HomeMy Public PortalAbout20010716REGULAR COUNCIL MEETING JULY 16, 2001 1 CALL TO ORDER The Regular Council Meeting of July 16, 2001, was convened at 6:00 P.M. by Mayor Tom Rackers. Prayer was offered by Councilman Edith Vogel, followed by the Pledge of Allegiance. ROLL CALL The following Council Members were present for the roll call: Present:Blaney, Jackson, Landwehr, Nelson, Olsen, Viessman, Vogel, Vincent, and W eber Absent: Angle* A quorum was declared present. PUBLIC HEARINGS Rezoning 3.78 acres north side 1100 block Boonville Road known as Somerset Meadow Subdivision, from RS-2 (Single Family Residential) to PUD (Planned Unit Development). Janice McMillan, Senior Planner, made a presentation detailing the background of the request for rezoning. After Ms. McMillan's presentation, no one present wished to speak in favor of, or opposition to, the proposed rezoning. Mayor Tom Rackers declared the public hearing concluded. *Councilman Clyde Angle arrived during Ms. McMillan's presentation. ITEMS TAKEN UP OUT OF ORDER ON THE AGENDA Mayor Tom Rackers stated that unless Council objected, he would like to take up some agenda items out of order at this time to facilitate several citizens who were attending the meeting for those specific items. There were no objections from the Council. NEW BUSINESS Consideration of Hearing on Leslie Blvd. Appeal — A motion was made by Councilman Charles Jackson that the Council hear the appeal at its regularly schedule Council Meeting on August 6, 2001; motion seconded by Councilman Carol Blaney and approved unanimously. REGULAR COUNCIL MEETING JULY 16, 2001 2 Mayor Tom Rackers reminded citizens present that they are welcome to attend that meeting and make their statements at that time as part of the official hearing record. PRESENTATIONS FROM THE GALLERY Mr. Charles Foster, 1036 Boonville Road, stated that he has been a resident of Jefferson City since 1956, and that he was an educator since 1946. Mr. Foster stated, on behalf of a large group of people in attendance at the meeting, that he felt it was important to adopt Resolution RS2001-12 indicating the City's willingness to participate in the efforts to teach character traits in all available outlets within the City through the “City of Character” program. Mr. Mark Miles, 200 Hart Street, made a presentation on behalf of a group of citizens who are attempting to establish the Lower Jefferson Conservation District in an effort to preserve their neighborhood. RESOLUTIONS RS2001-12 — Designating Jefferson City as a “City of Character” (Landwehr & Nelson). A motion was made by Councilman Bob W eber for adoption, seconded by Councilman Charles Jackson and approved unanimously. CONSENT AGENDA The following items were presented to the Council for their approval by consent: a.Council Meeting Minutes June 18, 2001 b.Approval of Permissive Use Request at 1103 Southwest Blvd. A motion was made by Councilman Carol Blaney for approval of the Consent Agenda, motion was seconded by Councilman Bob Weber, and approved unanimously. BILLS INTRODUCED Bill 2001-45, sponsored by Councilman Vincent, entitled: AN ORDINANCE OF THE CITY OF JEFFERSON, MISSOURI, AUTHORIZING THE MAYOR AND CITY CLERK TO ENTER INTO A SUPPLEMENTAL AGREEMENT WITH THE MISSOURI DEPARTMENT OF TRANSPORTATION FOR PEDESTRIAN/BICYCLE FACILITIES. Councilman Larry Vincent requested that the rules be suspended and bill 2001-45 be placed on final passage at this time so the project could be expedited. Councilman John Landwehr requested that Bill 2001-11 be removed from the Informal Calendar and placed on final passage at this time. Bill 2001-11 was read third time by title, placed on final passage and defeated by the following vote: REGULAR COUNCIL MEETING JULY 16, 2001 7 Aye:None Nay:Angle, Blaney, Jackson, Landwehr, Nelson, Olsen, Viessman, Vincent, Vogel and W eber RESOLUTIONS RS2001-11B**Authorizing Application for MoDOT Operating Grant for Transportation Services (Blaney) Councilman Clyde Angle requested information from Public W orks Director Marty Brose regarding Sho-Me Coach Lines as it would pertain to any agreements with the City. Mr. Brose stated he would provide that information to the Council. A motion was made by Councilman Larry Vincent for adoption of RS2001-11B, seconded by Councilman Carol Blaney and approved unanimously. **so numbered to correct a duplication in resolution numbers. NEW BUSINESS Schedule Finance Committee Meeting: The suggested date of Thursday, August 9, 5:30 P.M. Large Conference Room was agreed to by the Council. Councilman Larry Vincent stated that it looks as if the Council will have the proposed