HomeMy Public PortalAbout20-9758 Approving to Transfer the Source of Funding of the 141 Street Road MillingSponsored by: City Manager RESOLUTION NO. 20-9758 A RESOLUTION OF THE CITY COMMISSION OF THE CITY OF OPA-LOCKA, FLORIDA, AUTHORIZING AND APRROVING TO TRANSFER THE SOURCE OF FUNDING OF THE 141sT STREET ROADWAY MILLING AND RESURFACING PROJECT FROM THE GENERAL FUND TO THE SAFE NEIGHBORHOOD FUND; PROVIDING FOR INCORPORATION OF RECITALS; PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, on February 26, 2020 the City of Opa-Locka ("City") Commission adopted resolution 20-9735, authorizing expenditure of $93,680 of General Fund funds to re -mill a portion of the roadway surface of NW 141st Street (the "Project)"; and WHEREAS, staff recommends that the City Commission approves the source of these funds be changed from the General Fund to the Safe Neighborhood Fund; and WHEREAS, the City Manager has determined that dedicated funds from gasoline tax proceeds are available in the Safe Neighborhood Fund for roadway improvements; and WHEREAS, utilizing the Safe Neighborhood Fund as the funding source for the Project will save the General Fund $93,680, allowing these funds to be conserved to further restore the General Fund Available Fund Balance to approved levels, as directed by the State Operational Audit (Finding #3); and WHEREAS, strengthening the General Fund Available Fund Balance will also serve to strengthen the City's financial buffer as it faces the prospect of future uncertainty due to COVID-19; and WHEREAS, sufficient fiscal capacity in the General Fund is required to fund ongoing City governmental services while projects undertaken in the Safe Neighborhood Fund can be deferred, if necessary, in the future without impacting the City's ability to provide basic services; and WHEREAS, passage of this resolution will result in an encumbrance of $93,680 to be removed from Account #41-541340 - "Roads & Streets - Other Contracted Services" and added to Account #44-541800 - "Safe Neighborhood - Resurfacing Improvements" with the following results as set forth in Exhibit "A"; and WHEREAS, the City Commission finds that it is in the best interest of the City to transfer the source of funding of the 141st Street Roadway Milling and Resurfacing Project from the General Fund to the Safe Neighborhood Fund. Resolution No. 20-9758 NOW THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF OPA LOCKA, FLORIDA: Section 1. RECITALS ADOPTED. The recitals to the preamble herein are incorporated by reference. Section 2. AUTHORIZATION The City Commission of the City of Opa-Locka, Florida hereby authorizes and approves to transfer the source of funding of the 141st Street Roadway Milling and Resurfacing Project from the General Fund to the Safe Neighborhood Fund as set forth in Exhibit „A„ SECTION 3. SCRIVENER'S ERRORS. Sections of this Resolution may be renumbered or re -lettered and corrections of typographical errors which do not affect the intent may be authorized by the City Manager, or the City Manager's designee, without need of public hearing, by filing a corrected copy of same with the City Clerk. Section 4. EFFECTIVE DATE. This Resolution shall be effective immediately upon adoption hereof and approval by the Governor of the State of Florida or his designee. Staff recommends the City Commission approve the source of these funds be changed from the General Fund to the Safe Neighborhood Fund. Background — The City receives gasoline tax proceeds from the State each year, 1 to 5 Cents Local Option Fuel Tax and 1 to 6 Cents Local Option Fuel Tax, which is recorded in the Safe Neighborhood Fund. Under State Statute the proceeds from the 1 to 5 Cents Local Option Fuel Tax can only be used for roadway improvement while the proceeds from the 1to 6 Cents Local Option Fuel Tax can be used for either roadway improvement or roadway maintenance. On February 26.2020 the City Commission adopted Resolution 20-9735 which authorized expenditure of $93,680 of General Fund funds to remill a portion of NW 1415L Street. Current Activity — Staff has made the determination that dedicated funds from gasoline tax proceeds are available in the Safe Neighborhood Fund for roadway improvements. Using this as the funding source for the NW 141st Street remilling project will save the General Fund $93,680, allowing these funds to be conserved to further restore General Fund Available Fund Balance to approved levels as directed by the State Operational Audit (Finding #3). Strengthening General Fund Available Fund Balance will also serve to strengthen the City's financial buffer as it faces the prospect of future revenue uncertainty due to COVID-19. Sufficient fiscal capacity in the General Fund is required to fund ongoing City governmental services while projects undertaken in Safe Neighborhood can be deferred if necessary in the future without impacting the City's ability to provide basic services.
