JOINT SESSION
HAL HARBOUR VILLAGE
CITY OF NORTH MIAMI
MARCH 2, 1994
The ,joint session of the Village council of Bal Harbour and
City Council of North Miami was held on Wednesday, March 2, 1994.
in the Council Chamber of the Town of Bay Harbor Islands. The
meeting was called to order at 4:05 p.m. by Mayor Spiegel. Those
present were:

Mr. Wolpin explained at the last Council meeting of the City of
North Miami he was directed to prepare a proposed resolution for
consideration at their next Council meeting. He then proceeded to
distribut a copy of the proposed resolution. which would expressly
provide assurances to Bal Barbour Village. Such as, no
construction will commence on the project, and no building permit
will be issued unless each of the 11 tasks of the Comprehensive
Noise study has been completed.
Mr. Poole stated that all the documents have been reviewed, and the
conclusion that was reached is that Dr. Dunn will begin his studies
independent of Dr. Bragdon. He continued to explain the
information will be shared, so that they know what one another is
doing.
Ms. Delegal stated the purpose of the meeting is to comply with the
requirements of Florida Statute Chapter 164. She continued to
explain she is authorized to present to the City of North Miami a
resolution of the potential litigation, that is, a complete
enclosure of the amphitheater and the prohibition of any devices on
the structure that would allow the amplification of any noise from
within into the parking area or into outside at all.
Discussion followed. Assistant Mayor Blank questioned if the City
of North Miami would answer whether or not they are considering
enclosing the entire amphitheater. Mr. Wolpin replied no.
Councilman Hirschl stated that would conclude this meeting.
Councilwoman Carr questioned if another meeting should be
scheduled. Councilman Premer stated statutorily, they have met
their obligation. The meeting adjourned at 4:40 p.m.