budget before that meeting, and he asked Council Members to be thinking about which subcommittee they would like to serve on so he could assign those members accordingly. Those subcommittee will be chaired by Councilman Charles Jackson, Councilman John Landwehr, and Councilman Cliff Olsen, and Councilman Vincent reminded the Council Members that all members are welcome at all the meetings and their input is always welcome. He briefly touched on the time line for the entire budget process. Half-Cent Sales Tax Meeting — After a brief discussion, it was finally agreed that the best date to schedule the meeting would be W ednesday, August 1, at 12:00 noon. Councilman Roy Viessman mentioned a letter he and other Council Members had received from the local F.O.P. Chapter regarding their concerns with issues regarding police personnel. Mr. Viessman suggested that Council look closely at those concerns. Councilman Carol Blaney asked Public W orks Director Marty Brose who citizens could call when they have questions regarding work currently being done by the gas company to city streets which affect citizens' private property. Mr. Brose stated they could call his office at City Hall and he can give them the information they need. Councilman Clyde Angle made comments regarding pending litigation cases involving the City, and requested that those cases be discussed at a Closed Session at the August 6 Council meeting. Councilman Cliff Olsen announced that the storm water questionnaire will be going out within the next week, and reminded citizens about the July 26 “open house” storm water REGULAR COUNCIL MEETING JULY 16, 2001 8 meeting for W ards One and Five at City Hall from 6:30 - 8:30 P.M. Those meetings are posted on the City Council's Internet meeting calendar at www.jeffcity.net/cityclerk. UNFINISHED BUSINESS Councilman Bob W eber asked City Counselor Allen Garner to briefly explain the process that is required concerning the Leslie Blvd. appeal hearing which Council has set for the August 6 Council Meeting. Mr. Garner outlined what procedures or actions are legally required of the Council when such an appeal has been filed. Councilman Clyde Angle asked for an update on the cleanup of the old “Gundelfinger” property located on E. High. City Administrator Rich Mays stated that the City did not pay anyone to clean up the property, but that the Parks and Recreation and Public W orks Departments had cleaned up a lot of the debris and placed a fence along the High Street side of the property and temporary fences along the south and west portions. Parks and Recreation Department Director Bill Lockwood stated that he has staff do weedeating periodically, and removed a steel beam in response to an emergency request, but that their department has not had the time or resources to do much more than that. He stated he could discuss with the Council a plan to do more work if needed. Councilman Clyde Angle mention the CVB Board issues which he had mentioned at prior meetings, and stated he feels there are serious issues that need to be addressed. Mayor Tom Rackers stated if Council has any concerns at this point he is not aware of them. Councilman Clyde Angle made comments regarding the issue of unsafe sidewalks in the downtown area based on claims which have been filed in connection with them, to which the city is a party in litigation. He asked if sidewalks that are perceived as dangerous can be repaired before the sidewalk contract work begins in March 2002. Charles Jackson suggested that Mr. Angle's concerns could be addressed at the August Public W orks and Planning Committee meeting, as well as some concerns he has been made aware of by the Apartment Association. Councilman Larry Vincent asked that staff provide Council with what costs would be associated with repairing the downtown sidewalks before the 2002 contract work begins. COUNCIL LIAISON REPORTS Councilman Larry Vincent announced that the Park Board now has Facility Use Agreement and a Co-Sponsorship Agreement and that the Park Board has a co-sponsorship policy in place. He also stated that a recent unannounced audit of the city's Parks and Recreations aquatic facilities by Jeff Ellis and Associates, an international aquatic safety and risk management consultant, had indicated that the City's park staff at Jefferson City's aquatic facilities had exceeded the standards for their audit. Councilman Vincent said the Park staff were to be commended for that rating. Councilman Carol Blaney announced a meeting of the Bicycle and Pedestrian committee for W ednesday, July 18, at 7:00 P.M. in the upper conference room at City Hall.
