
Parks
Playgrounds
Private Swimming Pools or Public Swimming
Pools in Public Parks
Fire Station, built in residence style
Condominiums
Section 2. The City of McCall hereby adopts and
incorporates herein by reference Sections 55-1501 thru
55-1527, Idaho Code, cited as the "Condominium Property
Act."
Section 3. Each "unit" as defined by Section 55-1503
ss (d) , Idaho Code, is further defined as a separate apartment.
Section 4. No condominium shall be constructed more
than two stories in height and all such condominiums s1a11
be. constructed to conform to surrounding residential style
unless otherwise permitted by the Zoning Commission.
Section 5. In additici to the foregoing uses set forth
in this Section only the following structures and uses shall
be permitted.
Passed and approved by the Mayor and Council of the
City of McCall, this 6th day of May, 1968.
