Bulanda, Administrative Analyst III �^ SUBJECT: NO SMOKING ORDZNANCE OBJECTIVE To zecommend that tha City Council adopt the attached No Smoking Ordinanca. FACTS Numerous studiea hava. lound that tobacco smoka is a major contributor to indoor air pollution; and • Reliable studies have shown that breathinq second-hand smoke is a • siqnificant health hazard for certain population qroups, includinq elderly paople, individuals with cardio-vascular disease, and individual with impaired respiratory lunction, includinq asthmatics and those with obstructive airway diseases; and ~ Health hazards induced by breathinq second-hand smoke include lunq cancer, respiratory infection, deczeased exercise tolerance, decreased respiratory lunction, bronchoconstriction, and bronchospasm; and Non-smokera who su!!er allerqies, respiratory diseases� and other ill eflects o! breathinq sacond-hand smoke may axperience a loss of job productivity oz may be forced to take periodic sick leave because of adverae reactions; and . Smokinq is a documented cause ot fires; and ANALYSIS Accordinqly, it has been determined that the health,'�safety and general welfara ot residents o!, persons employed in and persons who frequent�.�,this City would be benetited by the alimination of smokinq< enclosed areas. , �"-; . ,; ;:. „•a, .�t'k.. -..�k�i, RECOMMENDATION � Staff respactlully request that upon consideration ot said facts, � that the City Council waiva the readinq and introduce tha ordinance � for first readinq. , ! � I ACFNDA ITFI1 � , it�nc-°- - e AN OR ANCE OF THE CITY COUNCI THE � CITY OF LY�OD� CALIFORNIA, ADDING �TION 3-18 TO THE LYNWOOD MUNICIPAL CODE PROHIBITING SMOKING IN ALL CITY OWNED BUILDING FACZLITIES THE CITY COUNCIL OF THE CITY OF LYNWOOD, CALIFORNIA, DOES ORDAIN AS FOLLOW3: BECTION i. Section 3-18 is hereby added to the Lynwood Municipal Code to read as followa: 3_18 PROHIBITING SMOKING ALL CITY OWNED HUILDING3 OR FACILITZES. �-18.1 DEFINITIONS: As used for tha purpose oP this section, unless the context otherwisa clearly indicates: "SMOKE oR SMOKiNG" shall mean the carryinq or holdinq of a lighted pipe, ciqar, cigaratte or any other lighted smokinq equipment or the ligiiting or emittinq or exhalinq of the smoke of a pipe, cigar, ciqarette, or other kinds of equipment. Smoke also means the gaseous products and particles created by tha use of a lighted pipe, ciqar, ciqarette, or other kind of smokinq equipment. 3_18•2 �mokinc in Citv-owne� h+���.��� � or fac{��r�pg urohibited. - Zt shall be unlawful for any peraon to smoke in any building or facility owned or leased by the City or the Lynwood Redevelopment Agency which ia used for -. qovernmental purposes. Notwithstandinq this prohibition, the City Manaqer may desiqnate smoking areas within such building or structure. 3-18.3 Exemntions Tha prohibition contained in Section 3-18.2 ahall not apply i to the walk ways or the outside areas of buildings or facilities owned or leased by the City or the Lynwood j Redevelopment Agency. , . 3_18•4" I The City Manaqer is directad to post and prominently dispiay � No Smoking signs at the entrance to buildinqs or facilities � aubject to the prohibition contained in Section 3-18.2. The City Council hereby � declares that it would have adopted thie ordinance, and each section thereof, irrespectve oP the fact that any one or more sections, subsections, or sentences be declared invalid or unconatitutional. . , -- I � - � , , � � :� �ection 3. The City Clerk shall certify to the passaqe of this ordinance and shall cause same to be published once in the Lynwood Press within fifteen days after its passaqe and said or ordinance ahall become affective thirty (30) days after its passage.
