TEMPORARY CONSTRUCTION AND ACCESS EASEMENT
The Rio Vista Homeowner's Association, hereinafter "Grantor", hereby grants
unto the City of McCall, its agents, employees and contractors, hereinafter "Grantee", a
temporary construction easement, referred to as TCE, and access to come onto Grantor's
real property for the limited purpose of performing construction activities to facilitate
construction of the McCal1 2009 Lift Station 8 Improvements Project and specifically to
construct a new wet well and dry well for replacement of the existing system. The real
property which is subject to this TCE is described as follows:
Up to forty-eight feet (48') from the existing generator building as shown on the
attached Exhibit 1.
The purpose of which is to effect:
construction of a new wet well and dry well for replacement of an existing system
for the Lift Station 8 site.
This easement will be exclusively for the time period from August 12, 2009,
through December 30, 2009, at which time Grantee shall record a Release of this
easement.
All fences, ditches, utilities, signs, native grasses/topsoil, trees, hedges, flowers,
etc. located within Grantor's real property that are disturbed or in any way altered or

damaged, other than where shown to be removed or modifi: d2during`construction shall be
repaired or replaced to the condition, in the opinion of the. Grantor, 4u conjunction with
the City of McCall, existing prior to any construction=activities. The Grantee agrees to
allow access at all times to the Grantor for the sole purpose of operating and maintaining
the monitoring well located on or nearby the TCE. The Grantoriitagrees to''accept water
from the dewaterprocess into the drainage systems leadinto` the Ri Vista and and the

Grantee is fully responsible for maintaining an approved andrttceptable,system for
dewatering the construction such that water flowing into the pond does not carry excess
sediment. Additionally, the Grantee agrees to reimburse the Grantor for the cost of power
associated with running the pump at the monitoring well starting from October 1, through
the completion of the project.
Grantor, its successors and assigns, hereby covenant to and with Grantee that its
officers, agents or employees may at any time and all times, when necessary or
convenient to do so, go over and upon the Premises and do and perform any and all acts
necessary or convenient to the carrying into effect the purposes for which this grant is
made.
