Call to Order The regular meeting of the Community Development Block Grant Advisory Board Commission was called to order by Chairperson Ventura, on the above captioned date at 6:00 p.m., in the Council Chambers of Lynwood City Aall, 11330 Bullis Road. B. Flaq Salute The flag salute was led by Commissioner Byrd, all those present participated. C. Roll Call Commissioner Ventura requested the roll call, and Ms. Clark complied. Present: Chairperson Ana Ventura Vice Chairperson Ken Wibecan Commissioner Kenneth Alford Commissioner Margaret Araujo Commissioner Laura Byrd Commissioner Constance Franklin ' Commissioner Claude Law Also: Annette Clark, HCD Manager � Chondra Handley, Minutes Clerk � D. Certification of Aaenda Postina bv City Clerk � Ms. Clark stated that the Agenda was posted per the Brown Act. � E. Aooroval of Minutes MOTION by Commissioner Franklin, SECONDED by Commissioner ; Alford to approve the Minutes of August 5, 1992. MOTION � carried unanimously. I F. Public Orals ' NONE i G. New Business I 1. APPEAL - REQDEST FOR SUSORDINATION i Ms. Clark opened discussion by explaining Ms. Amey's ' request for subordination reavaluation. � Commissioner Law stated that the applicant received a I loan when the property was in her name only. While i reviewing the submitted information he noticed that ' another name has been added to the property, and � withdrawn once again. Commissioner Law asked if this was i a violation of the Rehabilitation Regulations. � Ms. Clark replied yes. i � ; � � � � � . � � � , Commissioner Law asked why is this case permitted to an appeal if this is in fact in violation of the Rehabilitation Regulations. Ms. Clark replied that the homeowner requested an appeal. Staff was directed by Sol Blumenfeld, Director of Community Development, to re-submit the case for evaluation. Commissioner Wibecan asked if staff had any recommendations. Ms. Clark replied that staff had no recommendations at this time. Commissioner Franklin asked if the City Council could overrule the Commission's decision. Ms. Clark replied yes. The City council could overrule any decision by the CDBGAB Commission. Commissioner wibecan asked if the applicant violated any other rules of the Rehabilitation Program. Ms. Clark said the the applicant is not within the income guidelines and the property title has changed, which are two violations of the Rehabilitation Guidelines. Commissioner Law stated that the Commission has HUD guidelines in which it must follow, and the applicant does not meet the criteria for a subordination. Commissioner Law suggested that the previous decision to deny the subordination, remain in effect. Commissioner Byrd asked if the applicant is out of compliance with the regulations, would she have to pay ! the city now plus interest. Ms. Clark stated that the City should receive payment from the proceeds of the refinance. The only other I ' alternative would be for the City to foreclose on the ' property, but the City does not wish to do that. � Commissioner Byrd asked if the applicant was in default how long di_d she have before the IRS foreclosed on the ' property. Commissioner Araujo stated that the IRS will give up to � five years to pay the liens off, which can be paid any , given year. Commissioner Byrd asked about the applicants income. Ms. Clark replied that the income reported on the application is a combination of Ms. Amey's and her ' husbands. Upon submittal of the first application, both ' incomes were reported. When she requested a appeal only her income was reported. Commissioner Wibecan asked if the Commission denied the j request for subordination, what would happen to the � property. i Ms. Clark replied that the finance company, who is giving � Ms. Amey the loan will probably pay the City off. Commissioner Byrd asked if staff has spoken with the homeowner, and has she indicated her reasons for not ' wanting to pay off the City loan. � I ; I � t 1/ � , ' � I , Ms. Clark �plied that the homeowne�stated that she : • could not afford to pay back the loan at this time, nor is the loan due. Commissioner Byrd asked what would happen is the City subordinates. Ms. Clark stated that the applicant has a first trust deed and a second trust deed, which is the City's. After she pays the first off, the City automatically moves up to first position. However, the finance company, who is processing the refinance, would like for the City to stay in second position, thereby giving them the first position. If the property goes into default they have the right to sell the property. Commissioner Law stated that the homeowner is in no danger of loosing her property. She just does not feel that she should have to pay the City's loan off at this time. He reminded the commission that there are guidelines that have to be followed. Commissioner Araujo stated.that she has reviewed the information in the package, and due to previous problems with HUD for not following the guidelines, she does not recommend subordination. Ms. Araujo stated that Ms. Amey is not in danger of loosing the property at this time. Ms. Araujo stated if Ms. Amey request that the subordination go to Council for an appeal she has that right, but the Commission has to follow the guidelines. Commissioner Ventura requested a vote to approve or deny the subordination . � Commissioner Wibecan motioned to deny the request for I subordination. i Commissioner Law seconded the motion. All commissioners were in favor of denying the request for subordination. � A. Staff Orals � � 1. Ms. Clark asked if everyone received their invitations to � the Insulation Dinner given for Mayor Pro-Tem Paul �� Richards given September 10, 1992 at 6:30 at Bateman 1 Hall. i The majority of the commissioners stated that they ', received their invitations, however, a few needed to I check their mail. t Ms. Clark asked the Commissioners to inform her if they � had not received their invitations by the next day. � I. Board Orals ' 1. Commissioner Law said he was pleased to see the � completion of the Community/Transit Center. Mr. Law � request to see final cost figures. , Commissioner Ventura asked Ms. Clark if they were ; . available yet. , ; ; Ms. Clark said no the final cost figures are not available, because they are working from a punch list, i however the total CDBG amount will be available in the ! Grantee Performance Report at the next meeting. � I � i � � � I r � � , � � t ; I 1 Commission Law stated that he would ike to have more informatior�n the redevelopment of pr�ct area "A" and • ' how it involves CDBG. Ms. Clark stated that CDBG in not involved at this time. She stated that Mr. Blumenfeld is proposing to submit the application for 108 funds to assist in the efforts of redevelopment. When this information becomes available the Commission will be given copies. Commissioner Law stated that due to his difficulty with traffic, the grace period of fifteen minutes, before the meetings would begin was helpfull. He stated that he was very disapointed to read the minutes and discover that the grace period has been changed. Commissioner Ventura stated that the Board had the power to change the time of ineetings if it is requested to do so. Commissioner Byrd stated that she has no problem with the time. Commissioner Wibecan stated that he to was disapointed to attend last meeting which was half over when he arrived. He also stated that the chairperson does not have the ' power to change the meeting time. Commissioner Araujo stated that although she works in the City , she also has other things to take care of before she can attend the meeting. She felt that the board members who do not work in the City needs that grace period. Ms. Araujo also requested an update on the Genesys Program. Ms. Clark said that there is nothing to report at this time. The contract has to be signed and other steps have to be taken before the program receives funds. Commissioner Araujo asked if the Senior Citizen Grant Program was effective at this time. Ms. Clark replied yes. Staff advertised the program on I the water bills, and have received many inquires. Commissioner Ventura expressed her apologies to the � Commission. She stated that her intentions were not to inconvience anyone. If the commission wanted to vote to i renew the fifteen minute grace period, that would be � acceptable. Before adjournment Commissioner Byrd stated that she ; would not be able to attend the next meeting, and asked ' to be excused. Staff replied that her request would be noted. i Motion to start the meetings at 6:15 was made by � Commissioner Wibecan. Commissioner Law seconded. Motion ! carried unanimously. ; J. Assessment of the relationshin of the use of Communitv Develogment block Grant (CDBG) funds to locallv identified Communitv Develooment Obiectives. Community Development Objectives described in the 1991/92 Final Statement of Objectives include the following: Community Conservation: Enable citizens to live in a safe, decent and sanitary environment through the continuation of various housing and property improvement and code enforcement programs. Housing Rehabilitation and Improvements: As part of its effort to preserve and upgrade the City's housing stock, the City has continued to offer Deferred Payment Loans (DPL) and Grant to low and moderate income residents. Code Enforcement: The City has continued its code enforcement program to help eliminate and prevent slum and blighted conditions. Public Services: The City's.objective in public services was to improve public services and facilities. The City contracted with the following subrecipients: Project Impact and the Fair Housing Foundation. In addition, the City funded several in-house public service projects. Through these programs, over 1,000 low and moderate income persons benefited from public services. 2. An assessment of the relationshio of the use of Communitv Develooment Block (CDBG1 funds to the National Obiectives. Each activity listed above directly supports one or more of the National Objectives. Program guidelines regarding that DPL and Grant recipients have income at or below low and moderate income limits. Assessment of the relationshio of the use of Communitv Develoament block Grant (CDBG1 funds to locallv identified Communitv Develonment Objectives. Community Development Objectives described in the 1991/92 Final Statement of Objectives include the following: Communitv Conservation: Enable citizens to live in a safe, decent and sanitary environment through the continuation of various housing and property improvement and code enforcement programs. Housing Rehabilitation and Improvements: As part of its effort to preserve and upgrade the City's housing stock, the City has continued to offer Deferred Payment Loans (DPL) and Grant to low and moderate income residents. Code Enforcement: The City has continued its code enforcement proqram to help eliminate and prevent slum and blighted conditions. Public Services: The City's.objective in public services was to improve public services and facilities. The City contracted with the following subrecipients: Project Impact and the Fair Housing Foundation. In addition, the City funded several in-house public service projects. Through these programs, over 1,000 low and moderate income persons benefited from public services. 2. An assessment of the relationship of the use of Community Develooment Block (CDBG1 funds to the National Obiectives. Each activity listed above directly supports one or more of the National Objectives. Program guidelines regarding that DPL and Grant recipients have income at or below low and moderate income limits. Throuqh contractual agreement with subrecipients, each of the public service programs served at least 70$ low and moderate income persons. Page 1 of 2 ; • � � ; 3. The City certifies that during the 1991/92 program year, at least 70 percent of CDBG funds were expended for activities benefiting low and moderate income persons. 7b. NARRATIVE: 1. The nature and reasons for chanaes in the Citv's CDBG Proaram Obiectives. There was a Substantial Change made to the City's Final Statement in order to reprogram funds from slow movinq activities to other eligible activities in need of additional funding, HUD Los Angeles Region office was mailed copies of the Substantial Change in May of 1992 and August 6, 1992. 7C.
